  • Supreme Court On Muslim Women | Secular Law Prevails 'Uniformity' In Laws: The Right Stand?
    The Supreme Court on Wednesday ruled that a divorced Muslim woman can file a claim for maintenance under Section 125 of the Criminal Procedure Code (CrPC) against her former husband [Mohd Abdul Samad vs State of Telangana and Another].
    A bench of Justices BV Nagarathna and Justice Augustine George Masih pronounced separate but concurring judgments upholding Muslim woman's right after a Muslim man (petitioner) challenged a Telangana High Court direction to pay ₹10,000 interim maintenance to his former wife.

    This judgement clarified that divorced muslim women can still ask for alimony under crpc sec if she is not satisfied with the shahbano act (mehr from personal law). This clarity of recourse is missing.

    But muslim women often re-marry quickly . Should Alimony payments continue even after re-marriage ? In US , alimony is discontinued if she remarries

      There is no question of secular law and Shariat Law in Indian system.As a divorced (Muslim) women she is entitled for in maintenance .That right is reinforced here. A well meant humanitarian effort.
