I am so glad she got her name back. It is utterly RIDICULOUS to have your birth name stolen by a corporation. ALWAYS read the fine print before you sign ANYTHING, y'all

I am glad she is back. She made some awesome dresses in the past. Also, I do hope from now on, she will have any contract looked at by a legal team before she signs, so nothing like this will ever happen to her again. If the show say yes to the dress is still around, I hope to see her dress on the show again. Will keep a lookout here on YT

BOTTOM LINE: Know what you’re signing! More importantly, hire an attorney to review it before doing so. It’s money well-spent…and could actually end up saving you thousands of dollars, if not more, in the long run.

And the kicker of it all is: her dad’s a lawyer. I would think he’d know someone, or even they knew of someone who specializes in brand IP, and collaborate employment contracts.

So proud of Hayley for battling this through. When she signed that non-compete and signed an agreement "in perpetuity" no one had any idea of what social media would become. No one knew what would become of agreements like this, since other designers have been caught up in the same trap. As a result of publicity in cases like this, many states will no longer allow the term "in perpetuity" to be included in contracts. Legal contracts should identify the parties, specify terms and include a beginning and an end date. If all parties want to extend the contract, it should be renewable, provided everyone agrees. If Hayley had a five-year contract, she could renew it as often as all parties agreed, and when working for this company was no longer viable, Hayley could have waited for the end of the term and then refused to renew.

This same thing happened to the singer JoJo. She had to fight to use her name after her record label was out of business. This goes to show you if you need to sign with a company maybe sue you use a different name for the brand. Wow JLM using a different designer while using her name. The diehards know the difference in the designers. They should be sued for misleading the public. Greedy much for taking her personal social media accounts.

You can thank a Republican appointed federal district court judge in TX for enjoining enforcement of the FTC’s proposed regulation to all but eliminate non compete agreements like the one imposed here (with an exception for certain highly compensated executives/positions). The judge indicated the rule was unlikely to survive judicial review to go into effect as planned in Sep but in the interim only prevented its application to the named plaintiffs in the case before that judge’s court. What’s likely to happen next is the FTC will amend the rule, watering down the regulation to the point it offers no protection to everyday workers and in particular, to those working in creative career fields.

It's insane to me that someone else can "own" your personal social media accounts... Beyond ridiculous... It's easy to say read the fine print but honestly, when you're starting out, sometimes the choice is sign or don't get the opportunity and corporations take advantage of that. So sad.

This in a parallel aspect sounds so similar to music industry claiming Taylor’s swift’s music that she herself wrote and performed .
Can’t believe Designers have to fight for their own birth name.
Don’t work with the wolves. Make adjustments to any contract before you sign it. Sign it with a lawyer present that read the fine print and represents you.
