    Very important topic also, my husband & I discussed topic way before our marriage, I wanted us to have an understanding. My biggest worry was that since we were planning to start a business we would lose everything if things were to go south. And the sad things is that half the time people are not aware of the implications of whatever regime they choose to go for which affects everyone in their lives at the end of the day.

      Very true! We must be realistic with the type of lives we live, for you in community was definitely not going to work because as entrepreneurs you are risk takers.

    Great video, very education and it's nice to get the information from someone who has been through all this. I personally think that Out of Community of Property with Accrual is distancing yourself from the mistakes but wanting to benefit from the wins. So I would choose completely Out of Community of Property

    New subbie here. So sorry to bombard you with questions. If my business I started during the course of the out of community of property but with accrual marriage, isn't doing well, say I'm very deep in debt. Is my partner liable to pay the other half of debt in the event of a divorce? Are they fully liable in the event of death?

      You will have to watch video to understand the accrual calculation at death or divorce. It's not based on a particular asset or liability, but a comparison of the two net values.

    What I would like to know is, if you have entered into out of community of property with acrual and your husband has bought a house before you signed, what happens during death (let's say the husband dies) as you were both leaving in this house and as a wife you have been buying furniture and helping with decorating the house. What happens to the house?

      You have no share of the house. Anything he bought before marriage is his alone, it does not accrue to you. Accrual only starts from the day you signed.

    Can my spouse have share of my pension fund in the dissolution of marriage even thou I had already accumulated a certain amount of money before marriage if married out of community of property with acrual

      Anything bought before marriage is not shared. Only the once bought after marriage accrue to both

      Do you mean customary marriage? Because the options I discussed on the video are for civil marriage (where you sign). For customary (e.g. Where lobola has been paid but no signing), the default is marriage in community of property as the couple would not have went to lawyers to get an antenuptual contract which is needed for marrying out of community of property (whether completely out or with accrual).

      Hi. Yes it is possible. You need to consult a lawyer, specifically a notary. It is worth looking into.

      Yep, you are seen as one person legally! So it means your assets can be attached to pay of her debts, because your assets are her assets. One person!

    Great video.
    Question: If a couple gets married out of community of property with accrual and in the accrual contract they both exclude their current and future pension funds. But they in turn write a Will that the pension fund should go to the spouse in the case of death. What will happen in this case because the Will and the accrual exclusions in the contract contradict each other? What will be considered?

      The latest signed legal document will be considered meaning the will will go to spouse as per will

    If I had a business before the marriage and I marry out of community of property with accrual, then the business does extremely well during the course of the marriage, then I decide to purchase assets like properties under the business, then divorce or death happens. Is my spouse entitled to any share of the business or any assets owned by the business purchased after we got married?

      Your spouse will have a share to all the assets that the business bought after your marriage in the case of death or marriage if the business is a sole proprietorship.

      As the shares are bought during the course of your marriage, your spouse does have a share. It might not necessarily work out to be half, do watch video to understand how their share is calculated in the event of divorce or your death.
