  • The Honorable Ann Zimmerman, Las Vegas Justice Court, Department 8, presiding over a bench trial. Deputy District Attorney Agnes Botelho appeared on behalf of the State. Defense Attorney Michael Mee appeared on behalf of Mr. DeCastro. Case No. 23-CR-013015. The Court convicts Mr. DeCastro on all counts, imposes 180-day jail sentence.

      Everything said by the defendant in court is up to the judge for consideration on their judgement, so probably not a good idea in a case where you're against a cop to call the officers of the court pigs in the presence of the judge and then not even apologize to them when told to by the judge.
      It's like if someone accused of harassing women started telling the female prosecutors or officers that they looked hot in the presence of the judge and started licking their lips at them.

      but freedeom of speech shouldnt be curtailed because of outlier actions of others as the courts weigh the decisions between free speech and officer safety and if that is the case why do you drive or fly (easily show 1 instance of a deadly crash) we should all stay at home and be slient - rules shoudlnt be imposed based on outlier one acts versus actually making sure that one action or low probability actions dont encourage curtailing our rights. Its awful that any officer is gunned down or murder, but the illegal actions of others shouldnt curtail legal and legally protected actions of the masses (if his actions were lawful - this court said no, but im guessing he plans to appeal from the start)

    The amount of ppl in the comments thinking this judge is corrupt is hysterical. If you go to court and show remorse, a judge will almost always go easy on you. The gentleman here made it clear he didnt care and will continue to act this way, so the judge gave him a harsh sentence in hope of deterring him from this behavior in the future. Period. Nothing corrupt or wrong on this judge.

      The Appeal is already made so Jose's Attorney already knew the outcome. This Judge is paid up with the right people. A Jurry Trial in thisJurisdiction wouldeat money and have the same result. US Court ofAppeals do not get paid like District or Superior Courts do. US Court of Appeals is the only way to win this.

      Lol, no. Obstruction doesn't have to be physical, you fall a victim to a lie frauditors often repeat, and some even believe themselves. But it is absolutely false. In a few jurisdictions where obstruction is defined as physical only (and there are not many of them, and NV not one of them) they have auxiliary statues that prohibit non-physical interference of police officers. Inserting oneself into the middle of a police 😀 investigation even without touching anyone is a classical case of obstruction offense.

      Interfering does not have to be merely a physical act. It can also be verbal. Interfering can absolutely be a physical act. That is why bystanders are requested to keep a reasonable distance away; so as to keep the interference from becoming physical in nature.

      The cost of a jury trial isn't a burden of the defence. It's a burden of the state. The burden on the defence would be the cost of his attorney and court cost and for a just trial court cost is $1100. I had a 17 day jury trial where I was found not guilty the court cost was $1100. This case would run 1-2 days at most.

    Massachusetts defense attorney here with a question-am hoping counsel familiar with NV procedure might answer… I checked the docket and don’t see a pretrial motion to dismiss was ever filed or argued. Am wondering why not? I’m assuming defense counsel argues unsuccessfully at the end that the charges are unconstitutional as-applied (if he doesn’t, please correct me). In MA, I’d have moved (albeit unsuccessfully) pretrial on those grounds (even though as-applied challenges are more properly raised at the close of the prosecution’s case-in-chief) at least to frame the issue beforehand. Thoughts?

      Attorney also, I did not check the record. I agree a Motion to Dismiss should have been filed on first and fourth amendment grounds. In many states it is codified that criminal laws are to be strictly construed. I would have started there. I would have followed up with the Supreme Ciurts “10’” is sufficient, then show he was more than 10’. Followed by the first amendment argument and then moved into the fourth amendment arguments. Additionally, there was a severe lack of objections, the state was asking leading questions, which is disallowed. The Jusge is on the hook, LMO, for having sustained bogus objections. The officer raised his training 8 years ago, therefore, everything he raised on the stand that he used to form an opinion is fair game. The officer’s bogus arguments about fear of him being armed was belied by the fact his hands were visible both had cellphones in them. The wind was blowing and it was easy to see he had no visible weapons in front. If the officer could see his veins bulging in his neck from the car door, then it is likely that he could see that much. When the stop was over, which was before he tried to detain him illegally-because recording the police in public is lawful. Further, I would have argued that Target parking lot is private property, on which he has no legal authority.
      Finally, I would have cross examined him on every thing he testified to, in detail like “You testified that “at one point he reached into his back pocket to retrieve a cellphone…”. Then show video of him reaching into his hoodie pocket. He also did not swipe his hand away, which he changed up on the stand.

      and courts have sided with verbally refusing is not grounds for strong physical action by officers - even passive physical refusal is mostly protected against unnecesary force to physically enforce the command. And as he says, once he goes hands on and he indicates he will comply the cop should either state that he is under arrest and is arresting him or he should give him a chance to comply as he verbally has stated he will (for fear of physical encounter). Lawful order doesnt give the office the right to go hands on. Refusing to allow yourself to be detained or arrested verbally limits their response but if he was physically combative or threatening to be so (the defendant) then the cop can go hands on and more aggressively - seems to be plenty of case law that shows force used must be appropriate unless the officer can show he had a fear that is reasonable ( i thought he might be armed, he motioned in a way to suggest he might strike or lunge at me, all subjective, but of course that supposed act should also show up on camera if there are mutlliple angles being shown

      That is why the judge made this immediate to serve, as an appeal would have overturned as a matter of clearly established law. So bad was this in violation of law as to put the judge on sanctions and require mentorship for this. When this is done, the judge will not get a job judging pig calls at a county fair.

Facts were just not on the Chille side, while he was convicted fairly based on facts only, he did get harsher then usual sentence for running his mouth and contemptuous behaviour in court.
