Prevention of Children from Sexual Offences Act (POCSO Act) | Provisions, Offences & judgements | पोक्सो एक्ट | Section 2 | Ministry of Women and Child Development | Penetrative Sexual Assault | Section 3 | Aggravated Penetrative Sexual Assault | section 5 | Sexual Assault | Section 7 | Aggravated Sexual Assault | Section 9 | Sexual Harassment | Section 11 | Child Pornography | Section 13
The Prevention of Children from Sexual Offences (POCSO) Act was enacted in India in 2012 to protect children from sexual abuse and exploitation. The Act defines a child as any person under the age of 18 years and covers sexual offenses against children, including sexual assault, sexual harassment, and pornography.
The POCSO Act provides for special procedures for the handling of cases involving children and aims to ensure speedy justice for child victims of sexual abuse. The Act also provides for the establishment of special courts to hear cases under the Act and for the appointment of special public prosecutors to handle such cases.
The Act provides for stringent punishments for offenders, including imprisonment for a term ranging from three years to life, depending on the severity of the offense. The Act also provides for the mandatory registration of sexual offenders, and their details are maintained in a national database.
The POCSO Act recognizes the need for counseling and rehabilitation of child victims of sexual abuse and provides for the appointment of support persons to assist and counsel the child during the trial. The Act also provides for the compensation to be paid to the victim for physical and mental trauma suffered as a result of the offense.
Overall, the POCSO Act is an important step towards protecting children from sexual abuse and ensuring that offenders are brought to justice. It also highlights the need for society to take responsibility for protecting the most vulnerable members of our community.
