It’s not atc responsibility to keep you legal, it is the pic. Same with visibility or cloud clearance. You can ask for anything and often they’ll grant it without questions. I’ve even heard multi plane formation asking for transitions at 250 feet and being approved as requested. As for altitude you still have to comply with 91.119 (a) Anywhere - An altitude allowing, if a power unit fails, an emergency landing without undue hazard to persons or property on the surface. So the outcome may be the deciding factor if you were reckless or not, while looking at the reasons and needs of the altitude being flown.

As a resident of Culver City and frequent bike path user. People are likely at the beaches in Marina del Rey since the bike path that starts in Culver City, about 5-6 miles inland and cuts through many other residential areas such as Fox Hills, Playa Vista, and Westchester among others, and follows the Creek to the ocean remains open. So people are probably going on runs/bike rides to the beach and stop there take in the view. Other than that, Marina del Rey is more of a tourist destination than some of the other southern beaches which could also describe what we are seeing there.

That blue building is CALLED “The Blue Whale.” I suspect the reason they refer to just that building in air traffic as opposed to the name of the whole complex is because there is a helipad on the roof of “The Blue Whale.” In fact, the Red Building (that’s actually the official name of the red one) has warnings written on the rooftop forbidding helicopters to land there.
