    Trump can do what he wills within the boundary of the circle of presidential acts. Who decides that boundary? Much discretion is given to decide among the parties involved. But most decisions and acts by the President fall within the hoop, more than one might think, and the other acts do not extend beyond the perimeter of the circle. Why is it so difficult for the courts to understand this? They are so dumb. The president must be given as much power and latitude as needed for his official acts, otherwise he would always second guess himself, freezing up the country, wasting precious time and resources and productivity, and so what is permitted in the circle and what is outside the circle of acts for the most part at the President's discretion. This is what makes a president. No other person has his power in a country between the courts, legislature and executive. Republicans tend to give more latitude as a capitalist society, and Democrats stifle progress taking after Hitler, Mao, Stalin. Nancy Pelosi, Mike Pence, Christopher Wray, and Merrick Garland, communists, and socialists and Marxists.

      Yes, they are dumb and you are smart. But by your comment(s) you are missing the entire argument. The defense is trying to assert that the president can commit criminal acts and that unless he is first impeached and convicted by Congress DOJ cannot do anything. To defend that they are using civil cases precedence. This is a first, because before Trump no president has attempted to stop the transition of power after losing an election ( criminal act). So you seem lost....a "president discretion" is checked by the other branches that is how our Constitution is set up.

Stopping the transfer of power is NOT an official presidential duty, calling/threatening/pressuring states to illegally change their vote results is not within the duties of a President. Let me remind you this case is about the attempt to stop the transfer of power and this appeal claiming "immunity" is just to slow the legal process. I am willing to bet that the defense will request this panel to re-hear the case again, and after that request the entire panel of judges (10 I believe ) to hear it again. After that the SCOTUS. The arguments by his lawyer are moronic based on how our system is setup and it is obvious by the Judges questions that they were not buying the BS. But for people that chanted on command "Mexico will pay for the wall" they think it rises up to something beyond taking the courts time. On other matters....Capitalism is an economic system not a constitutional or political/governance one and has zero to do with this appeal or the case at all. You are clueless based on your rant/word salad. I can see the appeal been denied because the way the Constitution is setup no one is above the law as a principle and this process will set the precedence in case we experience another criminal president.

      The impeachment that failed was a criminal charge so double jeopardy applies of course as does the subsequent indictment which was illegal. But even then immunity is absolute, meaning within the sphere of the hoola hoop acts permitted.

      One more time slow one IMPEACHMENT is a political process, is not civil, is not criminal. Congress doesn't prosecute or convict anything criminal or civil. Congress legislates (creates laws) DOJ enforces the laws. Impeachment is designed to censure/remove a president from office by impeaching (House) and convicting (Senate). Once removed from office then DOJ prosecutes. You think you got it this time. There is no double jeopardy. That argument is just Trump's propaganda and misinformation for the gullible or ignorant.
      The Judges will laugh at that one as an appeal.

    If impeached and convicted (Senate) by 2/3 vote, Trump cannot be charged again because of immunity and double jeopardy. Pretty simple. The 2/3 standard is higher for the president. The case is done.

      The double jeopardy argument has no standings. In 1986 during the impeachment of trial of judge Harry Claiborne the senate ruled a criminal conviction doesn’t require and impeachment and someone acquitted in a court of law can still be impeached. In 1993 the Supreme Court ruled in the case Nixon v United States that impeachment is solely a political question. Double jeopardy applies to criminal. So if impeachment is a political question then double jeopardy doesn’t apply.

      @@Parture those aren’t random cases those are precedent. Double jeopardy only applies to criminal not impeachment because they’re political questions. If double jeopardy applied you wouldn’t be able to impeached for something you were acquitted of in court of law.

    The chief executive ( president) has the role of making sure laws are followed. Like it or not, that also means for elections that they're in or not. That would be part of his/her job. Therefore immunity during official acts ( which making sure elections are being lawfully carried out) is just that. An act they MUST carry out as chief executive . Every lawful act he committed was during his duty as Chief Executive. Communists just want you to believe that he was just crying " hand me the election " regardless. Which no act or comment by him says as much. Communists want you to believe that alternative electors , which is legal, is fraudulent . How is the chief executive supposed to carry his lawful duty to secure elections without immunity? We could just arrest every damn president who carries out such duty. Made up or not.
