I still do not encourage or endorse committing any sort of grand larceny or theft on the internet just because you know there is a light sentence for stealing music money from other users. 5 years and 10 months in prison will feel even longer when you actually experience that prison time for yourself. We had an old song get claimed by someone because 2 seconds of it sounded like a couple notes from their own song _that was uploaded several years after ours_ 😂 Fortunately it was one we hadn’t cared about for years & it’s not like we ever got big views, so it didn’t matter much. We did try to contest it at the time for the hell of it though, and exactly what you said happens...is what happened. “Oh well whatever” & all, but when it happens to a relatively popular artist/band/creator I can only imagine how frustrating it is

CZcams is the primary profiteer as they get a percentage regardless of who wins the claim. This is clear selective enforcement. If the DA hasnt prosecuted anyone else (namely youtube), they are selectively choosing who and when to prosecute which is unenforceable. This guy needs to appeal. One of the things I find to be super irritating is when you pay to license sound packs in perpetuity and mix some audio for a video from it, and then some a**hole copyrights your video because they licensed the same audio pack and used it for some song they made. It’s just so irritating that CZcams allows this to happen. I’m glad this guy got fried for it, but it need to happen more. There’s a ton of this bullsh!t going around. It’s infuriating.

CZcams needs to add an option where you can fight a claim due to lack of standing or fraud. It is so archaic that the CLAIMER gets to decided whether to drop the claim, which they absolutely never do. I talked to a CZcams rep about this once and the only real advice they gave was "seek legal counsel". So for small creators like me, we are basically screwed.

There have been copyright troll attorneys that have gotten 14+ year sentences & this guy only got 5? Plus it's not like they're gonna take away all of his money. As a musician I cannot tell you how frustrating it is how easily some random person can just claim your music. There are processes you have to go through to get the copy right back to it's original owner, but it's so much hassle when the original person that stole it basically just said "yeah that's mine."

@derekalexandersmith definitely with your P.R.O. it might be a slow process to get your rights back. But at least with registering your tracks with ASCAP, BMI, etc. You already have the intial rights. So ultimately youll have a strong case.

The final amount won’t be decided until the restitution hearing is complete. That article also said that the $23 million that was scammed was split between at least 5 other co conspirators

All you have to do as scammer is to gift that money to family or invest it outside of country you live, preferably in country with no extradition laws like Argentina and you will never have to return anything. I don't think there was single person in history of USA to actually pay what court ordered. It's almost always settled outside courtroom at much much lower sum as most scammers will have very little if any money that can be connected to them. I worked in European IRS for years then as accountant, trust me they will not pay anything, they will return to same scam in matter of days, we even got some people continue to do scamms from within prisons by proxies... It's YT that needs to change it's policy or nothing will change

The saddest part is, they're usually stolen from overseas producers like from japan china etc especially vocaloid music which the original artist didn't get to release for straming yet. CZcams is complicit in an astronomical amount of illegal activity, and they tacitly encourage it. The problem is they have essentially unlimited money from Google which means huge law teams that no one wants to go up against.
Legally speaking what youtube does is the safest route. They involve themselves as little as possible so in case something goes wrong the 2 parties are supposed to duke it out in court and not be able to involve youtube. On the other hand if youtube reviewed the claims then they would be an active participant, meaning every time a fake claim comes up they would be included in the lawsuits.

The biggest take away is just how broken CZcams copyright system still is even after over a decade. I remember when PewDiePie just mentioned Despacito in a video title, didn't even play the song (half attempted a couple chords on a guitar) and the video was claimed 27 times for a song _that wasn't played in the video._ So 27 people, individuals or parasitic legal firms, claimed the video saying they represented the copyright holder, and CZcams said 'oh, yeah, seems legit'.
Jim Sterling had this problem for so long, they usually only take money from Patreon and leave all the youtube video completely ads free, people would false claim the videos and put ads on it, so they decided to copy right claim the videos first and deny all the ads to be placed on the videos

My theory for why financial crimes get such light sentences is because then it sets a precident that benifits certain groups of people. Like politicians.

It's really time youtube is found accountable for this. If it happens once, they can claim they weren't aware of the flaw but now that there are multiple offenders and it's become public knowledge they have no excuses, they are knowingly allowing the scams to happen.
This kind of stuff has been happening for around a decade now and little to nothing has ever been done. Even after all of the viral controversies they've had, little ever changes and what does change is usually for the worse.
I know of a content creator who was getting copyright claimed for playing their own music they created with their band during their various streams. Someone also copyright claimed a clip of theirs that had “cricket noises” in it. The system is absolute exploitable abs broken.

Between the copyright claim scammers, the copyright claim abuses by legit publishers, and the outright wrong copyright claims being asserted by CZcams, I hope that there is eventually a class action lawsuit against CZcams for their accommodation and facilitation of all of it. One of the things I find to be super irritating is when you pay to license sound packs in perpetuity and mix some audio for a video from it, and then some a**hole copyrights your video because they licensed the same audio pack and used it for some song they made. It’s just so irritating that CZcams allows this to happen. I’m glad this guy got fried for it, but it need to happen more. There’s a ton of this bullsh!t going around. It’s infuriating.

CZcams needs to add an option where you can fight a claim due to lack of standing or fraud. It is so archaic that the CLAIMER gets to decided whether to drop the claim, which they absolutely never do. I talked to a CZcams rep about this once and the only real advice they gave was "seek legal counsel". So for small creators like me, we are basically screwed.

As a musician I cannot tell you how frustrating it is how easily some random person can just claim your music. There are processes you have to go through to get the copy right back to it's original owner, but it's so much hassle when the original person that stole it basically just said "yeah that's mine."

The final amount won’t be decided until the restitution hearing is complete. That article also said that the $23 million that was scammed was split between at least 5 other co conspirators

All you have to do as scammer is to gift that money to family or invest it outside of country you live, preferably in country with no extradition laws like Argentina and you will never have to return anything. I don't think there was single person in history of USA to actually pay what court ordered. It's almost always settled outside courtroom at much much lower sum as most scammers will have very little if any money that can be connected to them. I worked in European IRS for years then as accountant, trust me they will not pay anything, they will return to same scam in matter of days, we even got some people continue to do scamms from within prisons by proxies... It's YT that needs to change it's policy or nothing will change

CZcams is complicit in an astronomical amount of illegal activity, and they tacitly encourage it. The problem is they have essentially unlimited money from Google which means huge law teams that no one wants to go up against.
Legally speaking what youtube does is the safest route. They involve themselves as little as possible so in case something goes wrong the 2 parties are supposed to duke it out in court and not be able to involve youtube. On the other hand if youtube reviewed the claims then they would be an active participant, meaning every time a fake claim comes up they would be included in the lawsuits.

This kind of stuff has been happening for around a decade now and little to nothing has ever been done. Even after all of the viral controversies they've had, little ever changes and what does change is usually for the worse.

In Canada a guy just got 5 years for second degree murder, sentences are so lenient it's ridiculous
I know of a content creator who was getting copyright claimed for playing their own music they created with their band during their various streams. Someone also copyright claimed a clip of theirs that had “cricket noises” in it.
The system is absolute exploitable abs broken.

@@samuelfaille-denis8098we need a big law firm who's tech savvy to spearhead this lawsuit. This is completely insane. I wonder how many people are upset at the music creators for claiming AD revenue, when in reality it's some douche trying to move out of their parents basement.
We need strictor punishments and more work put in to stop scammers. Not to say the people working on this aren't working hard, they're doing amazing work, but we need more of them
