    Sir, you have not mentioned whether joint owners by default becomes owner of the property when one of the joint member is deceased.

      I think: No !..... death.... require.... will or succession certificate ..... even if the joint owner was parent or sibling or spouse.....

    Ours is a Society of Plots.Two brothers are nominees of a deceased member and the name of the first is mentioned in form 14 para 5 as the one to whom the property is to be transferred on death. They occupy different floors.
    The two nominees have enemity between them and no common Indemnity Bond possible from them. The first nominee insists that the property be transferred in his name alone and the second nominee should not become joint member ie the second nominee's name should be excluded.
    Can society do so on the basis of Indemnity Bond? Doing so will certainly lead to litigation for the society. Normally the first nominee becomes member and other nominees become joint members.

    अगर फ्लैट पर होम लोन चालू है। और वह फ्लैट और होम लोन मां और बेटे के नाम पर है। और मां फर्स्ट ओनर है। और मां का देहांत हो गया है। इस केस में नॉमिनी फॉर्म पहले भरा होगा तो लोन क्लोज करते वक्त बैंक ओरिजनल डॉक्यूमेंट वापस देगा क्या?
    और अगर नॉमिनी फॉर्म नही भरा था तो होम लोन क्लोज करते समय बैंक ओरिजनल डॉक्यूमेंट कैसे वापस देगा? उसकी क्या प्रक्रिया है?
    कृपया दोनों केस के बारे में मार्गदर्शन कीजिए।

    I have given in nomination flat details + parking +servant's room. Society is confused and not giving acknowledgement because of parking and servant's room. Any opinion.

    Deceased flat owner not declared nomination. Wife and two sons given no objection for transfer. Then 1st daughter-in-law claiming as nominee. Kindly guide me.

    Respected sir, l am the legal heir son . My deseased father nominated flat to three of us. My mother myself & elder brother. Then we two brothers filled form no.18 & my mother became member. Now my deseased mother nominated flat to we two brothers. Society is asking us to give succession certificate from us despite nomination is of we two brothers. We have filled new form no.18 already. Since two months society is not ready to transfer the flat to us & asking us to give succession certificate.Please guide us.

    The Chairman, Terry D'Souza and the Secretary, Denis Nazereth, of Everard Towers CHSL. Sion. Mumbai, 'Refused' to accept a Nomination Form from me, claiming I am 'Only a Nominee Member'; there is No such Status, Only Nember, Associate Member and Joint Member.

    Nobody will give so many documents if you asked because committee members are doing work a thankless job.
    In my opinion accepted copy nomination given by society & duly signed by committee is sufficient

      Thats Registrars problem.... not society.... society needs registered document with clear title ..... Society deals only in change of membership.... not ownership.... ownership changes at Registrar (property registration)

    About Nominations now I have been elightened
    But in one of the societies, father and mother were accused of financial fraud, the flat was sealed by police. Share Certificate is with the Bank
    Both parents died a long back. Son leaves in the USA, occationally comes India, pays all pending maintenance and insists the Society to accept his nomination
    What would be your opinion for the Society?

      I think: Nominee is not the owner.... he is care taker of porperty....will or succession letter will suppress the nomination....

    Till today's no mantion GR.
    NO MANTION NOMINATION FORM SIBMITION.
    70 %LOAN BORROWERS BUT NOT MENTION IN ANY REGISTER, FILLING. .
    KUCHH LOG MAINTANANCE BHARTE NAHI AND SLSO FALSE ANCORAGED/SUPORT TO COMMITY AND NOT A SINGLE PERSON KNOWING ABOUT SOCIETY'S LAWS.

    Sirji,nsmaskar hi,
    In gujarat builders registered wel farrow Association inspired of tesidencial houssing society.
    Takriban society starting se ABHITAK 7/8 years passed.
    Some SOCIETY'S flate owners are not paid maintenance. 120 members are there.
    1st commity take hand over charge from builders,that commity was elected,but they are putting tegicnation before pne year for the mis mansgements .
    3nd commity wel maintained with every things done by them with regularly INCOME TAX FILLINGS,AYthat time some of two s.s are illness and family problems leave the society's volitntearly works, mean while sectatory also regine,
    Now chairman can works for two main posts,call meetings for appoint secratory for two time,but anybody came.
    4rd times call mitting and he was absent due to some family relatives serious.
    During that time without any prior any agendas to appointment for new commity, some un knowledgeable person make a new commity without INFORMED all the society members and also passed some false regulation
    Like incriment maintanance about 65 to 70 %.for uphradtion in society in horrible CORONA 'S period3
    And one more secrate contractAMC was passed without all the SOCIETY'S permition.which was very high cost,without tendering.. Even not informing two mitting held by this commity. One more newtons doing by that commity also appointed pne employe eiout any application/intetvirw which salry was very hike.Rs..2,50.000_- aprox.
    As per society's rule above Rs..50.000/"-will be pass by GBM.BUT YHEY CANT FOLLOW THE SAME.
    SOME MEMBERS KNOWING LAWS SBOUT SOCIETY,
    OONHONE AAWAZ OOTHAEE, APPROXIMATELY 60 MEMBERS KI OPPOSED KARNEKE LIYE ABHIYAN CHALAYA
    NOW, SOME MEMBERS ARE ONFORMED TO THAT COMMITY ABOUT :VIRODH ABHIYAN"
    AND COMMITY DRCLAIRE THAT WE ARE PUTTING OUR REGICNATION ,FOR THAT THEY ARE CALL ANOTHER GBM ON SERIOUS CORONA PERIOD,
    THEY PEOPLE ARE TAKEN SOME RENTED PEOPLE SOGNATURES AGAINST THE GBM..E-MAIL TO SOME MEMBERS, ON SORT THEY WANT SHOWS THAT THEY ARE DOING PROPER PROCEDURES.
    Now QUESTION is what actions will do ?
    Some officers are suporting to this commity and they're in EGO.
    HUMARI KOI DUSHMNAVAT KA IRADA NAHI HE .
    PL.GUIDE US TO SOLVE WHICH WAY ?

    Only son is the nominee, so as you say he becomes a member not owner after the parents death unless there is a will. In that he cannot sell the flat cause his wife and children and children are legal heirs to be. So the son in his life time is not the owner. There is a slip between the cup n the lip in your explanation. Other, an associate member name does not come in the share certificate in the 2019 amendment.

      after the death ... intestate.... succession certificate is needed.... and them accordingly the membership can be looked into... society or even registrar of housing society has no power to change ownership..... that is done by court or through property registrar.....
