- The plaintiff pawned jewelry at the defendant’s pawn shop. She claims the defendant’s store lost her jewelry, so she’s suing for the value of her items. The defendant says he has no idea what happened to her jewelry, and they are not responsible for theft or loss. The defendant claims he offered her money and items from his catalog.

Whoever took the jewelry in, didn’t catalog it, didn’t take pictures, but gladly took it home.
Ultimately the Pawn shop is liable.

The defendant claims he never saw the jewellery yet at the end claims it wasn't worth the $3500, she got, but if he never saw it, how on earth would he know value?...
Because in general practice you don't receive 10x as valuable items for the amount that you pawn. Most pawn shops won't let you pawn something for that little if its worth that much

And why wouldn't they photograph them when they returned to relieve the temporary guy?
@@michelehemlokhexwhite4310 because they weren't the ones who received the items or originally dealt with her. They're store clerk messed up on the job and now they have to pay for the mistake of their employee
Also any pawn shop or jewelry will value the item by weight, not retail price or emotional value to it

If jewelry 💍 or any items have an emotional or sentimental connection, don't pawn it. Period.
But it comes to worse after the worst of a situation.. people do nutty things to make ends meet. I'm glad all my jewelry is fake

Unless they are really nice and expensive jewelry, pawn shops melt down lower end jewelry because they get more value out of it in solid metal form (gold bar) then having it sit in a display case.

Why didn't the plaintiff when she got the pictures ask for the worth of the jewelry at the other pawn shop, she had the pictures, they had to have more info on what they offered and the worth of the jewelry since the jewelry was the same.
The Defendant's were acting irresponsibly by losing the Plaintiff's jewelry. I'm glad the Plaintiff won!
BEFORE YOU PAWN, YOU - the customer - should take photos and also take a photo of the jewelry on a jeweler's scale... you can buy one for $10 online. Even better. Have the items APPRAISED before you pawn them.

I had some things that were from my Dad and I never would have pawned them- for ANY amount! (Sadly they were stolen)
He wouldn't have a clue as to the value of the missing jewellery.
Pawning stuff is possibly the only thing as dumb as renting a storage unit. They make sense in very few cases, but they're usually just throwing money away.

JM parents were refugees. She did not live a lavish lifestyle. She worked hard to be the great Judge she is.
@@ohsuellen That was along time ago, and when plaintiff said she needed money to help towards her business rent, JM was like if it's so valuable why pawn people do what they half to do to survive! She did it the legal way. Not everyone has a two judge household! People get out of touch of there up bringing all the time Specially when they have money. FACTS

JM is shocked at pawn cases not because of the hard times but because if the tiny amount they are willing to trade in items that mean so much. I’m selling my tvs or game systems or car or computer before my mother or fathers ring or bracelet they gave me and they’re dead! That’s the part JM is shocked about. JM shops at TJ MAXX because she’s afraid of going broke like when she was a kid. She understands. Pawn Shops are a rip off. They’ll give you $50 for a $1500 ring smh
We used to be close with our neighbors, we were called "the siamis twins", [I'm not sure about the spelling of siamis☹️]. There was so much we had in common even though we came from two totally different worlds. I loved it that we broke the racial barrier in the entire neighborhood and mocked the haters very loudly accompanied with even louder laughter. The husbands did many things together, guy stuff that us girls were like 🖕 be gone and play with your tools. We had our properties fenced in together with a gate in the middle so the girls could escape the handyman talks. Everything was so awesome for about five years. Unfortunately the neighbour broke a trust rule that involved coworkers and friends of ours. All over lousy 500 bucks. There is much more to the story, but I don't think it's a good idea to bring everything up. Anyway, the closeness was gone, the trust was broken and Unfortunately he [neighbor] did not fess up to his wrongdoing. This happened almost a quarter of a century ago. Our friendship never recovered. ☹️😥

Yes defendants you are responsible if someone you hire steals clients stuff.
You never pawn anything you’d want back, for one. Secondly, they either sold the stuff for much more and figured they’d stiff her or their employee stole it. She got a hell of a payday though!
Well now I’ve had to pawn and picked up. They have to keep it safe for a month after your first missed payment in my state but people can’t expect their stuff to just be there for awhile.
if you shouldn’t pawn stuff you’d want back then they wouldn’t give you time to pick it back up.

Pawn shop stole it! My guess it’s in their private home jewelry box . They lost the items and the pictures but had the vague paper work.

The pawn shop owner only wanted to give her the melted down value of the “lost” jewelry and that’s probably what he did , melted down the jewelry as soon as it was pawed thinking she was never coming back. She even came back and made a loan payment so he had to have known she wanted her items back. The guy is claiming he has no idea what happened when really he’s just being dishonest.

I know this has nothing to do with the case but this plaintiff really needs to get her life in order. If you're in a regular cycle of pawning things then your finances are seriously screwed up and you need to stop wasting your money and instead make a budget.

the court pays the 3500 to plaintiff..and the defendant is off the hook...this is not right
Before I asked my wife to marry me, I asked my mom to go with me to pick out a nice wedding ring.
She told me that she knew of a pawnshop that had high end jewelry., so we went there.
The ring that I bought was a custom made ring.
My mom asked him if she could take it to her appraiser and he told her yes bc my mom bought a lot of jewelry from him in the past. The appraiser said it was worth $5K.
We went back to the pawnshop and asked how much they were asking. The man said he would sell it to me for what he paid for it, which was $800.
My wife has gotten many compliments on it.
One of her patients was a jeweler and looked at it. He asked where she got it and she said that I bought it from a pawnshop. He too said that it was worth about $5K. My wife laughed and told him how much I paid for it.
He then told her that I got a killer deal.

Knowing what I know... they usually give about 10% of the real value when you go to PAWN. So that was a bit generous. Probably was worth $3000 total. But this was horrible business to make that kind of sloppy mistake.

Maybe it is time for the judge to retire. Giving the plaintiff shit for pawning precious items as if someone would do that flippantly. You do that when you're desperate and the judge seems detached from reality talking as if it was an easy choice

Pawn Shops are there for people that are DESPERATE for $! They don’t give you much for it because they know you are in a bind! (But why would she pawn something sooo valuable (supposedly) knowing if she didn’t return at a certain date with $ to get it back, she knew she would probably lose it! She couldn’t even prove all them pieces were all real, of good quality, their age, etc! (All of that is considered when pawning jewelry at a pawn shop!) but since the Defendants were negligent in losing it, plaintiff automatically won, which she should have for sure! (I just don’t know how judge arrived at the 3,000?) 😮
Why would you give a wedding ring that you bought yourself as a woman and when the marriage failed. 🤣 If you have to buy you own ring he isn't staying.

That was a crooked deal up front. I pawned a small diamond ring for $225. That value sure as heck wasn't the gold weight which I think is about 5gr. So yeah, they ripped her off.
I agree with the verdict in this case. The defendant's employee lost the plantiffs pawned items. No question they're on the hook here.

It's really hard to believe that she left so much in value to only get $300 that day. I know that pawn shops don't pay top dollar, but I highly doubt the stuff she brought in that day was worth more than a grand. It's hard to believe that she left a $1900 Tiffanys piece (among many other things) and only got $300. Sucks to be the defendant though! That's why you take pics and keep details so they can't come back later and say "PAY ME 5k!"
I had a friend who worked in a pawn shop, he said that they offer 10-20% because they know people are desperate and hope the default as it's more profitable.
And she got more than the $3,500 for it. When you add on the money the pawn shop already gave her for it at the time of the loan. Even if they made her pay to get the electronics back which is highly unlikely, she still didn’t have to pay to get the jewelry back surely. So if half of the $300 was for jewelry then total she received $3,650. If they didn’t make her pay anything to get her electronics back, which they never stated, then that would be a total of $3,800. If that’s the depreciated value? I’m having a hard time buying the jewelry’s value also. And that’s probably why she didn’t bother to get more information from the previous pawn shop (other than photos). She knew it wasn’t worth all that. Materialistically speaking.
Surprised she didn’t try to sue for the finance charges back also. The judge would have surely said no to that as she would have had to pay that regardless but I’m surprised the plaintiff didn’t try.

ALL of the pieces of jewelry that she had put into loan at the pawn store DEFINITELY was NOT worth $3,500!! And honestly, I highly doubt that any of those pieces actually meant anything to her...she was just saying all that to butter up the judge...BUT... REGARDLESS, this pawnshop was at fault for losing her jewelry, and the judge wanted to make a point of that, in which she did by making the judgment in that amount!! 👍

When you pawn something, you sign a paper stating that you won't hold them liable for lost, stolen or damaged items, it's right on the pawn ticket, so by law she shouldn't have gotten anything. I'm glad she did but just further evidence that 9 out of 10 times JM will rule more favorably for women than men. I seen another similar case but it was a guy and the judge gave him nothing. It's not about law to her, it's about her mood in the moment. I love this show but JM really frustrates me at times.
