      The caste system was implemented by the British to keep a peaceful community at each others throat. Divide and rule policy which is seen everyday hindu muslim anarchy yet India is a hindu country created in 1947during partition so muslims who remained should be treated as outsider's just as pakistan and Bangladesh does to the hindus.

If Hindu religion has to be proved supremacy based on hatred of other religions, and to speak lie and or can not do justice of human belonging of other relegions which Hindu religion you are talking about. With all its flaws USA is the beacon of democracy and constitutional values ,where people from all around the world want to come, is no 1 , why not India be in that league.     with due respect, If you hear this you feel wow these judges are truly great pillar of nation and ideally this should be in ideal scenario; but than as a common citizen I see corruption in judiciary right to last drop of ocean...right below the nose of these judges....Shahrukh son case has pained judge but a common man is daily struggling in many of such type of cases....infact Shahrukh has money but common man goes bankrupt in fighting legal battle....why can't judges be appointed on merit by examination not collegium system and for examination qualification one of criteria should be the history of judge where his judgements, controversy, etc should be considered .... question should be asked by judges themselves within that why judiciary is compromising.....I feel the three fingers needs to be corrected before pointing others

    Entire speech reeks of shallow western view of constitutionalism that had to deal with their medieval challenges. Given that India is a Hindu majority country, it's obvious that judges too get appointed from the same society. In ancient times, people spent entire lives learning the shastras and how the law applied to the society. That's why when kings were defeated, their ministers were retained to ensure continuity in the society. Didn't we have a judge who didn't want to hear the cases on Easter or on Christmas?
    Constitution is to serve the people who live in its jurisdiction and not itself. That's why legislature that represents people is empowered to amend the constitution even it's preamble. Judges should stick to interpreting the laws based on constitution and nothing beyond it. Last thing we need is activist judges regardless of their socio-economic or religious background

    Sir, collegium has to be broadened in SC and HC ie why 3 or 5 judges collegium , why not 9 or 15, one day brainstorming once in a quarter to appoint best judges for better future with better & faster judiciary. Judiciary has to be made financially independent through court fees from civil matters and to finance for free criminal justice system

    The concept of a judge is that he he is the impartial representive of God. So the best way of selecting judges is to maintain a biodata from high school level, of all lawyers enrolling to the bar . If any of the persons took part in any type of political or religious riots or held positions in political and religious positions should not be selected because they can't be impartial by what they turned during the life.

    I think the collegium should have a search committee in which government representative, eminent person from society, renowned artist, educationist and even a renowned retired judge from a foreign country should be a part. Their job should be only to search for competent judges who can be appointed to High Courts and SC. The final appointment should be done by the collegium. The appointment should not be left only to collegium. It should be structured and must pass the rigour of minute scrutiny.

    Law is codified commonsense. It changes from place to place and time to time. Culture of a country also do prevail.
    Constitution was written under the supervisory guidelines of England and their B team Congress, to watch the interests of Chruch. Even seats of Anglo Indian MP were provided. There are various sections in constitution which are designed to tax Santan Sanskriti. Even Indian languages were put on back burners and a foreign language English was given supremacy.
    Even Judicial processes had helped the mighty.
