What is Social Security Spread Language in a Work Comp Settlement?

  • Under the workers’ compensation offset, created by Congress in 1965, the total amount from SSDI and workers’ comp cannot exceed 80 percent of the person’s “average current earning.” This language has no effect on the amount of the worker’s compensation settlement itself; all it does is preserve Social Security benefits to the greatest extent possible. Inclusion of the language can reduce, or sometimes eliminate, the offset.
