    House B in the back is selling home listing in the MLS a parking space on the ingress egress easement. Same owner that has for 3 1/2 years refused to comply with the shared well agreement and contribute. She also refuses to maintain the easement does not provide trash service for her renter or fix water leaks

    Clear, succint explanation of a rather complex legal right - valuable insight to a non-industry/legal layman. I'm from Msia and our laws were received from Britain, so we have easements but after independence our land law got codefied and modernised and as such easements have been done away with most of newer properties but there are in place stringent procedures to acquire one by the dominant owner. Prior to independence the easement was acquired by proving long user in case of dispute - I think it was 20 years or more to prove long user.

    After 17 years I found out I have an easement... in a suburban area. My main questions are 1. Why am I paying all the property taxes, including that area? 2. If there is an accident/injury, or a city violation on it, who is responsible? 3. What if there are both new owners? 4. What if they have there own access to the property and technically don't need mine.

    I did understand it, now. Thank you very much. I do wonder if this is written down anywhere or one where customary use works in court? I was asked to give a neighbor an easement in writing, because I had no idea if he sold the property if the new owners were going to be problem. But I do allow usage informally.

    A lot is encumbered by a sewer easement that runs where the foundation of a building would be. How will this affect the owner, who wants to build a house?
    A) Any easement through the buildable part of the lot will prevent construction.
    B) It will have no effect because the sewer line is deeper than the foundation would be.
    C) The municipality must move the sewer line prior to construction.
    D) The house must be constructed to avoid the easement.
    I would appreciate it if you can explain this question for me. And what's your answear choice would be???

    What about a footpath that goes across two properties, almost like a sandwiched between two houses? They lead to the next street at the back and I think they were made so a pedestrian can easily get to a bus stop or a convenient store in the next street. I wonder if they're a type of easements?

      I think this depends on the situation. Some properties will have footpaths behind their house or between their house that are maintained by the city. When in doubt, pull the title out. The title report will list any property's encumbrances.

    What is an easement? An easement is an agreement between two parties allowing an action of someone who does not own the land, to use the land to an extent agreed upon. The non-possessive right to use the land has limits. The servant or better known as the grantor, in charge of the easement may allow PG&E to change the power line in the front of the property, and that is all agreed in the easement. Easements are usually for these types of companies that work on the property. It could also be a neighbor or any type of individual who just comes to terms with the easement and is allowed to enter your private property. The limitations apply to this user or holder of the easement. The owner of the property and easement basically allows, with limitations, a set up upon agreement or (easement.)

      No, it's not always an agreement, and the owner of the land that the easement passes over isn't allowed to dictate who can or cannot use the easement.
      Because the people who use the easement have a right to access.

    What is the difference between preeliminary title report vs the abstract title ? They have a similar definition.

    Great explanation. Reading online confused me even more but this video is way more clearer. Quick question if there is any water/drainage going under the property is it also called easement which means we cannot construct anything on top of that piece of land?

    I have a ? What if the easement holder has another way to access there property. For example Another driveway that goes to a public road.

    My easement runs from the front of my property to the backside of my property where the back property starts the owner of the back property has put a gate at the front where my front property begins no I have no access into my backyard neither does the fire department if there should be a fire what can I do

    What if property A (mine) has an underground power cable in a conduit pipe that runs up through my land to power a subdivision? It is not a public utility it was put in privately coming off of a utility pole just off my property? Do I own the conduit pipe and the cable ?

    One of the neighborhood fence fell on easement that lead to my property. I removed brush/bushes to clear the path. The other neighborhood on the other side got up set because o clean out the easement. Any advice am.in CA

    As of February, about 84 percent of syndicated easements were in some stage of an IRS audit, according to the finance committee report, which was released in August. The report found that about $10.6 billion of tax revenue was lost to syndicated easements between 2010 and 2017. And lawmakers in September introduced a new bill aimed at closing such loopholes.
    The IRS publicly flagged syndicated conservation easements in December 2016, and the Department of Justice filed suit against several Georgia-based promoters two years later. But the amount of tax revenue lost to easements continues to grow. IRS data shows total deductions claimed through syndicators rose to $9.2 billion in 2018 from $6.8 billion in 2017.
    “The IRS shamed these scammers by publicly listing these transactions, but the continued growth in their numbers shows that shame alone won’t do the trick,” Sen. Charles E. Grassley (R-Iowa) said in a statement in September. “The IRS and the Department of Justice will continue to do their job enforcing the law. Now it’s the job of Congress to clearly prohibit these abusive schemes.”

    Why would they built like that ?? Why the builder built property like that?? If it’s a problem pass some1 land then why they built at first place ?? Don’t understand. After built then it’s a easement problem. Don’t they know it’s a easement problem when they first built the property?? Don’t understand

      There could be many reasons for it. It could have been an entire lot that is broken up into multiple homes. For example, in the city, you could have multiple homes sharing the same driveway just based on dividing the land up and the zoned space around it. In the country, there could be multiple homes that stretch backward along a stream or hillside and all share the road because you won't have multiple roads cutting through people's homes or land.

    What happens if the utility poll easement is not disclosed by the agent and it is not in the title report ? They said later it is prescriptive easement. Does it need to be in the title report and what to do regarding reporting the title company?

      That does match the description of a prescriptive easement. These easements aren't seen in the title report and are assigned without notifying the title owner. It is possible to extinguish the prescriptive easement. To do so, you will have to resolve the reason for why the easement was first assigned. I know this didn't directly solve the issue but we hope it steered you in the right direction.

    I'm looking at a house that is on an easement. according to the survey the road out front is not a city street, but part of the property, and is labeled as an easement. so as i understand it, all the houses on my block basically have their property extend out over the road that is really a shared driveway. there's no HOA so who is responsible for maintaining it? and if something happens on my portion, do I have to worry about liability? if a pothole suddenly forms or one of the concrete slabs becomes raised and someone breaks their axle on it, do i have to worry about being sued? and are there usually legal requirements on things like maintaining access to the full two-lane width, or is it good so long as one lane can get through and the neighbors dont mind (I'm mainly thinking about temporary situations like where i would park the moving truck or extra street parking if i have guests over)? I'm in florida if that makes a difference

    I just bought a house and there was an empty lot next to it, and a week later they start building and the city came and put their clean out pipe on my property and on my property line which on my survey it clearly says here’s no easement there,but I have easement on the back of my house ,problem is that the city put their clean out pipe on my property not on my easement,and is it legal for them to even put someone else’s clean out pipe on my easement as well ?

    You mentioned the utility easement, but there’s also an easement in gross where there is no dominant tenement. What’s the difference between the two since both technically have no dominant right?

    I have a situation with someone, I drive a tow truck with a bed so to backup and drop the car I have to use more space to drop the car off so the other house owner asking me to pay for the property damage that I made which is he was just putting a concrete in place of the grass “on the easement “ at the same time no signs says anything about it, I thought it’s a sand what should I do in this situation

      Hi, Zainab. This is a great question. The difference between public and private easement comes down to who this easement is for. Public easements is for the public. An example would be sidewalks or streets. A private easement would be for a private entity. An example would be a neighbor using a homeowner's driveway. Hope this cleared things up!     Bought my home a decade or so ago neighbor beside of me had her property long before I came along this neighbor has 2 gated entrances most of us has one usually at the end of drive way at some point before I came along she took the fence down that connects her property and mine near my drive way she put a wide wood gate deeper in her yard so could enter and exist her yard with a truck and trailer.What does that have to do me and this vid? We’ll, at some point before I came along she plant a tree bush on the corner of her house nearest my land on the side of my drive way.I bet you can figure out where this is headed.To get to her gate with truck and trailer to avoid her bush she has to come on my property.I ignored it a couple of times(a couple too many)but one day she came within a couple of feet of my wife’s car .We had a little discussion that I can’t repeat.After that I wrote her a certified signature required cease and decease letter stating she is no longer allowed to trespass on my land whether it’s walking or driving a vehicle.There’s some thing a lot of people don’t know about it’s called aversive possession.If you own land I would learn what it is as in NOW!

    So if there is another access point to their property but have used my land for 20 years per their claim as a shortcut still valid? House a and B and both hers house B she claims she can't access through her land which is a lie since they're land locked and attached to each other. She uses my land as a path to get to the back of lot B which she claims if she builds a house there she needs access too.

    What about if the person utilizing the easement is living at the location (not a rental), but is not on the title of the home? Are you able to not allow that person to use the easement if there is another way to access the home?
