      If you're not doing anything wrong and ur not looking impaired and ur not in the investigation u don't have to if they openly see weapons drugs or anything illegal in the car u have to but sometimes they can say u fit the description of a wanted person then u have to but I think they should have to show proof u did look like a wanted person

    4:31 "...always be polite with an officer..." Are you confusing "polite" with "not abusive". This is not a social event. You have no obligation to "be polite". "Polite" behavior would have you respond to the cop's questions, statements and requests. It could put you in jail. Don't be "polite". Don't be abusive or combative, either. "I don't consent to any searches." "Am I free to go?" "I want to go now." "I want to consult an attorney before I respond to that." Those are all non-abusive things you can say to a cop. If he thinks you are not being "polite", he won't invite you to his next birthday party. You'll get over it.

    So let's say I'm a passenger in the vehicle and I do happen to have a warrant for my arrest, when I am asked for my identification and I refuse is there any scenario that I will make it out of the situation without going to jail?

      dude if you have a brother or relative that looks enough like you use thier name ive had a small bs warrant for over a year and been stopped like 4 times as passanger and i use my bros name and it works bc he has a clean record and cops are stupid no bs

      @@eloyrobles3873 A long while ago I found out that my only younger brother stole my birth certificate and had a license made out in my name with his picture on it. It wasn't a pretty picture when my younger brother ended up in the hospital for stealing his older bro's ID. May I suggest to your bro if he figures out you been using' his name that you end up like my beat ass bro did. BTW he never did it again and to this day obeys the law.

    I believe the bigger problem is that when the police want information from someone they want it right now as if there in the biggest hurry in the world, like they need it to go to the bathroom. I'm not trying to be funny, I'm just making my point as clear as I can. and when someone ask an officer a question, most of the time they act like your not even talking.

    I have a question. if police stopped the car for traffic violation and inthe car 2 passengers in the back seat and police saw in the plain view the drug in the car does police have a probable cause to arrest the passenger in a back seat.

    I have a friend that was passenger stopped for window tint the driver pulled out but tossed drugs on the passenger who concealed it stupidly however he refused to ID because he wasn't wearing Tint and the officer had no crime suspicion that he could state but angry over his id refusal put him in hand cuffs pulled his id runs him hears his past record takes him for strip search. Because police only follow the parts of the law that protect them and work for them. . The guy has a record but is that enough considering he was detained without reasonable articulate suspicion. The letter of the law shouldn't be just for the citizens. Should he get twenty years for someone else drugs found while his rights was violated because a deputy has a bruised ego and doesn't care about law in the first place?? He can't afford an attorney is afraid to go to court anyway because it's known fact that courts of law don't want to practice law and give you 5 times the amount of time and rarely is there justice in these small towns. What should he do honestly. ??

    I was a passenger in a truck that was pulled over for a traffic infraction, the driver was arrested for driving without a license, I was the owner of the car, the police wanted to inventory the car and tow it away, I told them I'm the owner I'm licensed and can drive the car, there was a 2 litter bottle on the floor board of the car, I was quested what it was I said I don't know it's a 2 litter bottle, they asked if it's a beer, I said no I don't drink, they had step out of the car to pay me down for weapons when I stepped out of the car, the office went I the car pulled the towel that was covering the 2 litter bottle to find something he wasn't sure what it was, then searched me by going inside my jacket pocket to find drugs, he claimed his life was in danger that's why he search me. Is any of that legal the dash cam audio was not working so I can't prove I was challenging the search to tow the car, it's the officers word against mine, but the body language, indicates no fear for his safety cause he never called for back up.

    What if 60 days has passed, from the passenger being arrested (the passenger was arrested with zero paperwork given and allegedly charged with 2 class 3 Felonies). But, We are looking at this 60 day rule and looking for precedent.. is it dismissed after that, null..? What can and what should be done?‽?

    I was told by a Georgia cop that if the driver got pulled over for not wearing a seatbelt I was to show my ID also. Some dumb statue called "party of a crime." What's your outlook. I know mine

    Why would you, a lawyer recommend to anyone to willingly vacate their rights. And no. Refusal to identify is not probable cause. You can tell this video is old. Rodriguez vs USA. Police cannot extend a stop simply because a passenger refuses to id. This video needs a update

      This is the primary question most ppl are asking and it's obvious he doesn't want to give a straight answer. The answer is never talk to the police and never give them your ID if you are doing nothing wrong. Warrant or not. They don't know you have one until they know who you are.

    So the driver is being pulled over for whatever reason. If it’s in city limits (where I’m from) 9 times out of 10 a cop walks up to both sides of the vehicle. If I’m in the passenger seat and the officer approaches MY window and asks my for my ID and I politely decline, or tell him I don’t have one, he returns with asking me for my full name, DOB and social. Do I have to give him that information? Especially if my driver has a valid license, and insurance?

      Yes. A driver must identify themselves and provide dl, insurance and registration but can not demand ID from the passenger unless the Cop has individualized Reasonable Suspicion that the passenger has committed a crime

    In OK (not compulsory ID state), driver pulled over for loud muffler, driver’s DL revealed an outstanding Arkansas no hold warrant. Best guess is warrant was for unpaid ticket. Cops claim this was reasonable suspicion to demand passenger ID. Passenger asked what did he do wrong and refused to produce. Cops say he seemed agitated and flailed his arms so they arrested him for interference with officer. Your thoughts?

    I was a rear seat passenger in a traffic stop. The vehicle was pulled over for an expired sticker on the license plate. The driver was not detained or arrested just given a ticket. The front seat passenger was asked for his name which he gave. The officer then shined his light on me asking my name which I refused to give according to my rights since no crime or violation was committed where the officer would need my name. The traffic stop was then prolonged while the other passenger and driver were threatened with legal action if they didn't disclose my name. I allowed the police to search my belongings and my person to alleviate any question of wrong doing, still not disclosing my identity. I was then taken from the vehicle, arrested and charged with obstruction and falsification. Was this a legal arrest?

      Dave - Unless cops have reasonable suspicion you are a criminal they can not demand ID. If it's not a stop and ID state they can't demand ID unless you have been lawfully arrested for some crime.

    If a driver lets their intoxicated friend out of the car, to retrieve a object that flew out the window and the passenger gets struck by a vehicle and killed, can the driver be charged or sued for damages for neglect.     When do the cops have the right to search the passengers purse or bags during a traffic search if it's not in the vehicle at the time when the cops find probable cause to search the vehicle????.....I was outside the vehicle with my book at asking the officer if I was free to go and waiting on him to return my Id and as soon as I exited the car to do so he told me to stop and put my bags on the ground which I did and then he asked the driver to get out and upon doing so a weed pipe fell onto the ground which he claimed ownership of but then the cops searched the car and then my stuff and I wasn't doing or breaking any laws and was completely cooperating with them but I had mentioned I was in a hurry to make it to the store before it closed and so almost instantly I had made that aware to the officer yet he still wouldnt give me back my id more the 20mins later...which I had no warrants or anything like that so I dont know why I was not free to leave also I had told them I did not consent to them searching my stuff prior to this aswell but bc the driver dropped his weed pipe then they said that was probable cause to search me and my stuff which was already out of the car by that time.......and upon doing so I was the one who got arrested and taken to jail meanwhile the driver and other passenger did not even considering the driver did not have his license on him and no bill of sale for the truck he did have current insurance but no tags on the vehicle since it was within 30days of him purchasing it....which is why we were stopped to begin with!!!&apparently that was his 3x being pulled over by the cops that week he had claimed.... anyways I'm just wondering what my rights as a passenger are and when do the have probable cause to search me????....I am now facing a class 4 felony charge for a dirty dope bag/pipe!!(

      Ricelle Greenwood when you say dope... do you mean weed or fentanyl/heroin? If it’s your first criminal charge EVER you’ll more than likely be offered ILC (In Lieu of Conviction) meaning once you complete a year of drug court they will clear your record. If it’s a weed charge, or a weed pipe charge... what state are you in?? Those pretty much don’t even exist anymore and you only get a felony charge if you have a decent amount of weed.

    Well .... you just told us that the passenger has to show an ID when the police ask for one because you just said that if the passenger refuses then that is probable cause for the police to request an ID .... so what is the answer ....? as I understand it .... the passenger has no right to refuse and if they do then there are consequences for it.

    You guys/girls can stop all the questions, here is your answer: The cop can do anything he wants to, you have no rights! Remember most cops has a GED and 6 months of training (while a hairdresser has to have 2 years of training). The brotherhood and the police union will protect them! You live in the police state!

    Hi can I ask you something I wS pulled over and I had my drives side window down my passage side down 1/4 way cop dragged me out of car assaulted me cuffed me cuz I wouldn t lower all the way do I have so after all this I was told I could go with a warning I asked for name and badge number from cop oh it was 3 cops in one car they was gang unit said they saw me speeding I wasn t so I'm told I could go warning two cops walk with me to car they said to get on camera my stuff they took out of my pocket was in car so I ask for name badge number one the cops that was back at car he slammed door came over said I'm ticketing him they didn t have ticket book they called another cop out to bring ticket book I was told th we y can t do that plus its only cuz I asked for name and badge number and wA already told I could go with warning

      I've been trying to get a hold of local municipal ordinances in a couple towns i spend a lot of time in & no luck. They're not online. I've messaged them about it & only one town has replied & told me to come in & they'll make copies for me. Very nice. However a couple towns have just ignored my questions. Can I just go in person & ask for them??? & do they have to comply??? Again they're not available online. Certainly a person has the right to know the town ordinances...right????
