5-4-2024 - minivan gets stuck in drainage ditch

  • As a result of the owner of the short term rental refusing to accept responsibility for the damage caused to the driveway, and refusing to repair the damage before it starts becoming extensive, their ill-prepared renters have increasing difficulty making the ascent.
    This particular renter group spun out, and when reversing to make another attempt, gets stuck in the drainage ditch on the side.
    One of them says, it's not how they were planning on spending their vacation. Buyer beware, I guess.
    This switchback in view is only 40 feet from our living area.
    Headphones may help a bit to convey the rumbling that goes along with these incidents, rumbling that resonates through the walls of our home.
    We live on a steep, curvy, gravel mountain road. There is one house uphill from us.
    To reach their property, the homeowner of that house has an easement for ingress and egress through our property, for use of our driveway.
    There is a shared maintenance agreement for keeping the road in a condition that allows "comfortable passage by any type of motor vehicle". But maintenance has failed due to constant damage from short term renters who are unfamiliar with driving on steep, curvy, gravel mountain roads (especially when damaged), while often driving vehicles unable to manage such conditions.
    Maintaining the road would be effective if the drivers were capable (as a precious few are), but when they're not, they damage the road beyond any reasonable wear and tear. This is a record of that continuing damage to our private property.
    For more context, this has been going on since we moved into our home in 2015, and in that span of time we've sent videos, complaints, suggestions, and photos to the homeowner hoping for a permanent solution. Our suggestions have been ignored, and we were instead accused of being threatening, harassing, and of violating their privacy with these videos. We've chosen to document the damage here so as to minimize this damage-related communication with that homeowner.
