@@michaelknight2897If upheld, Biden will be removed from the ballot in every red state for a crime in which he’s never been charged with either. Way to “protect democracy”. I’m an actual liberal. You are totally blinded by partisanship and as a result would hand your own children an America without democratic elections if given the chance to do so - clearly, that’s undeniable based upon your support for this measure. I’m sure you also had no issue with the DNC deciding that anyone campaigning in Iowa, New Hampshire or Georgia was ineligible to win the Democrat primary in that state. That is a rule the DNC passed to ensure that Biden wins the primary even though Kennedy was polling extremely well in those states and gaining. Kennedy had already campaigned in each state so instead of trying to win the democratic way they just blocked him to guarantee Biden wins no matter what. The level of hypocrisy amongst Democrats like yourself who claim to want to “defend democracy” while simultaneously destroying it entirely based upon your hatred of a complete stranger whose policies were mostly to the left of 1990s Bill Clinton is so staggering insane and selfish that I genuinely cannot see how America survives another decade without people like YOU embracing some semblance of emotional stability. Until then, we’re totally fucked and if this decision is upheld thereby preventing the person who currently leads in the popular vote from winning then democracy is dead and America has become a dictatorship, which again you claim to oppose while simultaneously supporting. Just stunning to watch self-proclaimed “liberals” so passionately abandon all of liberalism and somehow think you’re still the good guys. Take a deep breath, look at your children or grandchildren, and ask yourself if your blind hatred for Trump is more important to you than their futures. You cannot say you support democracy while openly destroying it. We’ve sanctioned Russia for doing less. In fact, in response to this Colorado decision Putin removed his opponent from the ballot and then cited that Colorado decision as a precedent for doing so. You lot are so fucking selfish, irresponsible, emotional and staggeringly stupid.

@ michaelthompson9548, the 14th Amendment is from the Civil War Era and stated that former Confederate military and civil office holders couldn’t hold office. There is no wording anywhere in there that applies to the president, especially today. And even if there was, Trump was not convicted in the US Senate on the “insurrection “ charge that the Democrats are so hell bent on pushing no matter what. Bill O'Reilly is always wrong! ...But he is wrong, here, because he is treating disqualification as if it was a criminal sentence that should only be handed down by a judge in a court, which is completely not what it is: disqualification is not a criminal punishment for the individual; it is a protection for the state!
It's a valid argument to insist on due process, however, Bill O'Reilly is wrong in his understanding that due process can only be appearing in a court of law!
If Bill O'Reilly was smart (which he really is not!) he would be screaming to the rooftops that the Colorado Supreme Court's decision is invalid because they do not have the jurisdiction to make that decision, and you know they don't have the jurisdiction because they don't have the power and authority to enforce it across the entire country!
Because disqualification affects you in the ENTIRE country: if Trump is disqualified did he is barred from serving in any number of government positions; local, States and federal, elected or appointed, throughout the ENTIRE country, and the state of Colorado does not have the authority to make that happen!
Therefore they cannot make this decision and they certainly cannot confirm a such a decision made by an even lower court, which is also lacking said jurisdiction!
Please someone explain to me why so many lawyers are not understanding this!
Jurisdiction is really fundamental, and covered in the first year of law school...well any GOOD law school...
I proclaimed Trump was disqualified on January 6th, therefore he is disqualified!...right?!
Why is no one respecting my 'authori-tie'?... because I don't have any authority to make that decision! Neither does the County court in Colorado, and neither does the Supreme Court in Colorado and neither does the local courts in New Mexico or Minnesota or the Supreme Court of Minnesota or the Supreme Court of any state: they do not have the authority to make this decision add reclassify anyone as disqualified across the country!
Can I walk into Denver County Courthouse, and file a deed for the Moon, or Mars?... NO! because they don't have jurisdiction over the Moon, or Mars, or Disqualification!

On if you redefine "insurrection" and then ascribe to someone the orchestration and coordination of said insurrection without evidence. Once you redefine the word and tell the lie enough you then use the new definition as the basis to FURTHER manipulate and lie by removing context of the clause and what it was created to do and address. In the end, this is the very thing that despots do. Congrats Democrats.

Are you a lawyer? If not, you post about the constitution like are. If you are a lawyer, did you take "Con Law" in law school? The Colorado Supreme Court decision was among the worst decisions in the history of the United States because - the Colorado court opinion altered the facts and in effect found Trump guilty of "insurrection" when he was never charged or found guilty of the crime. To the MSNBC / traditional US mainstream media who claim Trump does not need to be found guilty in court to have caused an Insurrection, then that is a problem under the US Constitution because that makes an accusation being proof of guilt - which is unconstitutional. What the Colorado Supreme Court is also stating is there is potentially no Freedom of Speech; no Freedom of Assembly; and no right to Petition the Government for Grievances. To those people in the USA who like this decision and want this type of judiciary, flights to Moscow, Russia depart from the USA every day.

    • @peterstaniforth451

@@johnnoone4323 There is no requirement in the Constitution that an insurrectionist has to be criminally charged and convicted before the disqualification takes effect. It was the responsibility of all the judges to weigh up the facts of the case and determine if the preponderance of evidence indicated that Trump engaged in insurrection. The evidence, not just Jan 6th itself but the whole criminal scheme instigated by Trump to pretend the election was "stolen" and then to attempt to use all sorts of illegal means to try to cling to power , is overwhelmingly that Trump did indeed engage in insurrection.

Really Bill? The constitutional scholars who know more about the 14th amendment than you, say Trump is ineligible to be on the ballot (14th Amendment) . He is an insurrectionist and he gave comfort and support to the other insurrectionists! He’s on tape saying he would pardon them!

    • @michaelknight2897

And constitutional scholars say the opposite. First and foremost, a Progressive is a Progressive first and everything second. Progressives will abandon professionalism, ethics, and truth for ideology every time. So a Progressive scholar is worthless when it comes to objectivity and truth.
