ORDER OF PROTECTION: Judge accused of retaliation & toddler's failed drug test

  • ORDER OF PROTECTION: Nearly three months after a Charlotte, NC District Court Judge awarded temporary custody of a toddler to his father, the child failed a drug test.
    The child’s mother spent 11 days in the county jail for refusing to follow a judge’s order to hand her son over to his father for scheduled visitations because she argued the father was still abusing drugs.
    Kent served two days before her family could come up with the $50,000 bond Smith imposed at the April hearing.
    Once freed, Kent hired a private investigator to track Graham and to figure out whether Graham was abusing alcohol and drugs and whether he was putting their son at risk. It took the investigator a matter of days before video recorded Graham in a grocery store parking lot using drugs.
    After we contacted Judge Sean Smith detailing what we were preparing to report in our ‘Order of Protection’ investigation, the judge removed himself from the case. Neither Joshua Graham nor his attorney responded to our requests for interviews.

      Nobody! I'm learning this as I go thru my custody case and I am in the same situation as this mother! Ex failed drug test and judge still ordered visitation. I'm panicking because there's nothing I can do and the biased judge dosent actually care about what is beSt for child. FyI I passes my hair test with 0.00 of any drugs in my system. It's disgusting and scary.

      There IS a bar association or investigation committee- the judge over some of my cases was recently indicted and is out of office pending outcome of trial - but, it’s not easy

      Remember the judge that let that boy off of rape charges? Well I think he gave him probation. People heard about it and went crazy. The judge had to recuse himself on that case. That's what needs to happen in cases like these. The word needs to get out and people need to get infuriated and voice their opinions. Voice their opinions by emails my phone my text by letters to the governor by phone calls to the courthouse. Over and over for days weeks and months.

      That's very true. They don't read the paperwork they just automatically go in there and believe whoever the drug user is.
      I just watched a case where Mom was currently in jail for domestic abuse and the father wanted temporary full custody. but, the judge did not allow it.

    I was a custodial father with a drug addled ex wife. I faced this weekly. I provided proof if her abusive nature. Judge gave her custody eventually, which led to extreme physical abuse, and eventually, CPS pulled the kids out of her home. I then had to FIGHT CPS to not have the kids put in a foster home.
    The system is broken.

      @@selinacrum2422 this was 20 years ago, I was eventually given full custody. Including of a child not biologically mine.
      I then found a lawyer friend who wanted to be a judge...and took the judges ROBE.

    These judges care more about themselves and respect than the safety of children. There should be no such thing as judicial immunity. This case is the quintessential example.

      I disagree.
      It’s important for both parents to follow court orders even if you disagree. Because parents always disagree and if one parent can step out of order then the other parent can follow suit and create his own narrative and also violate the court order. Back and forth it goes with no center power to find the best solution.

      You can’t just do what you want. Marijuana is legal. If a man wants to smoke marijuana that’s his right.
      He wants a beer at the end of the day? That’s his right.
      Millions of parents do this; why is Joshua being scrutinized for it?

    - mother says that father is abusing drugs & alcohol, therefore a threat to the child
    - judge doesn’t believe her
    - mother refuses father visitation
    - judge holds her in contempt
    - mother gets proof
    - judge ignores it and says that mother can’t be trusted because of contempt charge
    - the court gets the same proof as the mother
    - mother is proven right therefore her contempt is justified
    - judge recuses himself
    - mother gets custody

    I am so tired of this qualified/judicial immunity for judges and police officers, they are the worst and abuse their power all of the time.....crooked and corrupt system, such a shame!!!     Knowingly leaving a child in the custody of a drug addict and that child latter testing positive for drugs is a criminal civil rights violation and the DOJ needs to charge this judge with criminal conduct and put him in federal prison. Judicial Immunity doesn't cover criminal conduct.

    Jodi is the GOAT! I am watching from the UK and I cannot believe it takes an investigative journalist to initiate a corrective response. The US judicial system is broken, from wrongly incarcerating people for many years with little to/no evidence, to failing children who eventually end up dead because social workers lie or fail to perform their jobs. We have our problems here in the UK but as with all things in the US, it is much worse.

      The UK isn't any better.
      I lost all faith in the justice system when the judge allowed my abusive stalker ex husband to have unsupervised visitations. My daughter would literally get on her hands and knees begging me not to send her to her dad's because she was so terrified.
      The only reason he had taken me to court was to cause further upset to me and true to form, the judge allowed visitations and threatened to remove my daughter from me to give to him. This was despite dozens of police reports, death threats, recorded physical abuse and of course the carcass report - the judge actually stated in court he only read the first couple of pages and that he wouldn't base his decision on the court approved non bias assessment.
      The result was that I had said would happen, he again never showed up for visits and on the odd occasion he would see her, he'd get tired of her after an hour.
      So my daughter knows her dad has unfettered access but she chooses not to. That is hurtful and i would have preferred telling her her dad wasn't allowed to see her because then she could have this illusion that he cared for her. Sadly that isn't the case. He saw her for about 2 hours for the whole of 2023 and 2022. Oh, and he left when she was 2 and didn't pay a penny in child support in 16 years.

    Please keep reporting on this crisis. Thank you so much for showing how broken the family court system is. There are so many different solutions to ensure this child’s safety. The Judges and system are so corrupt and fixated on their “own” views without even considering all the facts. This happens every day and even worse women are consistently being killed by their abusers. No one in the system cares.

      They won’t care until we MAKE them care. If you’ve been negatively affected by “Family Law”, it’s on you to do your part to end the abuse. No one will do it for us. I aim to see the abolishment of “Family Law”, which is a multi-billion dollar industry only because no one has called for it to end yet. Allow me to be the first. Who will second? 😉

    I think our nation has given “Family Law” more than enough chances to do right by our children. The “pay-to-play” system (which I personally wasted $33k on, only to be disbelieved and punished at every turn) needs to go. The only way to stop it, as is the case for 100% of social problems, is for those affected to document abuses by perpetrators and profiteers of the system. I plan on standing in front of my Superior Court with a simple sign asking, “Have you been harmed by Family Law?”, and gathering questionnaires about people’s experiences. DO NOT rely on the non-profit sector or legislators to do this for us. Our suffering gives reason for their existence, and they’re not really going to do much to change anything, lest they be out of a job. Each of us is smart enough to know what questions to ask. Compile your data as best you can, and go to your local university to get help with analyzing the data into a report which you yourself will bring to your legislators, demanding that a full review and audit of your state’s “Family Law” system be implemented. Go to your local news outlets. They probably won’t help initially, but hopefully they’ll keep it on a file somewhere until such a time that the subject becomes “newsworthy”. I can help you with the questionnaire if you truly don’t know where to begin, but ultimately each of us will bring our knowledge and experiences to the table. You don’t have to feel hopeless. Our activism is the price we pay for living in a democracy. Use it!

      We need transparency in the family courts. They hide the disgusting things they do behind the childs privacy rights and quite literally kill children. I take in fosters who have been thrown out on the streets as young as 15.Mind you the people keep the checks. I had a kid show up 19 degrees outside with nothing on but shorts and a cut off T-shirt. The horrific abuse they suffer and the things they tell me gives me nightmares. Not one has ever told me their parents really abused them. The families were either poor and couldn't fight or got caught with a not perfect house or had an addiction problem that was easily delt with. Nothing like the monstrous things done to them in the system.

    What happened here is she pissed off and sued one judge and best believe it’s going to trickle down from judge to judge especially in the same county they’re all co workers and friends and look out for each other she’s going to be screwed from now on every time she steps in the court room

    Judges need to explain every single step they take with the reasoning why they made that decision and they need their powers to jail on contempt SEVERELY curtailed.
    There’s been many cases where a judge has ordered someone jailed on contempt until they apologized, which is government compelled speech.
    They’re just as dangerous as cops.

      No, they sentence them to a week, a month, up to 364 days for contempt. Sometimes if the contemptuous decides to apologize the judge can commute the rest of the sentence. They don’t have to though.

    I just received word from my very great friend that works in the Mecklenburg Courthouse, that the Leader of the Family Court Judges has a special needs child with the same diagnosis as Roman. The hypocrisy that is being shown by these clowns is absolutely hard to believe. Her team has been saying for months that this is all made up and the child is fine, but yet the actual medical doctors have not only diagnosed this condition, but they also assigned 26 weeks of specific therapy for him.
    Judge Trosch is her name circus leader and the head clown. This will be my last comment regarding this case regardless of the outcome, so I will leave you with this; Always treat people with kindness and care and never poke a sleeping bear.

      Pretty sure “judicial committees” are mostly about protecting judges. I was floored when my state’s JC let my judge off the hook for his clearly biased treatment of me, until I read about a DA from my state who got busted for soliciting sex from his clients in exchange for service (I.e. doing his #%! job). He got a slap on the wrist and is right back to lawyerin’.
      But really nothing will change if we fight on a case by case basis, and I don’t think any victims should have to publicly share their personal stories for a chance to be taken seriously. Changing the law is the only thing that will change this. Each state has its own system for administrating family law, which means each state could potentially dispose of the system entirely and create an alternative. Everyone involved in “Family Law” knows the system is broken, yet they do nothing to fix their own problems. Let’s do it for them!

    He's unfit because he does drugs (weed) and drinks (beer). He doesn't obey the laws,
    She proceeds to break court orders and gets held accountable
    Says he followed her and harassed her
    Proceeds to hire a PI to follow her ex around
    Doesn't let the father see the kid, ever under any circumstances despite no evidence of abuse. 5 times total in this kid's life.
    Talks about how damaging it is to virtually see your kid when her rights are removed
    Admits she continues to do things wrong
    Yells retaliation at the consequences she generated when the courts cannot trust her, because really they cannot
    Finally provides proof that the kid is being impacted by showing THC in his system and now we should all be on board with her being the victim.
    If they give this lady this baby back and she flees with him or heaven forbid, does something to prevent the father from ever getting him again, the people would ask how the judges all missed the warning signs that she was unstable and shouldn't be trusted.
    All of this sucked to watch. All she had to do, was follow the court order and let the guy hang himself. Maybe it's a long process, but what a way to make everything 10 times worse. He doesn't beat the kid, he feeds him, has help taking care of him, and smokes pot. At the end of the day, you would always have won, until you really muddied the waters, infact you had everything, all you had to do was give him visitation but threw it all away. She needs to get therapy or someone to help her start making the right decisions.

      she could have petitioned the court for supervised visitation if she thought there was concerns. Completely denying visitation is mean and spiteful. By ignoring the court orders altogether she puts herself above the courts.

    I know how it feels. The courts placed my child with her father. Luckily he doesn't keep me from her but he has a record that makes any parent question everything the courts and dcf are thinking. the courts and dcf have to be held accountable for their actions. I'm not saying some times they get it right but other times they get it so wrong.

    That poor kid is going to have abandonment issues his entire life. She didn’t say anything yet about nightmares, but they can come at any time throughout his childhood and even into adulthood. He’s going to have a hard time with commitment and maintaining healthy relationships and that’s no matter how hard the mother tries to mitigate what these judges and the father has done to this child. as far as the judges are concerned, not all abuse is physical. Sometimes the emotional is worse and what you perpetrated on this child was emotional abuse after the mother told you the truth and you chose not to believe her. What is it some sort of male brotherhood? I could tell just by looking at his face that he was doing something. That means he was smoking around that child while he was breathing. And it takes 30 days for pot to get out of your system. So while you’re punishing the mother by withholding her child, which to me is kidnapping, the child was being subjected to secondhand pop smoke because you thought he was a better person than the mother. This is almost as bad as taking that newborn baby away from that black, Texas mother, and father, because he had jaundice. They kidnap that baby for more than three weeks. Therefore, it was not able to bond with its parents as it should have.

    I had a neighbor, and we were quite close. She babysat for me and I babysit for her. Her second husband was sexually abusive to her older daughter, and to his own daughter. He actually made the younger son watch him abuse, his own daughter. The older daughter didn’t say anything ended up being addicted to something, and only finally confessed that she had been abused as well after she got out of rehab. Still the family court judge decided since the father remarried and had another child unfortunately, a girl, that the two younger children had to have overnight visits. This was before cell phones, so she couldn’t smuggle a cell phone into their overnight bags so they could contact their mother, and there was no contact allowed while they were at their fathers. this precious child was only six and she couldn’t sleep because she was so scared that her father would come into her room and molest her. Mom couldn’t do anything and was powerless to protect her child.

      I knew of a woman in a similar position, but the pedo ended up dead and they claimed the mother conspired to have him killed. She claimed to be totally innocent. I've forgotten her name or I'd look up the case now.

    This is over a year old. The only drug talked about is marijuana. That is no reason to not allow dad visitation. Get it court order for drug test before visitation. But no, mom withholds visitation. Allow the courts to work for you.

    Why can't they let Graham have supervised visitation through CPS or a mutually agreed upon party to supervise until such time he can show he is drug and alcohol free with primary custody to mom.

    Women love keeping their kids away from the fathers as a way of punishing them for not being with them. Using them as pawns is not being a good mother. My ex did the same thing to me. Didn't seem my kids for 9 months because she accused me of doing drugs and alcohol. I did two years of straight drug testing every week and everyone was clean and still had to see them through supervised visits at a mental health facility. Vindictive women are the most despicable people on this planet because they put themselves before their children

    Its not the fact the father smokes weed. Thats not a big deal. The father is a known alcoholic. the toddler tested positive for Marijuana which is not ok. Its not a big deal that someone partakes in smoking, but its a big deal when a small child has injested thc bc a parent is irresponsible.

    This is retaliation against the mother from the judge’s side. And him being in that court with the new judge on the bench, when he had recused himself, he wanted to make sure what he started sticks. He’s taking out his aggressive against his ex-wife on this mother trying to protect her child.

    So the 1st judge asks his friend to take the case. The 2nd judges ego didn't cate about the best interest of the child. That much MJ in a child that's still forming could have slowed him down. What 🤡🤡🤡

    Im not a part of this, but ima be real. the dude could just smoke weed and the mom might be crazy, growing up in a household with a similar dynamic (court issues and custody disputes) my mom would constantly try to assassinate my dads character and vice versa, idk about the weed or alchohol bc it depends on your relationship with them, but i could easily imagine a scenario where the mom doses the kid and takes him to get tested so that she can claim it was the fathers fault. fucked ik, but we werent here for this whole case, and we certainly arent these people. i hate that yall in the comments always want to sentance people to death for shit yall arent even apart of. We dont know who is in the wrong and we wont.

    8:10 You can hear in the clip she is lying. He is saying he doesn't care that the dad doesn't know all the specifics of the child's care because he has only seen the kid 5 times. It is a matter if simple logic. The father not knowing the kid's bed routine is irrelevant when she has kept him away. This is making no comment on anything else.
    The drug evidence is a separate issue

    My opinion of this is a bit skewed cause she was clearly in contempt and keeping him away from his son caused him to escalate. To ask the judge to follow the law and you didn't is wild. Her proposal for child custody doesn't have to be agreed to. She kept the kid from him for his first three years with no contact. He gets approval and you don't agree so you escalated. The only way this would work is if everyone did was SHE said. Sorry. I disagree with her.

    I use babysit a 2 year old boy. He was abandoned by his mother. 6 months later, she appeared back, demanding the baby back from the dad. The state NJ gave the baby up like nothing. A year later, the mother boyfriend beat and squeezed the baby to death. This broke the heart of the father,who never got over this nighmare. Father gave up on everyone and life.

    Parental alienation is wrong. You CANNOT do it and think that just because you're a mother its ok. Children need their dads too. They aren't second class citizens or second class parents and I'm glad more judges are waking up to it.

    This happens all the time unfortunately. I’ve seen the same series of events in reverse too with zero evidence and multiple assessments, even sassi and hair tests all negative and still they will go on record with the allegation of substance abuse claim.

    Yeah whether he’s abusing drugs or not is a different issue but you cannot unless a judge orders it prevent him from seeing his kid think about how you feel and then think about him for three years you didn’t let him see his kid think about he feels

    what I did was have in my custody agreement that If I believed the father was under the influence of drugs and/or alcohol; I could deny visitation. I also had another person present when he showed up. also the court started making him take drug tests randomly.
