  • Courts in the United States, Europe and Ukraine are considering cases of Russian war crimes in Ukraine, including: torture, sexual violence, murder of civilians, deportation. So far only one military man has been able to be sentenced in reality, and not in absentia.
Tatyana Orlova, a doctor from the Kharkov region, encountered a full-scale Russian invasion of Ukraine in a small border village, which was occupied by the Russian military literally from the first days. She and her husband were twice taken “to the basement,” where dozens of other people were kept in terrible conditions.
“We spent the first 24 hours with my husband, then he was taken away for interrogation. And I didn’t see him again,” Tatyana Orlova said in an interview with Voice of America. - When my husband was tortured, it happened behind the next wall, I heard how he was tortured and beaten. It's very hard".
Tatyana says that she and other women were lucky, in these “cellars” they were not bullied or beaten - unlike men.
“An empty room, with a small window, a concrete floor on which people slept. There were no more amenities. One bucket, excuse me, for the toilet. Where everyone had to go, because there was simply no other option. People were fed once a day. It was in the summer, they brought us a 10-liter bucket of sour porridge, gave us two loaves of bread for everyone, and about 20 liters of water. People took turns eating this sour porridge. Because there were no plates, no forks, no spoons,” says the Ukrainian woman.
Russian war crimes in Ukraine are documented by the Center for Civil Liberties, a human rights organization that received the Nobel Peace Prize in 2022. Together with more than 20 other organizations, they created an initiative - “Tribunal for Putin”. An investigation into more than 70 thousand episodes is currently underway, Alexandra Romantsova, executive director of the Center for Civil Liberties, told Voice of America:
“We had a case when a small area was occupied in the Nikolaev region. And after the de-occupation, we were informed about two potentially dead, missing, forcibly disappeared people. After all, they were arrested by soldiers of the Russian Federation. And they were taken somewhere. When field missions and prosecutors arrived in the area, they found a torture site and there were 27 bodies, including the bodies of these two. We understand that in fact we have a [new] Bucha every day in the occupied territory.”
According to the office of the President of Ukraine, during the 33 days of occupation of Bucha, the Russian military killed more than 1,400 civilians. Among them are 37 children. A Ukrainian court handed down the first verdict for war crimes in Bucha a year ago. Nine Russian soldiers from the 64th Motorized Rifle Brigade were convicted of torturing a local resident, albeit in absentia. They have not yet been detained.
Last week, a Ukrainian who survived torture at the hands of the Russian military during the occupation - he was tortured with electric shock for about 20 days - appealed to the Argentine court. His case is being represented by lawyers from the international initiative The Reckoning Project, which translated means “Project Reckoning.” Senior legal adviser of The Reckoning Project Tsvetelina van Benthem told Voice of America why it was to go to the Argentine court.
“One of the first questions to ask is why not contact the Ukrainian authorities? Because this crime occurred on the territory of Ukraine. But the Ukrainian prosecutor’s office is simply unable to deal with all the cases of international crimes that were committed under the conditions of a full-scale Russian invasion. That is why the question arose of where to go and which jurisdiction to choose. This country [Argentina] is open to complaints under universal jurisdiction. And we thought that this was exactly the case that would show that we are not talking about the confrontation between East and West, North and South. Torture is torture, no matter where it is used. And that is why we turned to the Argentine court with a request to open an investigation into this case. In times of propaganda and disinformation, it is important to tell true stories in legal proceedings. Therefore, consideration of this case by such a respected, authoritative body will already be a success for us,” Van Benthem emphasized.
Now, in addition to Ukraine, cases of Russian war crimes are also being considered in the courts of the United States and Europe. For example, the International Criminal Court in The Hague a year ago issued an arrest warrant for Russian President Vladimir Putin and Children's Rights Commissioner Maria Lvova-Belova. They are accused of deporting Ukrainian children. But bringing them to justice will be difficult, says Harry Ray, an expert on war crimes and a doctorate in international law at Rutgers University. But it is possible.

Зверство лишь пораждает зверство в другой стороне. Только не каждому скотине это понять.
