She is not suppose to. She is not a duchess in her own right. She is Duchess of Sussex or Meghan Windsor-Mountbatten or Princess Harry. She only becomes Meghan, Duchess of Sussex when Harry divorces her
They are allowed to use their Duke and Duchess of Sussex titles and he will always be a Prince, as it’s his birthright. They have agreed not to use their HRH (his and her Royal Highness) titles however they haven’t (yet) been taken off them.
