How long can a creditor collect an old debt?
The answer depends on the type of collection activity:
1. A creditor can file a lawsuit within the "statute of limitations" -- which here in FL, is generally 𝟰-𝟱 𝘆𝗲𝗮𝗿𝘀 from the date of your last payment (unless a different state law applies in your cardholder agreement).
2. A creditor can report information to the credit reporting agencies for 𝟳 𝘆𝗲𝗮𝗿𝘀 from the date of your last payment.
3. A creditor can informally contact you by letters, calls, etc. to collect a debt 𝗶𝗻𝗱𝗲𝗳𝗶𝗻𝗶𝘁𝗲𝗹𝘆 but, if applicable, must also inform you that the debt is outside the statute of limitations.
If you're receiving informal collection communications by letters, calls, etc., 𝗱𝗼 𝗻𝗼𝘁 𝗺𝗮𝗸𝗲 𝗮 𝗽𝗮𝗿𝘁𝗶𝗮𝗹 𝗽𝗮𝘆𝗺𝗲𝗻𝘁 𝘁𝗼𝘄𝗮𝗿𝗱𝘀 𝘁𝗵𝗲 𝗱𝗲𝗯𝘁 𝗼𝗿 𝗮 𝘄𝗿𝗶𝘁𝘁𝗲𝗻 𝗽𝗿𝗼𝗺𝗶𝘀𝗲 𝘁𝗼 𝗽𝗮𝘆 the debt because that can re-start the statute of limitations.

just before I moved to a new state, my then-doctor started a new practice. I went and saw him while everything was still sort of new, the building was still under construction, and there were new office workers. They filed my paperwork wrong, or neglected to send it to my insurance, and the day before the move I stopped by to discuss it with them. Once they realized their error, they made plans to re-submit to insurance, and that was that. Then 8 years later the debt collector calls me. I told them that my insurance had been billed, my portion paid, end of story. They were adamant that I owed, so I told them to send me a bill, including the date of service, the information about sending to insurance, etc, and I told them I would get proof of the fact that I had already paid.. They never called me back.
Just got a call about a debt that I'm pretty sure I last paid over 10 years ago, so I basically told the lady I was gonna dispute it, cause yeah, the date she gave me was wrong since I had not taken out any loans or used any credit cards since 2013 due to multiple personal life issues that made doing that type of stuff impossible.
So what happened? I allegedly have one from no more recent than 2011, P.Recovery said they purchased it in 2013, but showing “opened 2019” on my report. Haven’t made contact or payment.

Hey I have a unique case I can’t find an answer to. I had lawsuit papers posted on my door today from a car debt 5 years 11 months and 2 weeks ago. In Michigan where I’m from the statute of limitations is 6 years. Can I wait this case out 2 more weeks and clam that the statute of limitations ran out to get the case dismissed? Or do the debt collectors have a case since they filed before the 6 year mark? The expiration date for the case on the paper is 4/6/23. Thanks and great video!

I have been contacted by a collector for a debt from 30 years ago. When I paid by check I wrote paid in full. Which I was told by my X husband it was the last and Final payment. Him my X is deceased. Now this collection person from California is after me 30 years for a something I thought I payed off. Question: can this collection agency take me to court or make me pay something I thought was paid off after 30 years?
Hi there, I'm having a problem with a flight school in florida, they charged me $16,000 in 18 days, then later after 18 days got my signature on the pricing breakdown/estimate, and then few days later gave me a printout of the charges they had slapped me with without my authorization! So the charges predate my signature and the printout of the charges was after the day I signed (everything dated) ... loan is through Meritize... what can I do about this? I quit the school and left because they were a scam operation (also have proof)... I've called the bank several times and they said they are investigating (that was few months ago and I still haven't heard back) I just sent a dispute with the credit bureaus and waiting
