This video is misleading. My cousin was asked to provide consent from the father or custody from a children's court in Nairobi to be able to proceed their visa further.

!! if u are married and ur spouse refuses to go with u...u need to have supporting documents like marriage cert,consent letter from ur hubby indicating he has given u permission to travel alone with the kids...american embassy sio mchezo

In my opinion, I don't think you can because there is no official document to legalises or shows prove of your union as husband and wife.
answer is no play as single with your children and if you win do legal married to travel with your husband
