    A federal judge has signaled that Gina Carano‘s lawsuit against Disney and Lucasfilm over her termination from The Mandalorian will be allowed to proceed as the court considers whether the First Amendment allows private companies to sever ties with employees who publicly clash with their values.
    U.S. District Judge Sherilyn Peace Garnett on Wednesday pushed back on arguments from Disney lawyer Daniel Petrocelli, who argued that the lawsuit should be dismissed because the company has the “right not to associate with a high-profile performer on a high-profile show who’s imbuing” the Star Wars series with “views it disagrees with” that could turn fans away from the show.

      Discovery is not in the public record unless disputed. In fact the vast majority of discovery is NEVER in the public record. That's why people always have to get a court order for the release of deposition transcripts.

      @@christheghostwriter work practices, for start, since Disney is so adamant not having an agenda, when there clearly is.
      Why they are going through with these terrible decisions, since everything recently has been flop after flop after mega flop, and if there are any parties involved in a convoluted scheme.
      Where all the funding goes to, since they are given a huge sum for production, and recently, the acolyte, which had a budget $180m, it looked like trash, from sets to costumes to actors hired (no offense to some, but you can tell that someone of them look like they were just taken off the streets to be a part of someone).
      Any sort of affiliation with a scheme or ring, since it is most likely that they only hire those around their community and not even look towards people that have made a solid mark in Hollywood. I’m not looking for someone super famous, but someone that at least more than 3 people that audience would recognize.

They paid her for her contract, and then they decided not to offer her a new contract. That's not illegal. If it were, I'd go around suing every company that didn't offer me a job.

      Defamation typically requires some kind of fact statement that is false. Calling someone despicable is just an opinion statement, so Gina can't really sue over that as defamation - she might however sue over a non-disparagement clause if that exists.

Disney knows that, Carano knows that, Elon Musk knows that, and every lawyer she first consulted two years ago knows that. The only reasons why this case is happening now instead of two years ago are that Elon likes publicity, and Carano needs publicity. This is not a viable defamation case.
      And stop lying, by the way. Disney never said "Gina Carano is despicable." If you have to twist the truth to make a point, maybe you don't actually have a point.

      This is literally covered by Californian Labor Law that an employer can not influence an employees political opinion, or forbid/influence their speech or terminate somebody for their political speech.

    Don't think it was lost on me, that this trial hearing began the same week that, The Acolyte's "Destiny" episode aired on Disney +. Notice how virtually no establishment media outlets have mentioned that Leslye Headland's name was mentioned in Gina Carano's lawsuit as being one of her abusers (during her time employed at Disney/Lucasfilm Ltd.), and how that (most likely) has had an impact on the SW Fan base's reaction/reception to Leslye Headland's The Acolyte? Kids, if you don't know about the legal term, "Discovery"...well, you're gonna get a GREAT DEFINITION/DEPICTION of it in this case. WOAH, BABY!

      Well the case was filed awhile back but it took time to get a court trial. And there's not much to discover as all the dirt is out there but Gina was very polite in her interviews and never bad mouthed anyone and didn't mention names but we all know who. Jon Favreau fought to bring her back but higher ups blocked it. It's very political at Disney.

    There was no obligation for Disney to announce their feelings about Gina, and they could’ve simply not cast her. Instead, they went out of their way to make declarative statements about her character and actions which were demonstrably false and clearly designed to poison the waters for any future work. As an employer, they should know better than to directly interfere with future employability and the price should be high enough to discourage anyone from ever trying the same in three future. I am thinking 1B per month of unemployment, or Disney’s rights to Star Wars.

      They're running a business. They were under fire. And her behavior was utterly reprehensible. Disney is allowed to say so. They're allowed to tell their shareholders and customers that they're disgusted. The truth is a defense against defamation charges. It's true that she made those selfish nasty, ignorant statements. And, presumably, it's true that Disney was as disgusted by her behavior as any reasonable adult would be

    Disney operates like an NGO, advocating certain viewpoints,. The company is so focused on its "messaging" and advocacy for certain causes that it has forgotten that it is a for-profit corporation. The money Disney lavishly wastes is the investors' money. Disney is not a good steward of its resources, much less making a profit for its owners. Past time to get rid of Iger, his top executives, and the Disney board.

    I like the idea of the CA law protecting political opinion from employers. To me it's a free speech protection.
    When Ron presented the question, does the corporation own you because you are it's employee is the key issue. That makes not about Gina, but a constitutional argument protecting the citizenry. Corporations already believe they own their employees. This ruling can help ingrain the separation of the personal life, and speech, and when they are on the clock at work.

    @Ron - She must have been considered an employee by Lucasfilm if they were trying to FORCE her into a 40+ person struggle session. Since an entire show was being designed around her, Faverau certainly thought she was going to be working with him on a Disney Star Wars show for many years. Just because there was no current contract, their behaviour shows they were treating her like an active employee.

      She was on contract for Mando season 2 and maybe more seasons and there was discussion of her own show and Jon Favreau was a big supporter of hers. What's cool about Gina is she was no 90 lb Mary Sue but a real warrior fighter who looked the part so this is girl boss done right and she has legions of fans. Yes she was an employee but like all employees anyone can get fired for whatever reason when someone is out to get you. Honestly Disney would be smart to bring her back as it'll help with ratings.

      Jon Favreau informed Gina, in October 2020, that Disney had given him the go-ahead to produce, Rangers Of The New Republic. By December 2020, Favreau had already completed 2 scripts for the series; with The Pilot being given to Gina to read. Paul Sun-Hyung Lee (Captain Carson Teva) supposedly also got to see The Pilot, as well, since he was going to be playing Cara Dune's partner in Adelphi Squad. When Kennedy pulled the crap she did, she screwed a large number of people who would've been involved in that guaranteed success of a SW show...all because she hated the fact that all of the female characters from The Mandoverse were being praised and adored by general SW Fans, inc. the DREADED MALE SW FANS; which made characters like Rey, Rose Tico, Admiral Holdo, etc. look like the faulty, over-baked creations they are; which demolished her narrative that women should be a major force in running SW storytelling...STUPID and UNLAWFUL.

    Regarding the "But if she said this..." hypothetical, why not turn it around? What if Disney fired someone for posting an Instragram image of their pancake breakfast because Disney wants their audience to like waffles?
    This is exactly why most common people are skeptical of the "corporate persons" legal argument. Too often it amounts to corporations asserting greater legal rights than the people. I can respect that a business needs some protections to conduct themselves as they see fit, but if they cannot show how the conduct at issue is RELEVANT to the business, then they have no grounds to interfere with the rights of the individual.

    I would argue that investors are supposed to have legal protection from the Company's political views causing widespread financial losses. Simply because the company is choosing to inject those views into high profile shows that never had those views. As well as the fact the Company has a fiduciary duty that is legally binding to look out for investors interest over their political interests. Yet their focus here is an Actor using their 1st amendment right outside of the the "high profile show." You can also show that her firing lead to further financial damages to investors. So really when Disney is arguing this they are also admitting they violated their fiduciary duty. Just as we see official interviews with people Disney casts in other shows speaking volumes of vile hateful attacks against the fanbase and causing even more financial damage to investors... yet Disney takes no action there because it is a mirror of the same political beliefs they are pushing. At the end of the day Disney is in the wrong PERIOD because they have violated fiduciary duty and really what should be happening is an investor lawsuit. So when I hear "it's their company"... well no it's not. They are losing others peoples money. If they want to prop up whatever political view and take the losses... you do that as a Private Company with zero fiduciary duty. PERIOD.

    As an adjuster that handles civil rights litigation and cases citing violations of free speech (the Unruh Act as I'm in California), this litigation is going exactly as one would expect. Disney is trying to kill this litigation with a motion to dismiss. As an adjuster I would expect to motion to fail, and I would be assessing the options once it fails. Does Disney want to go through litigation and have to answer discovery? Only Disney knows what potentially could be turned over. Is it going to be worse for those things to come to light? If so, I would expect Disney to immediately try to position the case for early settlement discussions. I would not be shocked if there would be an early mediation and that they will have a settlement that will not be publicly exposed. Disney world rather do that then have their dirty laundry come out and potentially have an adverse verdict.
