- All I Wanted to do was clean up some old items around the farm and of course I get myself into a situation I don't want to be it. Follow along to see how my first ever experience in court turns out.
The judge should have accuse that man of fraud and then forced him to pay for your cost to come to court and also his own court cost .
I hate that happened to you. Scammers are out in full force. It’s a shame because that truck is worth much more than you were asking. He wasn’t wanting the truck, just an excuse to extract money. A true truck restorer would have been thrilled at your price.

If he had filed a countersuit, then he probably would have succeeded on that claim and not only avoided paying the other person's court costs, he would likely have recouped his own court costs and possibly his lost time.

I am so sorry that you had to deal with someone who was obviously not trying to do the right thing. Unfortunately that seems to be the way of the world today. Save yourself a lot of anguish if there is a next time, and continue doing the right thing and you will always prevail. I'm always so impressed with your hard work and enjoy watching the different elements of getting everything ready to plant, picking all the crops and cleaning all before winter. Like I've said before, I wish I were closer at harvest time but there is a little distance between North Carolina and Pennsylvania. Here's to another great season for you!
Oh, please, please, please make sure your bank has cleared the cashier's cheque, money order or whatever. Your bank may make funds available to you, but it can take weeks to be returned by the originating bank.
There is nothing special or guaranteed about money orders, cashier cheques, etc.

In the video he mentioned he received the court letter several months later. So I’m sure the money order had cleared by then. But still, you make a good point.

You read the situation perfectly. It is stupid that you had to pay his costs though, when you has proof you had tried to return the money.
He was definitely trying to scam you.
1st mistake was cashing the cheque. Always have the bank check the cheque , and wait, a lesson learned, and knowledge gained

Glad you stood up for yourself. This is why a lot of vehicles get scrapped. It’s easier to junk them than deal with idiots- scammers

That whole thing was bizarre, he was up to something right from the start. I don’t even like selling anything any more for that reason. Seems you can’t trust anyone. Our local police station has an area set aside in their parking lot to meet with people who are buying and selling. Always deal in cash. Sorry you went through that.

Best place to meet for the private sale of a vehicle is at the tag agents office.
They are excellent at paper trails, verifications, photos, dealing with strangers, etc.
If the buyer is trying to pull a scam, they will have time to question their own intention.
And, they never show up.
I really wish we were closer. I've been looking locally for a truck just like that to build into my next vacation touring rig
Good for you. Glad it worked out. You paid the jerk and he can go on to his next victim. Happened to me a few years ago in car accident. It was the other drivers fault and i had to go to court. I won and only had to pay court costs. 6 months later, my insuance decided in favor of me. Happy. Lesson learned.
This guy’s a scam. Tell it to a judge. Save all your information. The judge will side with you.

Great job man I'm glad you won and in the 50 something years I've had in my business is preparing cars for people I have been to court many times over things the worst thing is somebody that's been a good customer for 20-30 years needs a new engine and so you put the new engine in you don't take any money down on it you just put the new engine in it says they're your shop for 5 or 6 weeks next thing you know you're in Federal Way they get their car and you don't get anything and the federal judge will tell you don't bug them don't bug them little different situation but still adds up about the same way

I'm so sorry this happened to you. My husband tried to sell a car and some guy wanted to money order half and give the other half when picked up, and he wanted my husband to hand over the title unsigned. Um nope.
Sad that someone like that ruins it for everyone else.

Do not ever accept any check, Did I say any check for something that old cash only. He was 100% a camera. Or if you do both parties at the bank.
Or don't sell the vehicle at all glad you all turned out good for you.

It can take up to 10 days for a money order or certified cheque to bounce if it is fake or they put a stop payment on it. Even car dealerships are getting ripped off! A judge will toss this out. Even if you give him cash he could turn around and said you never paid him, or the cash was fake and want even more money. Charge him storage fees for storing his truck lol.

I have to agree with many of the comments on here. I would love to know his background record if he has sued others in similar cases. And it would be interesting to know if others exist on other selling platforms who just paid him off. This would be a worthy story for some news outlet.

It was a scam. The original was the check you deposited was perhaps no good or he would have put a stop payment on it AFTER you had refunded his money in cash. Everything that followed was intended to get more out of you.

That is totally ridiculous that you had to pay out of your pocket for that guy’s stupidity the judge should’ve seen that you were willing to pay and left him to pay his own court cost for his own stupidity I think I’d be asking for my money back
Unfortunately there are a lot of scammers out there. I've sold quite a bit on FB marketplace but I've never been sued...yet. BTW, is that water vapor from the Berwick reactor in the background in the beginning of the video?

You should have counter sued that dude for your time involved (time away from the greenhouse), travel expense to your bank to cash the money order and travel and time to court. I'm no attorney but the few times I had to defend myself the judge ruled in my favor. You have to watch how you explain things and choose the correct words. The same thing can be said with a positive influence or with a negative influence it's all in how you word it. Counter sue and with everything positive in your favor and show the bad faith and negative dealings the other dude put forth and that dude would be paying you.

This is more common then most people know, you could even call it being scammed. The same thing happened to me on eBay although it wasn't for a truck.
When I sell something it's on a first come first serve basis. It also has to be in person with cash in hand.

Make sure you tell the judge everything you said in this video. One tip on selling stuff if they don’t have quick communication and won’t call you then 🚩 will be popping up in your head.

He agreed to the price, was suppose to pick up the truck, paid for the truck. its his truck. Give him a deadline to pick up the truck.

It sounds like this guy was trying to beat you out of extra money you didn't owe him. You did the right thing going to court and it just shows honesty still has a place in the world.
I hired a shop to replace the motor in my truck. (1984)
Id call every few days to see if it was repaired , and I got excuse after excuse for why it wasnt repaired...
As luck would have it a friend of mine got a job at that shop.
He called me one eve & said , hey this guy is selling parts from your truck & charging customers as "new" parts .
I went the next morning & confronted him ..
An argument nearly led to blows & the police were called.
The officer told me to take him to court..
I did .
By the court date he had my truck 3 months ...
I had my friend come & testify to what he had witnessed ..
The judge asked why in 3 months he hadnt repaied engine ??
He gave the judge the same b.s. excuses...
The judge pointed his finger at him & said , you are in here every wk for your business dealings and all these people have a similar story ...
He asked me if I would be willing to sell the truck..
I said , not as it sits because it had no motor & it would be worth very little..
He pulls out a NADA book , determines the value and deducts what he was to charge to replace the motor...
I said yes, I would take that deal..
The shop owner says , Im not interested in buying it & he owes me $20 a day for storage..
I took a step towards the shop owner to break his jaw & the judge , understanding my anger says , young man hold it right there..
He pulls out a calculator , determines the $20 a day minus a week , which was the time I was given it would take to fix it...
Then the judge said , pay him $$ amount right now or I will put you in jail for contempt...
He pulls a wad of $100 bills from his inside suit pocket & pays me .
My friend had already quit , but , my friend stopped and asked what he wanted for the truck..
He said , if you get it outta here today , you can have it...
That night my friend & myself loaded the truck & I owned it once again..
I bought a salvage motor , and the missing parts , fixed it myself & put $4800 profit in my bank acct .
Sometimes being honest pays ...
And in this case , sometimes being dishonest costs you $6200...
I LOVE that truck though! Wish i could have something like that to hot-rod or just get it working and leavevit as is
I've been accused of things I didn't do as well. I had to defend myself against an educated attorney who didn't care if I was innocent or not . They just wanted to win and to see me punished.
The people accusing me were actually the ones guilty of the crime in question. Actually, they did worse. I tried 2 years prior to go after them in court, but because of court and attorney fees, they got away with taking more than $40,000 from my elderly father inlaw. It was supposedly in a bank account for him, but the money never made it to him. Even after he passed, they never turned over the money, helped cover his funeral expenses, or even showed up to his funeral.

If you wanted to get that truck a good home, you could always list it for free and just state in the ad to a good home only, no scrappers. You’ll know a truck guy when you see one.

I don’t like scammers I think they’re ridiculous and that guy is a slug to think he could just do that to you. Maybe that was his way of trying to squeeze more money out of you which wouldn’t surprise me. He says he wants the truck and then he backs out, and then he purposely does not get back in touch with you, and then claims that he has made a court date For you, whether that is true or not and tries to get you to pay for his court fees, so on top of it, he’s making double on an item he didn’t even really want. I wish I lived closer to your farm. I would definitely be interested in this truck
I never sell anything on the web. Too much drama. Lately i have been donating and asking for a donation receipt. If they can't give a receipt its my loss. Life is so much simpler. Happy growing!
When I sell a vehicle it's too the very first person who brings cash and I don't hold the vehicle for no one. Make sure you write on the bill of sale "as is" and get their dentification just in case they use that vehicle for criminal activity. Legally they need to register it and some people don't they just put a plate on it and drive it.
When selling things like this the rule is NO PROMISES TO ANYONE... the first person that shows up with the agreed cash gets it... done deal... I would reject his money order not accept the delivery and say cash in person ONLY!
How did he get your address? I would of told the judge it was paid for and there's no returns. He can come and get the truck at the county lot and pay for the tow there.

That makes no sence you payed his court fees . In my state if you lose a law suit you pay the court costs. You could also recoup the cost of your time and travel expense . That is a bum deal you got . Your lawyer would also be payed by person who sued you if they lost most people do not no this.
