      I watched it in real time and it didn’t sit right with me at the time. It felt very rushed.
      I did notice she didn’t address either set of attorneys. What really stood out was how she didn’t come up for a breath as she addressed the jurors and declared a mistrial. It was glaringly obvious she was rushing

    I followed this trial as if I was a juror. Did not know anything about this case. I really don’t know why this jury was divided. It was obvious the CW did not prove this case beyond any reasonable doubt in ANY of the counts.

      Like most I heard the media fake version. Then later I heard the FKR version. I chuckled about dog bites being such convincing proof of him in the house in a human fight. The McAlberts can’t escape the implications of the animal involvement. Defense should prove the dog isn’t in Vermont if necessary. Some of the 10% against KR would change sides imo.

And during a correspondence with Aiden Kearney, a.k.a. turtleboy, one of the McCabe’s said he had a direct line to the judge and referred to her as Auntie Bev.

      I agree. I am very, very interested to see if Auntie Bev retires in the next few months. That's seemingly the go-to move of apparently corrupt government employees.     HOLY CRAP- It just occurred to me- Lalli is arguing the wrong thing in his motion to dismiss.
    By citing Blueford he’s arguing that there’s legal precedent which says the jury’s possible acquittal is irrelevant (Blueford v Arkansas). But the motion Jackson and Yanetti filed ISNT ARGUING to reinstate the acquittal- they haven’t gotten to that point yet! Rather, they are simply moving to hold a HEARING and the jurors brought back to ascertain whether they indeed intended to acquit or not. And if you read Blueford in detail, in that case the court DID IN FACT bring the jurors back to have such a hearing.
    So actually, Blueford is confirmation that the judge should GRANT the motion to hold a hearing, bring the jury in, and ask them what they intended to do.
    AFTER that hearing, if we find out that the jurors did intend to acquit Karen Read, THEN it might be appropriate to use Blueford as case law to argue that it’s too late or it’s irrelevant or whatever (although it still looks like there are some major differences). But for the moment, the only thing on the table is the motion to hold a hearing, and Blueford only confirms that YES they should hold a hearing.
    I hope Jackson and Yanetti realize this and use Lalli’s own argument to shove it up his

      this is an unanswered legal question because the judge didn’t bother to ask the jury if they came to a verdict on any of the charges enough.
      no judge in this country has made a mistake so obviously preventable and now neither side can cite a case with the same fact pattern as this one to give them an understanding of what to do.

    She did NOT have adequate time to raise an objection!!! Auntie Bev saw to it that there were no objections raised before she sent the jury out.       I think they told her in chambers and she'll deny that, but the jury thought she would go make this right and when she didn't the next day they started coming forward but those that have have to make the other 8 come forward now and just keep the pressure on!!! Hopefully they now know any all the corruption from auntie Bev on down and will step up and speak out. They should go to the steps of the courthouse call the press and make the announcement of what their decision was!!!

    Intially, the judge told them "not to fill out the verdict slip until they came to a unanamois decision on the chargeS" I rewatched the video of the trial. Clearly, the jury or the appointed Lead Juror did not fill out the verdict slip due to not unanamois on count 2. Not to mention Count 2 issues not having not guilty was brought to the attention of the courts. Obviuosly Count 2 was written poorly at the least. The judge should have confirmed they not unanamois on all counts, she is the gatekeeper of the trial. Shame on this judge and this CW, they clearly do not respect the law or the jurors.

    The Judge in this case set the precedent that when notes come from the jury, she would read them to counsel without jury present and hear from the lawyers and than make her decision... she did this each time before... Than went rogue and chose a mistrial without hearing from anyone. Now, in hindsight her chosen path of procedure squashed KR 's constitutional rights! ALL charges should be found NG... she did NOT hit him with the car! Sanctions should be brought against this Judge.

    When you listen Bev giving jury instruction, she specifically said that after jury finish deliberation, they will be called to the courtroom and the foreman will read the verdict. They were never given that chance, they were immediately excused and the mistrial was declared by Bev.

      Her brother is an attorney and represented Chris Albert after he was involved in a hit-and-run manslaughter case in 1994. Yeah, she refused to recuse herself.     The argument isn’t that the jury needed more time to deliberate or should have been sent back out. The argument is that the jury had two verdicts, didn’t know how to communicate them to the court, and weren’t fricking asked because Bev, true to form, had already made up her mind about something and didn’t want to know if the lawyers had anything to say about it.

If Bev does nothing I bet jurors will give damning public interviews and hopefully the FBI will interview them as well. The McAkberts knew about the acquittal on count 1 and the split on count 2 prior to the end of deliberations. MSP is in charge of the jury. Hopefully phones are tapped.     I think Bev will have to entertain this jury and their decision. Not bc she wants to, but just like she reached out to people above her once before on when she changed the form to the way the defense requested. It's obvious Bev changed the form but never told the jurors they were required to mark off boxes. She wasn't expecting to have the jurors talk about her not giving this instruction that she is going to be forced to entertain the jurors' decisions on each case. Bev only does things for her selfish mind or her friends within the system until she is uncovered.

    Mark: they didn't check NG on 1 and 3 because the final jury instruction told them not to fill out any verdict slips until they had decisions on all 3 counts. Bev totally messed this up by not asking if they were hung on all 3 or just some of them. Travesty is this isn’t given full review. Hopefully Bev will set oral argument on the motion and more jurors will come out before the hearing.

    My grandfather was a bailiff for 20 years for his retirement career in another state. Now he was in a place that’s been known for corruption and had some bad things happen. One thing I know is bailiffs answer a lot of questions. My guess is a bailiff knew they’d reached a verdict on two of the charges and were deadlocked on the other and told the judge and possibly Lally. My grandfather was the best man I ever knew. He was honest to a fault. But I found a lot of what he said happened in court happened/happens in most courts across the country. Someone knew. Hopefully there will be someone who works in courthouse who isn’t beholden to Bev or Morrissey who will come forward.
    The smart thing would be for Morrissey to just dismiss the whole thing. But I don’t think he has the decency to do that.
    The real problem with this case is the DA’s office has made this more about convicting Karen Read than true justice for John O’Keefe. They are making it too obvious there’s bias. Lally repeated what was in Jen McCabe’s burn book in his closing.

      I agree! Paul Okeefe solidified this in his interview. I forget if he said they invited them or if they asked if the Okeefes minded. Either way it was intentional. The jury even came out later and said they felt intimidating. In the motion to dismiss the juror said Brian Higgins intimidating them. They meant Brian Albert.

      I think (well, one of the problems) is poor system design, - bear with me! Everyone should be working hard to design a system where the self interests of the police, the defence attorneys, the prosecutors and the judge etc. are best served when the innocent are found innocent and the guilty are found guilty. Unfortunately, for example, some prosecutors will advance their careers by winning cases where people they know to be innocent are found guilty. There are many people of integrity but they are struggling within "the system".

    Judge in Alex Baldwin case threw out charges with prejudice. Due to evidentuary issues. Great judge. btw I am not a baldwkn fan. i also believe he was negligent.
