The Best teaching on theory of failure
At 37:30 The safety condition and failure condition have small error. it will be a safe load in less than or equal to yield stress and fail if greater than yield stress.

Your question has the answer. Only 2-D loading
Slip of pen. Only sigma 3 will be zero. Strain will exist in that direction.
