How Sick Must You be to Qualify for Social Security Disability?

  • Social Security will only award you disability benefits if you can prove that you have a medical condition that has or will last 12 consecutive months and that will prevent you from performing the tasks at even a simple, entry-level job.
    In this video I talk about what I look for when deciding whether or not to accept a case for representation. I know that Social Security has become more and more demanding when evaluating disability cases so I am most interested in clients who are struggling with medical conditions that clearly impact day to day functioning.
    It is not enough that you are uncomfortable, or that you cannot perform your past work only. Further, SSA will not just accept your testimony - your file needs to contain compelling evidence from your doctors identifying specific activity limitations that would make it impossible for you to be a reliable employee.
    In this video I give you examples of these work activity limitations that I have used to win cases.

    I swear a person has to be near death’s door to have a chance at getting disability. And I bet even then SSA will still deny him or her for some crazy reason. “Oh you’re dying from cancer and have six months to live? You’re still alive during those months and can work. So, denied!”

    Thank you for these wonderful videos. In particular in this video you mention Interstitial Cystitis (which I have). I mentioned in my documentation how difficult (and upsetting to my bosses) it was to work when having to use the restroom constantly, but this is the first time I've heard it talked about. Crossing my fingers that my IC and RA diagnosis are enough. Thank again!

    I really do appreciate you sharing this important info about Disability claims. I was denied disability after I waited 3 years went to court and had an Attorney. I saw an ad on TV for a disability attorney. My attorney was from Citizens Disability was a joke because my most important day that I was waiting for 3 long years to go to court. My attorney did not say ANYTHING. I was so nervous and then so clueless that my attorney didn’t say a word. I was so upset and couldn’t believe it. So I really do appreciate the knowledge and info. It’s hard to find a disability attorney. Where are you located?

    I know a friend whose wife was terminally ill. She was denied SSD. Later on THEY APPROVED HER FOR DISABILITY BUT SHE DIED!

    I was denied my first try ,but they found me unable to do the job that I did for the last 20 years . This process is very depressing it's really hard to stay positive .

    I need help. I am 20 and have had severe anxiety since I was a child. I have worked in the past but that was only when I had someone put in a good word for me from working there. I dread interviews and do horribly at them, my anxiety is so bad I can't even talk to people. I didn't talk in class or to any students when I was in school, barely made it through high school. Currently living with my fiance and can't keep a job due to my anxiety and not being able to communicate as good as regualr people to my coworkers and customers. I stutter, shake, sweat and cant bring my words together, anytime I try to talk to someone it comes out as a mumbled mess that I cant even understand. Then this makes people think I'm stupid or retarded and it hurts my self esteem even more and my anxiety. My anxiety is so bad that sometimes when a stranger or someone I'm not 100% comfortable with talks to me I'm too busy worrying about being judged and dreading having to reply that I end up not understanding what they said. My mind will literally forget how to understand english which makes me freak out more. Its to the point now where I can't even go outside without my heart racing and shaking. I get anxious on the sidewalk! Thats how bad it is. And honestly I barely ever leave my apartment and have literally no freinds. I'm extremely lonely and get really depressed because I need a job but can't keep one, if I find a job where they don't fire me I end up quitting because my coworkers always treat me terribly because of my issue. I need to get ssd or ill be homeless becaus so currently don't have a job and wont be able to get one that I can do if I even get past the interview. My issue is this, how do I get accepted if I can't afford to pay for an attorney and to get screened. I am literally broke but if I don't do this I will be homeless. I heard it is basically impossible to get approved unless you have money lying around to pay for this. Not only that but they would want me to appear in front of a judge! Ive had to do that before and only got through it because I only had to say one word, but this time id be expected to answer questions and explain my case. Which is impossible, its really shitty to expect someone like me to be able to do that and to have thousands of dollars laying around. What can i do in my situation??

    Question Mr Ginsberg, 52 years of age light heart attack, multiple stents, pacemaker ,heart valve issues hypothyroidism Hodgkin lymphoma in early 20s which I believe is main factor for all of these conditions!! Same job 25 years truck driver handling heavy freight, off now per cardiologist, thinking of filing! Would value your opinion on my odds! Thank you!

    I have a form of dysautonomia called Postural Orthostatic Tachycardia Syndrome, IBS, and possible fibromyalgia and chronic fatigue, but I’m only 21. I got this from Covid and my condition has been declining and I can’t keep working full time. I’m so worried I’ll get disapproved if I apply. I miss work a lot between sick days and doctor’s appointments. I’m pretty sure I’m about to get fired because my employer doesn’t like that I miss work so much. It’s crazy how hard they can make it to get approved.

    I have a plate in my neck ,3 tier infusion.winter is bad!!! I’m unable to walk long periods, sit very long, or head down to do dishes. Don’t know if that qualifies as disable but when that pain kicks in it’s bad. And other times I’m ok . I think the last straw was when 8 was walking and I felt needle in my back I stoped to evaluate did not like the feeling.

    What about Lupus and fibromyalgia. I was jus diagnose with these two chronic illnesses. 2010 all my symptoms started pulmonary embolisms. One in 2011 and two in 2015 Tremors anxiety, depression. Organs removed or in the emergency room every year for 10 years. I had two organs removed because of the Lupus. Upper respiratory infections at least once a month, ear infections, bronchitis. My health issues are ongoing, since 2010. I finally got a diagnosis in Sept 2018 of Lupus and fibromyalgia. I worked for Kaiser Permanente. I ended up on FMLA . I stopped working there in 2016. I was on short term disability for 6 months and never returned back to work. I took a 12 hours a week doing a respite care job for a friend of mind watching tv and taking naps for a 79 year old lady. I tried to work 15 to 20 before that and again ended up in the hospital. If I get a job I basically could say that I would need FMLA. I am constantly sick with respiratory colds and I have tremors. The more stress I am under the worse the tremors are. With all of this would I be able to win a disabilty case. I am 51 years old and have all my credits that are required if I was to be able to retire. Thank you for your help with my question. Sincerely Virginia

    I have had chronic dizziness for over a year and a half. They have diagnosed me with chronic vestibular migraine. And chronic dizziness. My dizziness is 24/7.. I've had lots of tests done and everything has come back normal but I'm still very sick and dizzy. I've seen a neurologist and a Ent. If both Drs say the same thing about me. Is that enough. I can't do much at all. Even small chores around the house are hard. My husband does everything.. Tell me what I need to do to win this.

    I had breast cancer and I have neuropathy plus a genetic disorder called neurfibromotisis type 1. I have degenerative disk disease and terrible pain from my hip down my leg and feet. I had 42 neurfibromotisis tumors removed that has caused nerve damage. Now I am dealing with possible colon cancer. The colon issue has came up after I applied for disability. Im waiting on my colonscopy (this Tuesday) and my disability cause still says "80 days " still in review. My pain level is outrageous. I cant sit long and I cant stand long. I've worked factory and managed a restaurant. Right now with the colon issue I have to run to the bathroom 20 times a day.

    i dont have health insurance. im 30 year old. i have a job now but my lips are so bad. my whole mouth, but my lips really. they are so bad to the point where i am embarrassed to go to work, embarrassed to shop, scared to go anywhere. My lips are tight and dry and you can see it, it looks like i have aids but i dont have aids. i taken hiv blood test, std blood test. I gone to hospital once and they refuse to see me because my lips were so bad, they were so raw and tingly one day and i went to hospital and they said sorry there is no doctor here to see you, im sorry. so i had to leave. Now whenever i go somewhere i always wear a mask because we are in covid 19 and it makes me feel a little more comfortable because people cant see my lips. before, i always have to wear chapstick to make them look and feel normal, but even then, people still look at me in disgust because my lips are so bad now. They get worse every year. now its so bad that i dont even want to work. I worked at a gas station and i stopped going tonight because its so bad. i literally quit today and its the best job in the world overnight position. barely any customers, barely any work. its 8hour job, but with 2 hours of work, the rest of the 6hours is just waiting for customers to come by hanging out. Im so shy to see anyone without a mask, im so shy to see my own friends today right now because ive gotten so bad. no matter how healthy i eat, my lips wont get better. doctor even prescribed me a antifungal cream and still didnt work, gave me antifungal pink pill and still didnt work. my digestion is also so terrible, sometimes i cant poop or pass gas. feels like i have an intestinal blockage. but i cant go to doctor because its expensive so i dont know what kind of condition i have. i just know i cant work any more. i barely even go to publix. i know that when the virus is gone and masks are done we dont have to wear them, ...i dont know what i will do. i am going to get eveything delivered to my house. i have to. this crap is untreatable, living with it since i was like 21 and im 30 now i cant work because i cant even communicate with someone cux im so embarrassed, every one always talks about how nasty i am. i just wish i was healthy so i can work every single day, so i can talk and communicate with everyone. now i am trying to pursue social security, i dont even want to walk inside there becasue theyre going to see my lips man. my life sucks. i hope i can get approved for it if i try. i cant work. no one will hire me, businesses want clean presentable people to work to attract customers. not nasty looking people. at my job i lost customers because of my lips.

    Thank you. Very informative and helpful. What about severe COPD diagnosis and have no idea day to day if you will be able to get from the bed to get dressed. And if you can, can you get to the car. Have had PFT performed. Very low numbers according to doctor. Oxygen at night. Would I possibly meet a listing? Recently had to give up work completely. Cannot commit to any kind of schedule.

    Hello . I had a heart attack 4 / 3 /2019 I have a stent in my RCA and in 11/2019 I had a double bypass . Now my problem is my legs swelling and I have had to up my lasix twice now and my legs still swell I have to keep them proped up all the time , when I'm not going to the bathroom every half hour.     I had severe uterine bleeding, where I would spend hours in the bathroom. Even with medication it was an issue of bleeding. Needless to say... it was corrected by surgery a few years ago. No way during this time I could of hold any job. It's not pleasant dealing with on going bleeding issues.

    What about if you drive Uber you can set your own schedule and work when you feel good and not work when you're not most employers won't let you set your Schedule

      My opinion is that on-going part time work can hurt your case because if demonstrates that you do have capacity for on-going work. I hear what you are saying about setting your own schedule but unless your Uber driving is very sporadic I think it will likely hurt your case.

    I just applied for disability yesterday, i was diagnosed with liver cirrhosis 4 years ago. I worked as long as I could but the fatigue is too much now. I take a 10 to 30 minute break roughly every hour at work because i need to rest. I'm worried i wont get approved because while my liver panel is always bad, its not bad enough to meet the listing... Do i have a shot at getting disability or do i have to waith til my lab work is worse? Thx for the videos i just found your channel, will be checking out some more of your videos

    If you were working for me the government and had done a job for five years after an injury and get a new foreman that wants a friend employed and convinces higher ups that he has problems with me and they take his side and so I file a claim and the claim is processed, I am forced to take disability retirement and try to get social security disability and was denied. It is frustrating and rediculus.Now what, I made 100,000$ a year and now am expected to make that somewhere else at 62 years old?

      My experience has been that many of internal medicine or physical medicine doctors SSA uses are "industrial clinic" doctors - the same types of clinic doctors that workers compensation insurance companies use to deny claims. These reports are basically worthless. On the other hand, I generally find the psychologists that SSA sends people out to for consultatives to be fairly reasonable. Some are better than others but I have won many cases on the strength of a psych CE.

    Stage 4 cancer, I have a house and 2 cars and some money in the bank. How do I qualify for social security disability. I will be 55 next year so I need to get off of Husky before then or they will put a lean on my house. What are my options

      Take a look at the Compassionate Allowance list - www.ssa.gov/compassionateallowances/conditions.htm adn the listings - www.ssa.gov/disability/professionals/bluebook/AdultListings.htm. If you can ask your oncologist to confirm that you fit within either or both, ask SSA for an expedited evaluation when you apply. And best of luck to you.

    I'm a49 yr old woman who worked as a cook in a restaurant for the last 15 yrs with an 11th grade education who has CHF. Since I filed for disability my ef went from 20% to 50%, but because of my meds (coreg, lisinopril, lasix, and aladactone)I still feel tired all the time and urinate frequently. My Dr., who supports me, says I will be on these meds for the rest of my life. Do you think I have a good chance of winning my case even though my ef has improved so much?

      you might get Both medicare and medicaide. for me there is no chance I could ever work, let alone my daily functioning and nurmrous surgeries and doctors. I was Put on special needs medicaide.

    Hello, have you done a video on multiple sclerosis? I am diagnosed with RRMS and have to use a walker and crutches to be mobile. Do I have a good case with this condition? Plus I have degenerative disc disease, cervical stenosis of spinal cord and a spinal cord lesion. Thanks.

    Another question cannot figure out how to edit at the moment. I have a moderate case of CP. Mentally I am good, but I do have issues with walking and fine motor skills. I am 26 and have been on my father's disability sense shortly prior to his death in 15. What impact would that have if I am ever able to find a job? I have looked on and off and what I have found is that many of the jobs that are out there either are entry level and I do not have the walking and/or fine motor skills for, and or they are NOT entry level in which case it would be hard to be hired with no experience Those are the jobs I would be most able to do, however, so my question is what impact would if I ever started working being on my father's record. I know that if HE were still living and were able to go back to work after a trial work period he would lose his benefits, but what about being on his record?

      SSA uses something called the Dictionary of Occupational Titles and vocational witness testimony to identify jobs that exist in the national economy that a hypothetical person of your age, and with your educational and work background could do. It does not matter if the job is minimum wage or that you would be bored or that there are none of these potential jobs in your area. SSA asks if one of these simple, entry-level jobs existed could you perform it. At age 26 I would be concerned about requalifying if you were to try to work and were not successful.

    Stage 4 Melanoma survivor. Was awarded SS Disability in 2012. Went back to work same year. Several reoccourances and surgeries since. In remission for 3 years. Radical neck dissection. Partially disabled on right side of body, waist to neck. A bout with pancreatic cancer. Diabetic under control with Metamorphine. Heart disease diagnosis as well. Yet I still work. Stress level is high. Work in Corrections. What are my chances if I want benefits reinstated? Thanks.

      That would suggest a serious impairment. When might death result - 2 years, 5 years, 30 years. That is also a factor.

    What about dermatomyositis cause it is an impairment listing. I have severe weakness with muscles hard time getting up, hard time walking, reaching up for things, rashes, and severe pain plus many other aolments?

    Doesn't it state 12 months, or death? I mean that's a big difference.

      Yes, your disabling condition needs to have lasted or is expected to last 12 consecutive months or result in death. I find that the SSA adjudicators are unlikely to approve a case where a claimant has not been out of work for 12 months. If you have a terminal condition you would need to make that fact know clearly when you apply.

    Can you tell me about Fibromyalgia as a qualifier. Two drs. one being a rheumatologist agree I have this diagnosis. Denied after two appeals and hearing now appeal has been filed with appeals council. Your thoughts would be appreciated

    I have been out of work for 10 years because of my sever anxiety and I'm been taking lexapro for about the same time. My SEVER ANXIETY is so bad where it interferes with my sleep. I try to cope. Even being around people triggers it. And if u don't get your proper sleep you're not going to be as affective at your work and no boss wants that. So I just can't work. I need some assistant like SSD. Do you think i qualify.

      If you are getting retirement SSA, then yes, you cannot collect both. If you are getting private retirement money and you qualify for SSDI medically you can collect both.

    Hi, I like your channel, all sounds good.
    I think ill let you know my situation
    According to you, I'm qualified.!
    But according to social security in my state, all I'm qualified for is $312.00 a month. No medical anything!
    I Can't walk, can't cook for myself, take no prescriptions, see no doctors, can't bathe myself etc...
    I hear of people getting "emergency" funds all the time from them, and from social services...
    All they have to do is come to the United States!
    I've seen advertising from social security to illegals, "instantly qualify for over $4,000.00 a month in social security benefits"!
    Plus medical!
    Yet Americans that need these services can't get help. Why?
    How do you go to doctors get tests required, get hospice which I need, get wheelchairs etc when you don't qualify nothing according to them?
    I guess I could renounce my citizenship move out of the US, then come back if I'm still alive and get anything I needed then!
    I won't be here the years it takes to jump thru all the hoops, while they wait the applicants out.
    My state sucks to the max on everything like this!
    Where are my "emergency funds"?
    Sorry Y'all, this is my reality with the system!

      It’s so true. Americans don’t get the help they need. It’s really sad because we go into these offices to get help, no matter if it is SSI, SSDI or SNAP etc... and they treat us like crap.

      You cannot get SSDI unless you’ve paid into it and earned enough credits. Some non-citizens can qualify for Medicaid but there are restrictions on that as well. If you only qualify for $312 a month, it might be the result of your earnings over your lifetime or your countable assets. Also, being that you are getting one form of aid or another from SSA, you must be qualified for Medicare or Medicaid unless you did something wrong when filing. It’s obvious that you are focusing on the wrong things and are leaving out some important details. Go see a health care navigator or file for insurance with the healthcare marketplace and take care of business. I’m sorry you were misinformed; No immigrant comes here and gets $4000 a month in aid.
