    I've seen many videos where the person being stopped was calm and respectful but the officer escalates the encounter. How does one combat that?

      Record everything you can. Be calm no matter what. Keep your hands on the steering wheel at all times. When they ask for papers tell them where your license, registration or insurance is and ask is it ok for me to reach and get it. Assuming the cop is acting uncool. If the cop is acting like a decent human then keep it that way.

    In my work over the last 15 or so years, I had to travel a lot -- about 150 days per year. That means I had to drive a lot of rental cars. I never got pulled over, but I had decided in advance that if I were pulled over, and the police wanted to search my rental car, I was going to say NO! I would do the same now with my own car, but in a rental car, it is even more important to say no, because you never know what someone else who rented that car previously might have stashed in the car.

      I have been in a situation twice before where I refused a search request and one that I asked cops to leave private property and all of those ended correctly. A number of times as a younger man was searched illegally this was before phones had cameras and in situations you just let it happen and drove away feeling lucky the didn't plant something. Record. Refuse requests. Stand firm on your rights.

      You could argue that if you decriminalize all but the most harmful drugs you would get rid of a large percentage of the police personnel and you wouldn't have to suffer the routine stops over nothing just as an excuse to get into your vehicle to search for them or to get your ID on the police database. Fight any illegal actions people do when they are on drugs just like you do with alcohol. Legalize them, sell them from approved distributors with quality assurance and then tax them.

      ​@@wjf0ne I don't think so. There's now horribly violent crimes on the rise in California from cartels stealing land and water to grow their own pot on federal and private lands so they can grow it locally and avoid smuggling hassles...
      And that's just pot. Not to mention the fact that many of these guys are lacing less impactful recreational drugs with deadly drugs like fentanyl to increase their return buyers.

    If you don’t consent to a search then they bring out the dog (after 20 minutes and the dog will jump all over your car scratching the paint…. And even if you’re innocent and have nothing to hide…. The dog will still “allegedly” hit on your car.

      One thing about the "drug dog". Usually, they have to extend the stop to wait for the dog. If they've given you the citation or warning, the stop is over. Record it, and keep asking if you're free to go. Your lawyer will thank you later.

      The dog hits, because they teach it to "hit" on command. They always get their excuse for probable cause, because they manufacture it by getting the dog to lie for them. The dog just wants praise, it's the scumbag on the other end of the leash that is breaking the law.

    Sadly if you refuse officers will claim that is “suspicious” and therefore gives them “reasonable suspicion” to search your car. Also even if your polite some will claim that you refusing is a hostile/aggressive behavior.

      So what? !!!
      You can't stop what they are going to do - but you CAN record what they do and you CAN call them on it and you CAN ask for RAS and for probably cause, and you CAN verbalize your non-consent to any searches or seizures.
      While police can indeed make up anything they want, the place to argue that is NOT on the side of the road, it's in court later. THAT'S why it's so critical that you record and ask them if they are recording as well as keep your composure, because that will go well for you at the time as well as in court.

    Also, by allowing them to search your car, you are making yourself vulnerable to dishonest police that are going to frame you to get their numbers up. And if you don't think that happens - You are fooling yourself!
    Not to mention the fact that you don't know what accidentally made it into your car because it dropped out of the pocket of your kid's buddy, or from behind the ear of a mechanic, etc.

    Depends on who stops you! Time and time again there are recordings bring posted where a driver has tried to excercises his rights calmly and he is then physically pulled out, cuffed, in back of car and search goes on. And in many cases body cams turned off and some from of a beat down takes place. Rights not accepted by law officers.

      Generally they are calmly exercising rights that only exist on the internet. If they are forcibly removed, it’s because they were asked 50 times to exit said car and they refused. That’s a right that doesn’t exist.
      You have the right to ask for a supervisor but the supervisor isn’t required by law to come there.
      The list is long of rights these so called auditors tell you exist but actually don’t.

      I saw the troopers wedding ring and said your a married man, mind if I go over to house and schtupp your wife? His jaw fell open, and said it pisses you off that I even ask because that is your territory. Well this car is my territory, and it pisses me off that you even ask to search my car. You stop me for a supposed speeding violation, but that was simply a pretext to pull me over. So he just blurt out....Whats in the contractor bag in the back of your car? It's full of 100 dollar bills what do you think? No he never got to search my car. Officer Petty of the Nebraska State Patrol was aptly named. Car was a 1986 Subaru wagon with clean and folded laundry in a plastic contractor bag. I was going to work at a nearby dairy where I was night herdsman 6 nights a week for two years straight and boy did I get hassled by the cops. Worked 12 to 8 in the morning, and was driving to work at 11:30 at night and this brought every cop in two counties at one time or another. Yes they lie about traffic violations just to get you pulled over hoping for an easy DUI, but instead got me on my way to work. I'm not shy about calling them out on their illegal bullshit they pull. They like this even less than they do finding out it is a completely sober driver with all his papers correct driving the car. Stuff like...The next time you feel like going fishing go to the effing lake! Really endears them to you. lol Pushback has to start somewhere and it might as well be me. I can't tolerate a bully of any sort, so these posers really get me going.

    I will never allow a police officer to search my car for one simple reason. I buy my cars used, often from individuals. there is a doctrine that basically says anything found in my car belongs to me. I have no idea what illegal debris has been left behind under the seats and tucked away in the trunk by previous owners. I am not going to take the fall for what others have done when I can simply say, no you can't search my car.

    They want to search your car so they can plant something if they just dont like you or if you are rude. Being rude is never a good thing to do. Respectfully decline. If they say they smell weed tell em yeah I smelled it as soon as you walked up, it must be in your clothes from a previous stop or something. If they say your eyes are glassy have you been drinking? Respond with your eyes look glazed have you been eating donuts? If they laugh your ok.

    Some dirty cops actually plant drugs during the "search". I've seen it on youtube recorded by the cop's own body camera. The poor girl was extramely lucky it showed up on the bodycam footage.

    Excellent advice that is offered by a likely first-rate attorney polished in his craft. For those citizens not versed in the law, I can only agree with their logic. That is, the failure to give consent will likely agitate the officer regardless of arousing suspicion of any potential wrongdoing and issue a ticket out of spite rather than a courteous warning. Even knowing the law and your rites will not improve your chances with your insurance carrier.

    Ohio has a law and its old and this law says that a police officer in ohio has to deal with whatever they pulled you over for BEFORE being allowed to ask you to allow a search, IE: you get pulled over for no license plate light the officer is NOT allowed to do anything except deal with the license plate light issue first, after they are done with the license plate light issue and according to the law they have to give you your license and any tickets to you physically and only after they have given your license back can they ask to search your vehicle, most cops know that the majority of ohioans are ignorant to this law and I'm sure they break it all the time and the courts and the defendants own lawyers allow it also seriously, but when the officer hands your license back say have a nice day roll your window up and drive away while they are asking to search its totally within your right to leave a traffic stop once your license is given back, if the officer keeps your license then asks to search this is considered by ohio law "kidnapping" because the officer is keeping your license there by keeping you hostage till they give it back, I think the law is the "bright line law" I'm probably wrong on the laws name tho???.

    Only time an officer ever asked me was on a traffic stop on the interstate in the Texas panhandle, I was in a recently purchased car with paper tags and had the window down with no shirt on and my dog was riding shotgun. I imagine that I looked like a drug runner. When he asked I just said, sure, knock yourself out and in about three or four minutes he had finished his search and my dog and I were back on the road, still looking sus.

      Tell the cop to remain very calm as smelling something that isn't there is a strong symptom ( phantosmia) that they are suffering from a stroke and that they need to lie down at the side of the road immediately whilst you call for medical assistance!

    as a lawyer trying to educate ohioans you should post the law I talked about here so ohioans know this laws name at least and can say to the officer the laws name and how the officer is in violation of ohio law pertaining to how traffic stops are made....
