I'm literally about as conservative Christian as you can get, being a Southern Baptist who doesn't agree with current American politics, and I still celebrate Halloween, because Halloween is just a holiday to celebrate the spooky side of things, it doesn't have to be satanic in nature. Heck, as far as I'm aware, Halloween was created by a catholic saint.

All Saint's Eve is another name for Halloween, as it is the day before the aptly-named All Saint's Day.
You need to contact his firm and alert them that he is using their information in threats. This is highly unethical. As a CPA who does audits, if I made similar representations to clients under audit to have them behave how I saw fit I would lose my license faster than you can say “you thought”. Not to mention this puts his whole firm at risk from a liability standpoint, you know this isn’t his first time pulling this.

I'm a Christian and I think that was unnecessary. Halloween is a funny and socially positive for everyone because it unites a long distanced society. I'm so disappointed of the people of today's world they are not down to earth. Keep doing the great job Optimus and we wait for your October uploads.

The sad thing is that I’m a Christian and Halloween is my 2nd favorite holiday (right under Christmas of course). Christians like this guy are the reason why atheists think we’re crazy.

As for the helicopter father part - what else do you call a parent who has such an overblown sense of self that they would actually try to sue a CZcamsr just so that their kid doesn't see them? Nevermind that CZcams Kids is a thing now.

When being a parent is too much of a burden so you have to blame others because you can’t be a good parent yourself.
This guy can't be a lawyer. One, he doesn't understand that everyone is entitled to their own opinions, often opinions that are protected speech under the First Amendment, two, I don't believe he knows what the word fraud even means. In order for Optimus to commit fraud, he has to tell someone or maybe his viewers about some facts that he deliberately misrepresents in order to make them give up their possessions or their rights. Optimus has committed no crimes in any of his videos, and the fact that he didn't show any proof is mind-boggling.
Third, if he's really a lawyer, then he has either cheated at a bar exam, or he doesn't have the maturity, professionalism, intellect, or temperament to be a licensed attorney. Other than not knowing what fraud is, the fact that he had the audacity to try to get CZcams to censor Optimus's video about Halloween, just because he's a Christian and doesn't like Halloween may actually constitute a violation of the First Amendment, and will likely get him disbarred if not sanctioned.
And as a Christian myself, I am extremely disappointed in the way he sent that email. And if he's really a dad, then he's a horrible one at that, the doxxing of his son's name is the perfect proof of that. If this really was a lawyer, then no wonder so many people hate lawyers, because he just made all of the lawyers in this country look bad.

Not surprising. The south tends to be more religious than in the north. Plus if this “lawyer” came from the southern states, then this email might be believable, but still very ridiculous, not to mention unconstitutional.

Okay, I was listening to this as kinda a mini-podcast while I walked between classes at my University. The moment I heard him say that showing videogame clips while talking about different stuff is legally *FRAUD*, I knew for a fact that he was either a lunatic, or knew literally nothing about law.
"Fraud" isn't just when you "lie" or "present false information" to someone. It's when you do that in a *deceitful* or *malicious* way in an attempt to get some kind of financial/personal gain.
In this way, it is almost IMPOSSIBLE for a commentary channel such as this to be convicted of Fraud, as the entire purpose of a commentary channel is to provide the channel owner's personal opinion on a topic, and thus it is not plausible (with plausibility being a cornerstone in all tort, i.e. personal wrongs, cases) that someone in this manner could commit a tort. It would essentially be the same in a legal view as suing a comedian for fraud when he/she says that their jokes are impossible not to laugh at. You could say that hearing a comedian say that their jokes are the best would incentive you to go to their shows and spend money to possibly see them at a showing. However, it's POSSIBLE that this was done by the comedian in an attempt to commit fraud against the general public to gain more ticket sales, but it's not PLAUSIBLE, as it would be idiotic to assume that complimenting one's own comedic skills is an attempt to deceive others, not to mention that a major aspect of comedy is deceiving others regardless (This Possible vs. Plausible in tort cases is what prevents the US government from being sued by people when they're detained in something like a terrorism case because they match up with the suspects, such as shortly after 9/11, as while it's *possible* that they were targetted for discriminatory reasons, it's not *plausible* that it is a falsely-applied way of discriminating against them, since people nearby a terrorism scene wearing, say, traditional Middle-Eastern Islamic garbs would be prime suspects in an ISIS terrorism attack, rather than the businessman in a tuxedo and red tie walking down the street on his way to work).
Thus, in this way, you CANNOT be sued for fraud for the things he mentioned here. It's genuinely insane to think it would be possible to sue a CZcams commentary channel for following its "job" procedures. If they were attempting to promote an item as being part of a "sponsorship", when in reality it was their own product that 100% of sales went to, then THAT would be fraud. However, showing CoD gameplay while talking about recent events can in no way be considered fraud, as there is no attempt to either deceive, or use it as an attempt to receive personal gain (in that showing videogame clips would somehow benefit you more than showing only clips of whatever you're talking about).
Also, while certain types of Fraud such as credit card fraud or insurance fraud are felonies, the type of fraud he's describing here would NOT be a fraud, and would ONLY be taking to court if the guy personally filed a lawsuit against Optimus, and even then he'd have to prove that he was genuinely deceived by the fraud, because as far as I know you can't sue someone for fraudulent practices against someone else, but he'd also have to prove that he was somehow greatly inconvenienced (And I mean the kind of inconvenience of having to wait in traffic for 7 hours, not the kind of inconvenience when someone doesn't hold a door open for you when your hands are full), or suffered some kind of financial, intense emotional, or physical injury, which he clearly did not suffer from watching a commentary youtube video.
Of course, none of this is to mention the fact that no legitimate courts would take his lawsuit seriously, as the basis for it would be seen as a waste of time for the courts.

I doubt the email was from a real dad, the "as a lawyer" line is used for intimidation by people who think that is enough. If it were true, he would not say "as a lawyer", he would say something more along the lines of "I am an associate of Miggliachi and Rathod Law Firm" and list specific legal violations. They tend to try to settle disputes out of court first, there are a number of processes for that which are easier and more reliable to deal with for both parties in many situations.
EDIT - the points listed in the email do not address specific legal violations. It is not in the format of a legal notice, demand letter, or any formal documentation.

As far as I can remember, the only holidays that currently deal specifically with candy are Valentine's Day, Easter, and Halloween (and maybe Christmas??). Easter is a certain religion-only holiday, and even then, the distance between Easter and Halloween is massive in terms of time (months, even). If this dude's child is eating so much candy already that the mere idea of them celebrating Halloween the traditional way (by going to get candy from strangers after several months of no candy-related holidays) is a problem, that's a parenting problem and a parenting issue and needs to be dealt with by the dad. Nobody else.
This guy is a massive, parental *failure* if he doesn't claim responsibility when it comes to what his kid sees/views/watches, especially on the internet and television. He and parents like him need to stop asking for the internet/tv/movies/whatever to parent their kids for them and then complain (despite them not watching the content in the first place to know what it's about????) when some of those things aren't exactly child-friendly and/or have content that said parent doesn't like. Not everything in those mediums was intended/made for children in the first place, anyway.

I love ghost stories, I’d be happy if you only made one Halloween video with ghost stories.
I’ve always believed in ghosts/spirits/demons, and those stories always fascinate me because it makes you wonder if it’s real what the people in the story are going through or if they are just REALLY good at story telling.
And I’ve always wanted to explore a legit haunted building with other people, so as fake as some ghost stories and evidence are, there are some stories and pieces of evidence that while could be faked, I personally don’t see a natural explanation to some or the stories or ghost evidence, and to me it’s just hopeful thinking that it’s 100% legit evidence and stories.
This makes me wanna celebrate Halloween even harder
