  • In Central Hall, Kapil Sibal is in conversation with P Chidambaram, his colleague in the Rajya Sabha. Both, eminent lawyers discuss the misuse of the law by the Modi government on election eve, especially to kill any opposiiton, drive fear into opponents and break the governance in states by first going after officers and then family members of top politicians. They say this is hurting the backbone of India's democracy, its federalism. P Chidambaram asks what will happen if State police start arresting Union ministers in the same vein.

I think Kapil Sibbal was hesitant in asking questions and Chidambaram was equally hesitant in answering. Chidambaram may be feeling that he too may be responsible in creating the monster - ED that has been let loose on the opposition parties. Not only the opposition leaders, judges, top lawyers, bureaucrats, businessmen and many others supporting the opposition are targets. Others are completely safe.

This is an important interaction between two legal luminaries of the country. It is beyond one's comrehension why suddenly the investigating agencies are so active in opposition ruled states. There is a general feeling among many people that why the ED is targeting only the opposition leaders? Does it mean the ruling party and its supporters are all holy cows? It was reported that before the assembly elections, ED officers were active in Raipur. Even the ED issued some statement imputing motive to the then CM Chattisgarh and once the elections are over, nothing is known about that. The developments are very perplexing. Even CM Jharkhand was arrested on some alleged offence dating back years. Now AAP is under the radar of the ED. Merely based on hearsay charges and confessions of the so-called approvers, can political leaders be arrested and jailed without bail? Does such action not influence the course of impending elections? If a person's reputation is irreversibly damaged, what is the remedy he has got under the law? Why no such coercive action is taken against those tainted leaders who are now in the ruling dispensation? All this doesn't auger well for democracy.
