Is it necessary for police to attach original statements with report u/s 173 Cr.P C or can photocopy attached with challan be used to contradict ?
What is effect if at end is also written for witness that statement is read over to him, heard and understood and it is correct.
Original records must be sent to court by the police. Witnesses must take interest to get their statements from police and read before entering the witness box.
Sir, can statement be recorded without oth of maker u/ s 164 (5) ? If yes what is validity of it ?
It is not recorded under oath. However the witness is explained about the consequences of his or her statement before recording their evidence by the magistrate.
Its Clear written that statement under clause 5 to be recorded on oath..its mandatory..!

Would you be kind enough to portray the police rules as 86 yrs old was illegally inducted by making FIR with the help of an Adv. Threaten every Thursday to pick the innocents and gained lakhs from s respectable family.
Can a witness be declared hostile if no statement under section 161 Cr. P.C was recorded.
The hostile questions arise only after recording statements u/s 161(3)crpc.
brain mapping test does not violate the article 20(3)
1. Admission is a statement oral or documentary which suggests any inference as to any fact in issue or relavant fact. 2. Confession is a direct admission or acknowledgement of his guilt by a person who has committed a crime.
Sad that hasty decision in providing stay by honourable Justice Anand Venkatesh in Madurai bench of Madras High court has resulted in injustice. Without hearing the case details or document verification of opponents why have he been so hasty is ugly.
Now the case is pending for listing for several months and when can the stay be vacated and justice met.
