    He needed a "Certificate of Necessity and Convenience." Basically he needed to prove his business was NEEDED and wouldn't hurt existing businesses. And the existing businesses had a virtual veto over new competition.

I feel like we aren't even the same species with these people.       Imagine a cyberpunk dystopia but instead of the Megacorps controlling government, the Government is the big bad, and controls the Megacorps. that's exactly what we have now, only less cool cyberware.

      Most state liquor licensing boards are populated with bar, package liquor, and nightclub owners. They decide whether or not to issue permits with this same sort of logic.

    If there’s only 5 moving companies in town and they know there won’t be another competitor they’ll team up to raise their prices and lower their quality of service. This is bad law.

      makes me think of the king of the hill episode where they basically team up and make a "propane mafia" where they do what this law wants, screwing over the customers and such and they find a way to compete once it is broken apart.

      Exactly, and a consumer who wants to shopping around for a better rate won't have much of a choice. And there in a position to say "well you can't go anywhere else, because we're all the same price".... Business owners in similar Industries all KNOW each other. They hangout, and get drinks all the time. And they get together to lobby politicians to create BS laws like this.

      People with that attitude need the government to tip the scales in their favor because they can't compete on any level. They don't know how the real world works. People absolutely pay more for good service, especially things like moving. You don't want to have to pay a lawyer to deal with the movers that destroyed all your stuff. In the end it saves money to go with the reputable company.

    I looked it up and they won their lawsuit in 2014; federal judge overruled the state’s law. Great job guys!

      @@iamnotamused317 sorry brother, but you should have said “defendants” instead of “plaintiffs”. Plaintiff is the one who brings a case against another in a court of law. In this case, Bruner is the one who challenged the law, hence he was the plaintiff.

      They complained against him (as plaintiffs) and he filed against the state (as a plaintiff).

      @@iamnotamused317 at the 00:54 mark, they received a letter that was threatening them to stop or pay a fine. This is not the same as a lawsuit. Bruner in turn sued the state and then a bunch of counter-lawsuits and injunctions happened. But kudos to the law firm for not charging for their services; most businesses can’t afford the costs for a good attorney.

      I work in a market where there are actual moving companies that compete infairly. By unfairly I mean they have prices so low that it is impossible for them to pay a decent wage and have a profit.
      They are most likely cheating on their taxes.
      Many of these companies have a high score on rating sites despite this. Movers who has experience from these companies always think our company is the best they ever worked for.
      It is possible for substandard companies to operate in a market, be successful, have good ratings and be profitable.
      I dont really know what the solution would be though.

    Had to do this in Texas about 40 years ago when we wanted to haul plastic feed stock outside the Houston commercial zone. Went before a Texas Railroad Commission hearing, it was more informal than we expected, to had one carrier protest against us because they thought we wanted to haul animal feedstock. My wife explained the difference between plastic and food, the objection was withdrawn. We received our certificate.

      If you ever get a chance to read “the wealth of Nations” by Adam Smith, written in 1776, nearly 250 years ago, he tells exactly this is what businesses try to do all the time, to gain favor with the government so that they can restrict competitive businesses. This is an age old problem, and sadly it exist in some industries in America.

    I'm a lawyer. I paid a lot for school, and to study for and pass the bar exam (3 of them), and to take the test, and for continuing education courses every year, and other stuff.
    In the United States of America--in a FREE country--some dude should be able to wake up on a Tuesday morning and say "OK, today I'm a lawyer." And hang a shingle and start taking on clients. He shouldn't be able to say he went to law school (if he didn't), or that he passed the bar exam (if he didn't), or that he has years of experience (if he doesn't). But it's his right to decide to be a lawyer.

    The old moving companies are the shady companies. Try to get them to move your stuff and get it there by the time allotted in the contract. You will quickly find out the law is on their side and they only have to do what they want.

      I was telling my niece about how if you were to cut someone's hair for money it would be against the law if you didn't get permission from the government. In order to get permission from the government you would need to go to school, spend lots of money. I told her that businesses that can afford this are happy that they can make the government do this because it stops smaller businesses from competing. Then her brother popped his head up and said, it doesn't really sound like a free country.

    I have used Wildcat Moving 5 times over the last few years for various moves. They are prompt, efficient, and very professional. That is the reason why the others were against the company. They knew he was providing what the didn't (or didn't want to).

      This kind of "law" has long existed in the U.S. (and every other nation). A very glaring and obvious example are the laws protecting existing, big-business ISP's. In my opinion, it is this kind of inequity, and the fact that these criminals aren't pursued by any law-enforcing agency and prosecuted, that causes the majority of Americans to feel as though they are competing in an unfair system (which we are), and the wealthy are given a distinct advantage far beyond the fact that they have more money. The strife and conflict in the U.S. starts with the knowledge that we ARE oppressed, and, in my opinion, is largely responsible for all kinds of lower-level crime justified in the minds of perpetrators because they believe it's the only way they have of getting what they want. So, for example, in their minds, it's okay to sell illegal drugs on the street, and enforce their position in the market with extreme measures (including killing your competition), because that is, after all, the way our society really works, and it's easier to sell drugs than try to get ahead by working a job for someone else in a system that is inherently unfair.

    John, I hired an interstate moving company who quoted one price based upon square footage. when they got to the house, suddenly it was 1000 sq ft more ($4000). they charged extra for boxing and materials. I received a box with 6 unopened 6 packs of strapping tape. Maybe an expose on the scalawags of the moving industry. Very common according to my admittedly limited research. They would not open the doors of the truck until I paid balance in cash in full, presumably because I would see that the truck wasn't full. I can prove that based upon the size of the truck, it did not contain the increased amount, but too late.

During the entire time I lived there (3 years) I didn't see one new business start up except a car wash - which happened to be owned by the brother-in-law of the mayor.     Kids can’t even operate a lemonade stand now without a license. I started my gum empire in middle school buying in bulk and selling to the other students and I think someone ratted me out and had a school box full of gum. I was sent to the vice principals office and he gave me a Saturday detention. The reason why he told me was it was taking away from the cafeteria revenue. My parents never disciplined me for it which they did often when I was wrong.

      When I was younger, I used to buy a pack of bulk gummy bears, then I’d repackage them and put 15 gummy bears into a zip block baggy and sell it for $2.00 I’d make at least $100 in profit a week, eventually the school found out and tried to get me to give my money back to my classmates, I lied and said “I already spent it” so I got off with a suspension and was told if I did it again I’d get expelled.

    This outrageous practice was standard in the health care field. The permission was given or not given by the Department of Health. I live in Pennsylvania and wanted to start a surgical center to lower costs and improve access and quality for cataract and other ophthalmic surgeries. Basically, the local hospital made patients wait up to 3 month to get scheduled for elective surgery. The hospital also refused to buy equipment to perform the standard of care, and charged 40% higher than neighboring hospitals". The process went through the "Department of Needs Assessment" at the Pa Dept of Health in Harrisburg, and to top it off, this department was only open for business 3 daiys monthly which meant that each step of the process - requesting an application, being submitting the required financial information and documents on patient costs and quality - each process took about a month to accomplish. After that it was required that my intent to open a center be published in the public notice section of the newspaper for an additional 3 months and then the hospital was able to arm themselves with attorneys and fight me at the Department of Health hearings. The Dept. of Health allowed for testimony, then response and then reply (I believe there were 2 responses and replies separated by about 6 wks.
    The whole process took over a year, and it by no means was a sure thing (politics plays a significant role). Thankfully, I got my center.

      Well, that's a different animal. Places were charging Taxis, so, the train station charged the taxis, the park charged the taxis, the air ports charged the taxis', etc. As a result, there was a breakdown, when uber, was showing up at the train station, something some of the drivers paid hundreds of dollars to do. How do you fix that? Weird. The taxi drivers had criminals background checks, etc. granted, lots was ignored. But, they were all shaking down the taxi companies.

      We had a real economy.

    Sometimes being the only competitors in the market makes it tougher to find ways to improve and lesser vendors to partner with in future. Also, keeping it to a small handful limits the options available to consumers because their needs are ever-changing and vary in preferences and necessity.
