The Indian Penal Code has provisions to deal with false prosecution under Section 211. The section provides for punishment to any person who files a false report with the intent to cause harm to the reputation of a person or to cause an injury to any person. The punishment for filing a false report is imprisonment of either description for a term that can extend to 2 years, or with fine, or both. If the false report was regarding an offense punishable with imprisonment for a term exceeding 7 years, the punishment can extend to 7 years of imprisonment along with a fine. Additionally, the person filing the false report may also be liable for compensation to the person against whom the report was filed. The compensation is awarded under Section 250 of the Code of Criminal Procedure.

झूठे केस को झूठा सिद्ध करने के लिए सालों साल लग जाते हैं झूठे केस की ट्रायल एक निचली अदालत मैं लगभग 20 साल पर अपीली अदालत में 10 साल इसके बाद इतनी समय हाईकोर्ट में उस पीड़ित व्यक्ति झूठे केस के खिलाफ कब आईपीसी की धारा 340 में मुकदमा दर्ज करा सकेगा कोई अंदाज है आपको इसलिए पीड़ित तो पीड़ित ही रहेगा
यही कारण है न्याय के स्तंभ पुलिस जुडिशियसली फल फूल रहे हैं पीड़ित व्यक्ति को न्याय नहीं मिल सकता जय हो भारत का संविधान

वकील साहब, नमस्ते।ये जो आपने कानूनी प्रावधान बताए हैं,बहुत अच्छे है।लेकिन ये धाराएं तभी लागू होंगी,जब केस कोर्ट में झूठा साबित हो जाये।मेरे खिलाफ बहु ने 498a का मामला 17।09।2018 को प्राइवेट कम्पलेंट केस के रूप में दायर किया था। अभी 5 साल होने को आये,ट्रायल शुरू तक नहीं हुआ।बताइए ये फिनिश कब होगामेरी उम्र 75 साल है।क्या मैं केस कर पाऊंगा।कर भी दिया तो उसका फैसला आने में कितने साल और लग जाएंगे।यह सब प्रैक्टिकली सम्भव नहीं प्रतीत होता।

Suppose , any person (plaintiff) filed a civil suit in connection with landed property (for partition , possession , injuction order etc.) against anybody (defendant/s) mentioning false information ie / such as ' defendants uttered him (plaintiff) to remove frm th land in question n threatned of beating/ assault etc.in th plaint ( in support of a cause of action for a suit ), then can defendant person file a criminal case in a Police Station against that plaintiff person u/secs. 182, 191,192 ,209,211 etc, of IPC for giving false infomation/evidence by th plaintiff ? Plz advise.

Sir you are right my elder brother age 85 forged my property papers i already informed to court in 2010 .but court out look my request and court fee given permanent injection on my plot even lease deed in my favour and procession is with me mcd section plan approve for plot .brother putting fake petition every 6 months .case started in aug 2010 today June 2024 .more then 4 years brother passed on cross examine .that last with held by court in dec 2023 .plantiff already get permission to produce his 2 witness which he againe revised in April 2024 to 5 .I file purjury application in Jan 2024 but court not taking it seriously in last April 2024 order to replied the purjury application .last many years court giving next hearing inbetween 5/6 months 9:02 years .this is all due to court staff manipulation .where other case on same day given short dates .today I am 70 y not a hope to get justic they way judicial system work .where s c direction is that senior citizen having age over 70 and suit civil suit pending over 15 and person having govt servant shall be finished in 6 months .where I am also ex govt servant .I lost all hope they way our advocate work and make amagalam with each other and not heard to concern .on other hand civil judge follow thier standard process and deliberately ignore the time limit of each proceeding application .such draw back in judiciary system make more complicated when new law will be informed from 1july 2024 .i fear that next date hearing will be inbetween 8/10 years .govt must come up with alternate source to minimizer the more then 15 y family case
