This episode is loosely based on a real life case, Witt v United States (NO.10-885) 2003.
Airman SSGT. Dean P. Witt was admitted to David Grant Medical Center for a routine appendectomy while he was on approved furlough to finalize his transfer from Hill Air Force Base, Utah to Travis Air Force Base, California. Prior to post-op, and shortly following surgery, a military nurse anesthetist re-inserted an endotracheal tube into his esophagus instead of his trachea (windpipe), forcing life saving oxygen to be pumped into his stomach, instead of his lungs, and then utilized pediatric medical device to try and save him, resulting in an anoxic brain injury to include, 100% vegetative state. Witt died 3 months later on January 09, 2004.
Witt's wife filed a wrongful death claim in August 2008 under Federal Tort Claims Act in California's Eastern (9th) Circuit District, which was denied reluctantly by District Judge, John Mendez in February 2009. Judge John Mendez urged the Supreme Court to revisit the Feres Doctrine because the Feres Doctrine was “unfair” and “irrational.”

As of May 2019, the Feres Doctrine is still alive and well, having yet another decision by the SCotUS to not hear a case of military medical malpractice (only two Justices, Thomas and Ginsburg, voted to hear the case). The SCotUS in effect is deferring this matter to Congress to correct by enacting new legislation. Currently, the SFC Richard Stayskal Military Medical Accountability Act of 2019 (H.R.2422 and S.2451) has been referred to both Congressional Judiciary committees for further hearings and action. Both bills have bipartisan sponsorship and support, however, they are unlikely to ever pass.
As a veteran, these bills have about as much chance of passing as Congress voting to not give itself a raise.

I’m currently rewatching this series and Blacklist.
It’s been long enough to have forgotten even the basic thrust of the episodes, much less these wonderful commentaries on the sad state of the American political and social system.
And current TV seems to be following the political and sociAl trends of things in the spiraling water of a toilet bowl.

I'm a retired US Army disabled veteran.
My left arm was torn off at the shoulder. 2 Army surgeons and a whole emergency team operated and reattached my arm. I spent 3 months recovering overseas. I had great doctors, nurses & therapist.
9 months later, I was given a 60% disability rating and retired.
I was 19 years old. I was lucky.
There were 1000s that were not.
My troubles really started soon after that.

2:30 hits hard. Most MOS/NECs go off of civilian certification standards and schooling but unless it’s advanced the military won’t pay for it. For example medics go through the National EMT course but only the Air Force has it mandatory in their training to get on the civilian registry.

I remember when this was on television, I heard commercials for it on the Radio pretty much every day, and the sheer excessive marketing of it made me want to watch it less because it felt desperate. Years later, a friend of mine was talking it up and showed me two episodes, and I realized just how good it was. I binged it back before binging was a thing. And now, from time to time I find myself thinking of it still and going down a Boston Legal CZcams rabbit hole being reminded of just how amazing this show was. I wish we had something like it now.
