She should buy the business today based on the profits of the business. Then when her dad passes later she still gets her 1/3.
It's quite unfair to label the brother-in-law as foolish without knowing his perspective. Dave tends to make judgments based on whoever he's speaking to on the phone, without considering the other side of the story.
