I know, he was trying to get up to the speed where his type of boat settles flat, meaning he was trying to get up to 40-60. On his acceleration his nose would be up so high in the air he has to look around the boat to even see (I had the same style hydro-planing boat) that's when he hit them, as you can see from the damage, his nose was already in the air during the time of impact. He wouldve hit those 3 people directly with the nose and side of his boat.

There are however some very irresponsible people behind the steering wheels of some boats as I have witnessed. As a fisherman with a similar boat involved in the crash I try not to be on the water after dark . The loss of life and to those injured should never have happened. It is clear that the speed boat clearly ran over the stern of the fishing boat while being driven in a willful reckless manner. That boat is a racing boat - pure and simple. Add what looks to be a 250 hp motor, and you have a machine that is capable of speeds well in excess of 100 ( up to 120) kph. Idle speed for that boat is likely close to the 10 kph speed limit. To be a running a boat like that after dark at higher speeds is nothing short of careless and dangerous operation of a motor vehicle, especially in a posted 10 kph speed zone. Boats don't have brakes. If you have ever been in a boat travelling much over about 70 kph, you quickly realize that you are covering water so quickly, it is extremely difficult to avoid a floating hazard object on a bright sunny day. Damn near impossible at night. A shame that so many people have had to die or be injured because of one irresponsible maniac!

The fishing boat was between 2 docks, it wasn't just sitting out in the middle of the lake with no lights... this guy made a habit of speeding through as close to the shore as he could because it's a speed boat that can turn on a dime and instead of going through the middle path of the lake he went close to the docks and smashed into the fishing boat the kids were partying on. Those kids were not at fault. people need to stop blaming them because they were having fun partying on a boat after dark.

WOW!!! THAT'S AS SAD AS IT GETS FOR THOSE FAMILIES. I know Bob's Lake. It's a beautiful place where friends of mine had a cottage. It's a serene landscape typical of Cottage Country in Rural Eastern Ontario. Speed Boats like the one in this tragic story have no place on a lake that size. Anyone who puts a boat like that in the water isn't going to abide by the speed limits or they would not own that type of boat. Why he didn't have proper lighting on the boat to prevent hitting something in the dark is a serious lack of awareness on his part. Canadian Collision Regulations.
"Rule 6 Safe Speed - International
Every vessel shall at all times proceed at a safe speed so that she can take proper and effective action to avoid collision and be stopped within a distance appropriate to the prevailing circumstances and conditions.
In determining a safe speed the following factors shall be among those taken into account:
    (a)
    By all vessels:
    (i) the state of visibility,
(ii) the traffic density including concentrations of fishing vessels or any other vessels,
(iii) the manoeuvrability of the vessel with special reference to stopping distance and turning ability in the prevailing conditions,
(iv) at night the presence of background light such as from shore lights or from back scatter of her own lights,
    (v) the state of wind, sea and current, and the proximity of navigational hazards,
(vi) the draught in relation to the available depth of water.
The crash occurred about an hour after sunset. (i.e.- low visibility)
It appears the speedboat failed to proceed at "safe speed" by definition.

Criminal negligence causing death seems to be a charge that fits. Also I would suggest a lifetime ban on a license to operate a boat. You can see the Port/Starboard lights on the fishing boat but obviously not the tail rear white light since the speedboat is on top. These lights are usually pretty unreliably as few people boat at night and therefore are not maintained often but again can't gaurentee anything.
There was a rear light on the speed boat. Usually the rear light is removeable and it looks like it does have port and starboard lights so I would say that it is a safe assumption that the speedboat was lit and the fishing boat it is unclear whether it was lit.
All that said, having boated close to 25 years, I would not feel comfortable hitting more than 30 km/h on a well lit full moon night, on a lake that I am very familiar with, let alone speedboat speeds.

I don't know why, all reports by media seem to be one sided. But I'm pretty sure that after dark any boat on the water must have lighting so that others can see you are present and can avoid a collision. No one has mentioned that, and I can't tell from these pictures if either boat had the required lighting. Without those lights the boat is not permitted to be on the lake after dark and most small fishing boat owners know that especially if they know a boat is a known speed offender. The 10/hr limit applies to when within 100 feet from shore. I don't know if that is the case, it's also wasn't reported factually.
