In mens rea does all the elements e.g. knowlodge , negligence and reckless have to all be proven in order for the mens rea to be fulfilled
Hello Sandra. No need to prove all elements of men's Rea. One is sufficient. However, all other ingredients of the offence must be proved beyond reasonable doubt, less of which no conviction shall be entered by the court against the accused person. Please read this court of appeal decision in support of the view that all ingredients of the offence must be proved beyond reasonable doubt, Uganda v komakech Francis case No. HCT-02-CR-SC-0282 of 2022. Judgement of justice George Okello delivered on 18th August 2023.
