(c) Re-fix all pensionary and post retiral benefits
accordingly.
(d) Issue all arrears and fresh PPO where applicable,
within three months of this order and submit a compliance
report.
40. In view of the fact that there are a large number of
pending cases which are similarly placed and fall into
Category A or B, this order will be applicable in rem to all
such affected personnel. Respondents are directed to take
suo moto action on applications filed by similarly aggrieved
personnel and instruct concerned PAO(OR) to verify records
and re-fix their pay in 6th CPC accordingly.
10. In the light of the above consideration, and the fact that
the same considerations are applicable for pay fixation of
officers and men of all the three Services, we find that the
applicant prima facie has a case and the balance of
convenience too is in his favour. We therefore, allow this OA
and direct the Respondents to:-
(a) Review the pay fixed of the applicant on
promotion to the rank of Wg Cdr in Jun 2007 under
the 6
th CPC, and after due verification re-fix his pay
in a manner that is most beneficial to the applicant.
(b) Re-fix the applicant’s pay on transition into
7
th CPC as on 01.01.2016, in the most beneficial
manner, while ensuring that the applicant is not
drawing less pay than his juniors.

पिछली सरकारों ने तो कई बार orop रिवाइज किया था। पैसे पेड़ पर नही लगते यही सुनना पड़ता था
आज से सौ साल बाद इतिहास पढ़ने वाले भी विसंगतियाँ पाएँगे और प्रभावितों के वंशजों को कोर्ट से न्याय मिलने का काम जारी रहेगा । हमें अपने प्रशासन पर गर्व करना चाहिए

सर कोर्ट के आदेश तो बहोत कुछ होते हैं पर अॅकशन कुछ भी नहीं होता...यह मिलेगा वह मिलेगा पर कुछ भी नहीं मिलता है...ओआरओपी का ही देखीए कोर्ट आदेश लागू होने के बाद भी कुछ भी नहीं...और मै तो कहता हू कि जिसैबो को खत्म करो वह भी वेलफेअर वाले काम नहीं करते हैं..

सुप्रीम कोर्ट का जबर्जस्त फैसला आया था लेकिन अभितक कुछ भी नही हुआ है।
सर 3 महीनों का समय तो orop 2 रिविजन का भी दिया गया था
Sir आप अपनी ड्यूटी सही निभा रहे हो परंतु सरकारी अधिकारियों को निर्देश अनुपालन कराने के लिये सुप्रीम कोर्ट भी कह ही सकती है, जब मोदी किसी की सुनता ही नहीं, जिसकी सुनता उसे (पत्नि) पहले ही छोड़ दिया जो हायर सुप्रीम कोर्ट उसकी जिंदगी में आदेश मनवा सकती थी।
No action is being taken by the Government . Fresh example is there with regards to grant of OROP. More than six months are over, but no action is still taken.

सर जी मै SM HONY LT जन 2017 में सेवा निवृत्त हुवा था और सातवें बेतन आयोग के हिसाब से मुझे पेन्सन दी जा रही है जो की जुलाई 2013 से पहले आये इसी पद पर उनको हमसे 3000 ज्यादा बेसिक मिल रही है ।
आज हमें भी आशा है कि मननीय ऊच्च्तम न्यायालय ने बहुत ही ऐतिहासिक फैसला सुनाया है जो कि सत्य है और हमारा हक भी
अब सरकार इस फैसले पर क्या संज्ञान लेती है?? हम सबकी नजर रहेगी।

Sir. Very nice information. It is very difficult to state that no Govt. Orders not being implemented. Nor Hon. Court ordered implemented by who is responsible for pay and allowances to employees as per entitled pay scale. It is farce that even on promotion. FR22 also not implemented by Pay section. Existing Govt Orders for who is responsible for delay in Pay. He should be penalized. But regret to say. No action by department. Jai Sriram. Salute to Hon. Court of India. ie Hon Supreme Court and hon CAT.

Sir you have given so many court orders by the honble courts. But what is the latest update on grant of notional increment to those who retired on 30 th June and 31 St December.We retirees are in deep depression. Whether the government obey the orders of supreme court. August there was a hearing but adjourned. What is actual feed back on this.

How the individual will come to know that he is drawing less pay from his colleague. Since pay of the pbor is controlled by PAO OR , it is not possible to identify anomaly at this stage in r/o persons retd long time back.therefore it will not be useful for them

I am an ex-sgt retired in 1982.I too am paid lesser during 6th CPC and so the refixation In 7thcpc has gone incorrect.

जो काम सरकार का है, अगर हर काम व फैसले कोर्ट ने ही करने हैं तो सरकार का मतलब क्या है क्यों इन करीब ८०० राज्य सभा और लोक सभा के सांसदों पर देश का इतना भारी-भरकम बजट खर्च किया जाय,यह कहां तक न्याय संगत है,देश में क्यों न राष्ट्रपति शासन प्रणाली लागू किया जाय। देश का आधा बजट इन नकारों पर क्यों खर्च किया जा रहा है जब इन्होंने कुछ करना ही नहीं है।

Many a times the court had directed the Government to implement many jawan related welfare matters. Three organs of Government i e. The legislature, judiciary and bureaucracy should have mutual respect on each others independent function. Unfortunately the judiciary and legislature entered into a "who is supreme" war. The legislature never respects the verdict of the honourable supreme court. If a normal person doesn't obey he will be booked for the contempt of court but the govt never implements if the order is not in their favour. All the political parties are having similar attitude. In my view the present Government will prolong the issue till 2024 to fetch vote bank.
