    Rich wanted to put his kid on the golf cart because he didn't have any health insurance, and he didn't want to get billed for the ambulance ride. The way I see it is if you're participating in a sport as dangerous as motocross the FIRST thing you do is make sure you have proper health insurance, but Rich is a cheap prick. That's why he sued LACR - because he's a bottom-feeding oportunist who doesn't care about anyone but himself. You better believe his kid didn't see a dime of that money because Rich likely swindled his own son. If that doesn't scream "scumbag," then nothing does.

      Bruh...when i was starting a business and had to go without health insurance, i stopped riding for 6 months. Can't imagine putting my kids uninsured on an MX track.

      Not sure if you know the lengths parents will go to help their kids achieve their goals. Who knows, maybe it was either gas to get to the track that day, or a health insurance payment, and giving his kid a shot at lorettas was the decision that was made. Neither of us are in the room where these conversations were held, or at Rich's dinner table. Let's keep the assumptions to a minimum.

      @jeremylaird5141 I struggle to think of any racer that has insurance on their bikes. Maybe they fall under some blanket policy against theft or something. But guys buy their bikes knowing that they'll get wadded up at some point and it'd be dumb to claim a crash on insurance

    If Rusty did not like Matt then he should not have taken the bike on consignment. After you take responsibility for the bike then how you handle a situation is about your character not about how much you like the other person. Making it about the other person is just the scapegoat for your poor character. If Rusty is a good guy then he will do right by those he conducts business with if not then he is just in it for what is best for him. Which means all those he has helped in the past and future is still about himself not them.

    The fine print of both the consignment contract (if there was one) and the shop’s insurance contract would have to be reviewed which lead to the situation for the stolen bike. It was in the care,custody and control of the shop and the owner may not have had much say in how the coverage was interpreted. It would be nice to have all that info and maybe that’s why he offered him some money anyway….🤷🏼‍♀️

Total BS on the dealerships part, I would sue them. Contracts are mostly worthless in today's age. I am not saying its easy to run a dealership either, but c'mon man that is BS they should at least give the kid a reasonable amount for his bike. Contract or not, its the RIGHT thing to do!

      @@kurtheidelbach The way you see and the way I see are completely different. It's not my ignorance, its anyone with any DECENCY that runs a business would do the right thing. So what you are saying is I drop my motorcycle off at this dealer (I assume their policy is the same for service) and they assume ZERO responsibility and my bike got damaged/stolen these people don't have to pay for my bike? Complete garbage. I don't have to know the details of some BS lines buried way in the contract that nobody would read in full (which is a scumbag move to begin with to even have that in the contract), I would NEVER buy from this dealership and I am sure they won't be getting anymore bikes on consignment either (as they shouldn't)!!! Consignment is only a sales agreement, meaning the consignee agree's to pay the dealer a certain percentage of the sales price. It should IN NO WAY take the responsibility of keeping the product in good condition AND preventing it from disappearing. Everyone knows dirt bike don't have insurance. You can say what you want to protect your buddy, but its a scumbag move. Packs of a feather flock together.
      They only got lucky that this kid probably can't afford a lawyer, otherwise they would be getting sued and they would lose. Post a copy of this contract, maybe I will pay this kids legal fees to prove a point!!!

    This is the 1st I’ve ever heard of any offers of $2000 😂😂 worked for the guy for a year and made him hundreds of thousands of dollars and he’s mad that I wouldn’t stick around and keep doing it while getting paid & treated like shit 😂 I guess you’ll have that! Integrity is getting harder to come by 🤦‍♂️ I do know he helped me when I was growing up racing and although I think he exaggerates what he’s done for me I do truly appreciate anything and everything he and all my other supporters have ever done for me!

      seems like everybody that helped the boys i coached always ended up kind of dikin’ them. it’s like they can’t just be str8 up. we appreciated what they did do but decided to pull the bikes at loretta lyn times. it must be a “thing” in motocross? ha

    The consignment thing sounds bad but it is a legal issue. If matt had a contract he needs to review it. If there is a clause in there that he needed to have his own insurance and didn't supply that than it is not the fault of the triangle dealership. People say it is the right thing for the dealership to pay Matt but it was also the right thing for Matt to have insurance and you cannot put that on the dealership. Now if there was a contract that mentioned that mentions nothing about personal insurance or there was no contract than Rusty needs to do the right thing and pay him for the bike.
    I had my truck broken into at a dealership while it was there to get service done and they didn't compensate me at all because the paperwork I signed said they were not liable while my truck was on their lot. Sucks but I signed it and I owe it. It is what it is and these two (now three with Cooksey) men need to do the research and fess up to what is not just right but what is owed period. Time to put the big boy pants on.

    I was at englishtown (you can find the video on CZcams under wisky throttle englishtown mx) this was yyyyears ago , but this dude luanched off a burn was literally 20 ft in the air , flew threw the trees and landed on the 85cc track . Dude went away in the ambulance for sure! I was on the track when it happened they shut the tracks down till the guy was taken out of there , he was severely injured, he didnt sue nobody thats what a waver is for . But yeah that was a gnarly one i watched it happen .

    I had never heard of this guy Rusty until a month ago when he took a loss from a break-in, so I have nothing for or against him.
    35 years ago, I sold a truck on consignment at a truck dealership. We had a simple contract that was agreed and signed by both parties.
    As I recall, it was stated that they were not responsible for the trucks wellbeing while parked on their property and it was my responsibility.
    The truck was parked outside in the lot with all the other trucks at the dealership.
    I had insurance on the Truck, and in the end, there was no problem with the selling of the truck, but I was responsible for it. They were just selling it.
    So, if this bike was valuable to Matt, he should have had insurance on it that would have covered it. Apparently not. Should he demand that Rusty
    automatically insure it for him since he didn't want to himself. Rusty probably didn't have it covered either, so he is just not wanting to pay for it out of his pocket. I doubt Rusty is going to pocket $5000 in insurance money from this situation.

      Do you even know what kind of bike this is? Its a off road motocross bike ! And assinite thing to say he didnt care about his bike. If i dropped my dirtbike off at a dealership to get worked on nobody that i know has ever thought i better get insurance or i might get screwed over! My bike is in shops care at that time and same goes for consignments. If it was me i would involve a lawyer and find out truth on that dealership ins. Policy. Who do you think is responsible for damage /theft when somebody drops a car off at dealer with liability and not full coverage on vehicle, for service ? Hint.. not owner, and doesnt mean not give a damn about the car! Responsibility is on the dealer! Plain and simple .... unless signed otherwise.

      This was true in a local repair shop in the Austin area. All the cars had their catalytic converters stolen while behind the locked fence. However, their insurance stated that it was the owners responsibility as the dealership had provided a locked gate. Not sure if the same rules are applying here but as crappy as it sounds, that was the long and short of it. They provided some protection beyond that, the owner is responsible for the loss. Interesting to find out if they actually had a contract and terms of said contract

    Pre-lit fees are 33% but if it goes to litigation it’s 40% plus costs for things like expert witnesses. If they settled then fees were likely limited to 33%, which is still a lot but to say that only the lawyers got paid is laughable.

    It is a terrible thing to crash while riding..BUT..this sport is dangerous if you aren't in control.... once you decide to Go Race ..or Ride at a Track to practice....YOU accept responsibility for how You Ride out there.... and I can see someone New to the Sport going out..crashing ( like we all did ) and Suing because they feel it was " Dangerous " to ride there....uhhh..you slow down..ride within your level of expertise.... or pack up and Go Home.... suing the Track is not Cool...One day there are NO TRACKS...NO LAND YOU ARE ALLOWED TO RIDE ON...and that is because someone Sued the Tracks....Insurance becomes Expensive or Unavailable to get....No one Wins in this.... Lawyers win of course... as usual... but someone who has a Family history in the Sport..a Business in the Sport... and wants his kids to ride and race??? Sues a Track for his Kid's mistake??? That is Bad..if this is all True....
    They might shut that track down..over this...still could be close to stopping using that track....then what??
    Letting people know the facts as you find them helps others hear about it...and nothing is wrong with Facts and Truth coming out...

      Yep. 100%. I have left and just bit rode a few tracks just because for either the track. Or my skill level. Or both just gave me that “not gonna be good” feeling. I spent year recovering in 2010 over a combination of both of those factors. It’s just not worth it. Stay healthy to ride another day. But aside from a facility running out and smacking me off my bike with a batt. I am responsible for my actions

    Doesn’t matter on the facts of if you should or shouldn’t sue. But 1. That’s what insurance is for. 2 . The attorney probably did get 40% plus it sounds like there was a ton on Dr bills.
    As for burkeens bike. If I’m a shop and someone says “hey can I set my bike at your shop forsale”. Why the hell would I assume and responsibility or risks? If triangle insurance would cover the bike then why wouldn’t they help Matt out ? I don’t see how the shop has a liability for doing a favor for Matt. Did Matt have signed consignment paperwork ?

      Consignment is a business transaction - they take a percentage of the sale price in return for selling it off their floor. Therefore it’s part of their stock, and they’re liable.

      Yes. Like stated. Consignment means you get paid. And most importantly the buyer will be paying the taxes and fees. Those fees are what pays your shop insurance. Your shop insurance is there to pay for stuff people steal.

    Rusty has always been a dirtbag. At Loretta’s in 2017 I was there wrenching for Stroupy, and he got butthurt that I knew more about the bike and the details than his dealership flunkies posing as Race Mechanics. He didnt help Austin at all, and then he ran to the podium when Austin won by a 00:17 margin. I covered up the Triangle logo with a towel and used my drinking water to clean off the WW Motocross logo (as Junior was our biggest supporter) Rusty is a bum

      @@CookseyMedia I can agree with some of your points but many other factors come into play and posting pretty much just rumor and 2nd party information just lowers your credibility and comes off as just click bait. You have a platform that deserves a thorough investigation of a subject before speculating.

      @@georgelynch6139 One of the most important things I do to is protect my sources, and sometimes I have to distort, or change irrelevant facts to protect them. The only facts I wanted to get out were 99% accurate. People know I will always protect them, that’s how I get the information I do. I might get sued, but I don’t care, I don’t have much, but I am confident I will win any of these suits, because I can prove my important information. Don’t think for one second I wouldn’t counter sue, and my lawyer friend has been waiting to pounce… I hope it never comes to that!

    Rusty....OMG come on. No business takes a bike on consignment, loses the bike, then tells the owner "Sorry about your luck." That's ridiculous. Matt needs to be made whole and Rusty can eat it or file it with insurance. Personal insurance on the bike when it is at a shop? So if I take my bike to a shop to get worked on I have to put "personal insurance" on it IN CASE it is stolen while it is there? Right....... Pay Matt his money, which we all know Rusty has

    Wait. Rusty really doesn’t like Matt, but agrees to take his bike on consignment then says tough luck when it’s stolen. Could the theft have been an inside job? This is a newer race bike with good parts, not a clapped out 01 YZ250. Rusty screws Matt and gets a race bike for free or $2000, if that’s what he really did offer him.
    You just know this guy has probably burned as many people he’s helped by the way he just straight came in hot to Cooksey. The people around him know. His employees and family are used to getting yelled at by him for his own mistakes. Guys like him done take responsibility for anything bad he’s done. They always blame others and use what ever power they have over someone.

    Not the dealers fault, owner should have had insurance.

      This is a garbage take. Imagine you give your bike to a dealer on the arm, but he calls you a week later and says, "Hey, we were broken into, and your bike was stolen. Sorry for that. Have a nice day!" How would you feel?

      Consignment! They wasn’t doing the guy a favor. It was a business transaction. When the bike sells the buyers pays tax and shop fees. Shop fees pays for insurance. It’s a business transaction. When we do consignments at our store the paper work basically states that we “temporarily” own the motorcycle and it’s covered protected and treated just like it’s our bike. That’s pretty much how all shops work. Least legit shops. It’s different than asking you buddy if you can stick your bike out in front of his flea market booth.

      so a week ago, it gets stolen from your house even before you drop it off, who paying for it then? he had no insurance. if you can not afford the loss of your bike, you better put insurance on it. if you don't it is your own fault.
      Family had a Handa, can am, seadoo , skidoo dealership, we had a fire, mostly in the showroom, just smoke and heat in the shop. it was early in the spring, so a guy had his Goldwing in getting work. the smoke coloured it and the heat melted the windshield. he would only put insurance on it in the summer when he rides it. then in the winter it sits in his shed. who going to take it with 2 feet of snow on the ground. he thought he was covered cause it was in the shop, But it happened on a weekend so no mechanic was working on it. if they were welding the crack in the frame up, and it caught on fire, he would be covered.
      Oh and FEELINGS don't matter,
