By ( rightly) resigning , rather seeing no other option but to resign and go to save the imminent disgraceful defeat in VidhanSabha, Uddhavjee has ACCEPTED the REAITY like true THAKRE. But now ,due to pressures from MVA partners, is cutting a sorry figure by foolishly fighting to get himself reinstated.
The Time Period this case has taken purely Indicates the Leniency by the Apex Court in terms of Political cases of our Nation!!!! So much Apprehension.........
While Dr. Singhvi repeatedly arguing that , as a lawyer of the aggrieved party he is not demanding reinstatement of Udhav Govt but appealing to the court to restore status quo ante as it was before June 21, 2022.
Whereas, the honourable constitution bench judges are telling repeatedly that they would have given a serious thought of reinstatement of Udhav Thakery govt had they faced the trust vote, lost & then resigned but Udhav Thakarey govt resigned on its own volition without facing the floor test.
And as a counter argument Dr. Singbhi is saying that as far as restoration of status quo ante is concerned, it is immaterial whether Udhav Thackery faced the floor test or not.
I personally feel, Dr. Singhvi's counter argument is relevant & valid. In support of my thinking I want to present a similar incident happened recently.
In British premier league match, about a fortnight ago, a crucial match that would decide league topper, between Manchaster City & Aresenal, the a pass from a midfielder of Man city received by their right out forward, dribbled inside the penalty box & about to score a goal.
At that moment one Arsenal defender commits a serious foul that brings down the Man City right forward on the ground & thus Man City loses the opportunity to score a goal.
The match refery instantaneously shows red card to the offender Arsenal defender & also offers a spot kick to Man City.
When the Man City striker was about to take the penalty shot, someone raised doubt that the right out forward while receiving the ball (from his midfielder team mate ) was in off side position.
The match referee checks the fact in video footage, found the right out forward was indeed in off side position & he then & there reverses his decision ( I mean withdraw red card shown to the defender & also spot kick) & offers free kick to Arsenal.
Now, the question arises what would have happened ( what decision the match referee would have taken) If the off side matter had come to the knowledge/notice of the referee after the spot kick & scoring of goal by Man City.
I personally feel that the match referee would have taken same decision as was taken earlier.

I don't understand the football at all but i would give you different example.
I don't know if you are from Maharashtra or not but here for boards exam, if question asked is wrong and provided that you attempted it ( it's enough to just write the question number without writing a single word. It's considered you "attempted") , then after review from the exam board, every student who have attempted the question gets full marks for it. But, if you do not even attempt it, then you get nothing for that question. This analogy fits perfectly here. Even if we assumed that governer's order was wrong, we can not reset the clock as Uddhav Thakare didn't even appear for the exam to attempt the question. So, even if all the questions asked in the exam were wrong, Uddhav Thakare still stands failed but everyone who appeared and attempted the wrong question, would get full marks.

This is very superfluous case -- HUNG assembly should be avoided by design .. How? Why not political party declare their affiliation before election mandatorily ( as per amended LAw ) so that this hopping resort politics will end -- Voters are kept dark in this world's biggest democracy and all NAATAK starts once election is over -- HUNG assembly can be avoided by design -- Eminent people should sit and think -- This does not any way means dilution of democratic principles -- All Articles of Constitutions can be fulfilled .. If some number of party members do not agree with the elected party leadership, they have the following options:
1. Wait till leaders term is over then express your opinion to take the party in your direction in the leadership election process
2or resign from the party and stay in the legislature as an independent

Nobody knows what supreme court want to dig or say. We are following both side arguments . But now sindhe proved majority infront of all members of the assembly. Now also opposition had majority they can bring noconfidence motion any time. Only they are confusing common man.
Maharashtra Government formation has opened up one major possibility -- 51% or more of MLAs who won the election of any party can come together and Suddenly select their Leader and claim to form government - CONSTITUTION will not come in between -- In Maharashtra 3 political parties of totally opposing ideology came together formed MVA government -- Same way 51% or more WINNING MLA of any party can form government -- Anti defection Law can be managed somehow . Ultimately Governmant means MONEY came out clearly in this episode . Voters is blind spectators in current form of Representation of People Act -1951 which has not gone any material change since 1951

this according to the common man is a simple case!, Voter the common man, if is the king in democracy, & exercises his option to choose his own representative through popular vote, as a lawmaker, to represent him, because of which it is said by the elected representative, " voter knows everything & knows whom to trust & chose their representative very intelligently. It must be again the voter, who must have the option to change the status of their elected representative, as The king of democracy, & any change without the voter stamp of authority must be seen as a violation of the trust of the king the voter, in which case the only remedy is "go to the people again" and get his approval! So now there is a need to introduce "RIGHT TO RECALL" for a minimum of 10 years, to again make the common man feel he is the real King of democracy!

Higher courts should discuss on IMPROVING THE SYSTEM and should not discuss case by case - The Floor test case is SR BOMMAI is 1995 case -- which is al most 30 years back -- The system is still like that .. Representation of people ACT - 1951 did not make any significant change to avoid HUNG ASSEMBLY . Hung Assembly is NOT what voters want it comes that way and hence interpreting HUNG ASSEMBLY as voters verdict is NOT right at all -- Example : If 30 % voters voted BJP and they got seats 6 short of majority -- 30 % voters voted for congress and they got 6 short of majority and 6 % votes to go 3rd party they got 12 seats -- VOTERS are not giving verdict on HUNG Assembly and Voters are not asking 2 of the parties come together to form government -- This is very convenient way Law is being interpreted -- AVOID coalition after the election -- Push coalition before election so that Voters know who is with whom before casting votes -- I strongly believe VOTERS rights are compromised in the formation of coalition government - This is NOT what voters want -- This is a big subject need a detailed study on drawing board
