Our entire framework depends on convictions. The language that is attempting to bar Trump doesn’t use the term, but it’s implied throughout our legal system.

Before the peanut gallery starts, I’m not a Trump supporter. I’m a constitutionalist and I haven’t seen a president in my lifetime who hasn’t somehow violated the constitution. I support a reset of our congressional and executive branches. Do you feel like your tax dollars are going to good use? Have you ever? Exactly. Trump should be qualified in every state people have the right to vote for their Candidate which they would want for president. Donald Trump is not an insurrectionist Donald Trump has not even been charged as an insurrectionist The 2020 election was stolen.
No justice Kagan your job is to rule if trump committed an insurrection and should be removed from the ballot. You are not to be ruling if a state can keep a person off the ballot. In other words is the decision of Colorado's court an accurate interpretation of the constitution. That is your job and you are avoiding it. The supreme court is afraid to make the right decision.

I would be very surprised if the supreme Court as a whole would do the right thing judicially speaking and agree with Colorado supreme Court in bar Trump from being on their ballot.
Trump has been accused of insurrection, but it has not been proven and he has not been found guilty in a fair trial in a court of law. You have completely forgotten that in this country a person accused of a crime is presumed innocent until proven guilty in a fair trial in a court of law. So, if I accuse you of a crime, is it right for you to suffer penalties or consequences for that crime before you have been proven guilty? And what if you are innocent?
Wouldn't it be crazy to see a man removed from the ballot for a crime that he did not commit, and that not a single person has even been charged of?

Chief Justice Marshall said the President is an officer of the United States, the presidents themselves call themselves the Chief Executive Officer. Donald Trump himself has said himself the record is good enough to progress to the Supreme Court. Once after the Civil War and the 14th Amendment was applied, thousands understood they were no longer qualified for office. No one thought you needed a conviction for removal of office post-civil war. --Mario

Question, if states can't be trusted or allowed to apply this candidate disqualification, then why did they include a way for Congress to override the states. No need to override states, if states can't exclude a presidential candidate from their ballot.

If the candidate is allowed to be elected but is not confirmed by a 2/3 margin, who becomes president at that time and how is a viable candidate confirmed? Is there to be another election? Who presides during that election? OR is the candidate that receives the second highest electoral votes? The constitution dictates that the candidate receiving the majority of electoral votes. This seems to violate that principal.
Allowing a candidate to run for office that is NOT qualified to hold office creates a constitutional crisis!

It also says that no state can interfere in a person or right to vote for whom they pick. That if the state does the seats in Congress and senate shall be removed. I read it and clearly see it on paper. There is no well if this or that. It says what it says.
And the last sentence of amendment 14 section 3 says that by 2/3 vote in both house of congress the congress can remove the disability. Why is no one mentioning that last sentence?

1:14:05 and 1:24:28 - This is the crux of the whole thing for me. If Trump can be barred from running without a federal determination that he participated in insurrection, any federal candidate in any state could be barred by deeming him/her as an insurrectionist. Therefore, the state parties in power will use this against their political enemies with expanding definitions of insurrection. True, it won't happen all the time, but it could be used in opportune times, such as these.
Makes sense... that's why biden and mayorkas are being impeached, paybacks (as they threatened during trumps impeachment) to the detriment of our nation.
But a state court did find he engaged in insurrection so at least that would likely be the precedent. Not to say there aren't political judges who could just do the same but usually it can be appealed to a higher court at least.

So if the 4 amendment is being used why is no one using the whole thing? The whole amendment says more. It says a vote of 2/3 of senate and congress can override the amendment.
It also states in amendment four that any state who interferes with a person right to vote in an election for the candidate of their choice shall then have their seats in the house and congress reduced.
It also says a male of the age of 21 and citizens shall be allowed to vote.
So we have more than one issue right now in my eyes. Let us enforce all the amendment 14 of the constitution. I believe we have some seats in congress to reduce for some states that remove the names of Biden and Trump from the pre election voters.
1:06:27 - The difference I see in this list is that insurrection is difficult to determine versus the other 3. Under age, foreign-born and 3rd-terms are easier to determine than insurrection. Just think of a regular trial used to determine if someone was foreign-born vs being part of an insurrection.
His actions leading up to, the planning, his words the day of the insurrection, his actions trying to redirect the car to the capital, his statements to take down the metal detectors and saying they didn't come to hurt him, his refusal to call off the insurrection or make any move to calm the crowd or end the insurrection. ..............
