And the result is also good for people living in j&k, Kapilji's arguments are irrelevant as good happening in favour of suffering people yet he wants to object, if he takes matter in national interest where other countries are threat to India. Whenever Art 370 was a temporary provision from its inception and inclusion in the Indian Constitution the legal interpretation of this matter may be considered only either that the said Article may be abrogated when such proposal for abrogation will be sent from the constituent assembly of J & K to the proper authority or will automatically be abolished with the abolition of said assembly in its normal course .The strong reason for such abolition is its temporary character so it cannot stay like other permanent articles.(This is my personal opinion.)

CJI sir was right. Constituent assembly(ca) was only to frame the powers of J&K assembly and after its completion it should never exist. Then President seeking ca's recommendations doesn't arise and that to after 1957 when ca was dissolved. In fact once ca was dissolved even 370 ceases and it should have removed from the Constituent then itself and could have saved space in the Constitution 🙏

as to what I understood, according to Kapil Sibal, 370 is temporary, but in order to remove the temporary status or to abrogate the entire article between 1951 to 1957 a Kashmir Constituent Assembly was there, this assembly was not able to abrogate or make changes to the article in those 7 odd years. Now the article even says that only this Constituent Assembly(CA) has the power to abrogate this article and not just that, no other assembly can be formed after 1957. Hence by Mr. Sibal's logic since CA cannot be formed to abrogate the article, the same article will remain as it was and cannot be abrogated. Matlab eo Permanet to gaya automatically. Which means the power to abrogate the article is given by the article itself to the then people of Kashmir, the people who were in Kashmir between 51-57, whose demography was being changed by the invading Pakistanis. matlab 1947 ke baad mai jo POK bolo ya baki Muslims that supported formation of Pakistan and wanted Kashmir as the part of it did not leave Kashmir had the power to completely either stay with India or be a part of Pakistan or be ruled by article 370 by Indian money. Waah re article 370 kya baat hai heads bhi mera aur tails bhi mera khel raha tha ye to, isiliye Modi and Shah had to take this step to abrogate it as there was no use of such a deceiving rule of land.

a) Why was Defence, Communications, Foreign Affairs and Ancillaries given to the Government of India?
b) Was the Accession Conditional if so where and upto when ??
c) Does Temporary become Permanent without due process? Temporary can be removed but can permanent be removed ? Why must a temporary provision be expressly enumerated if it is intended to be converted to permanent at any point in time ?
d) How are Temporary & Special Legislation to be differentiated, are they the same if so why are they so enumerated varingly ??
e). Between 26 October 1947 and 26 April 1961 when the Maharaja died in Mumbai without once going to Kashmir did he at any point in time say that Kashmir was to be given back its independence since the Security Situation was restored ?? No.
How does Kapil Sibal face his family when he goes home or are his families also anti India like him.

Removal of article 370 is a political decision and people can have different views on it but the important question is if the current procedure adopted to nullify article 370 is constitutionally valid or not.Interesting arguments

Constituent assembly of the state is for a temporary period and if the state wanted, it should have continued article 370, by making a resolution. If it has not done anything before that, Parliament can make any decision, after that date, which is the power of President and parliament. Sibal's argument will not stand.
If the argument is such that It questions the power of president and the parliament in making laws for the country, the tomorrow the same argument may question the authority or jurisdiction of SC in adjudicating the case or hearing it. Hence this case has neither the premises nor the basis to be heard therefore quashed ASAP.
Can such a thing be permitted in any other self respecting country!?

Why does instrument of accession has more power than parliament, supreme court and entire government machinery. Should it not be just thrown out and re-written, re-interpreted. I thought question we ask ourselves is simple when posed with question of Kashmir -- is it part of India? If yes, why are we arguing merits of how it cannot be same as rest of India --- Because someone 70 years ago said this or that -- how does it even matter.
