I've had my kindness taken for weakness many times. I give without asking for anything in return because it's the kind of person I am, caring and giving...I have an open big heart and don't much appreciate it when others question why I do what I do. You are 100% spot on! I get along with all of neighbors, except one. It really upsets what I have to do next. I've been given no choice, but to follow through. It's so funny, cause where I live at now, I have no trustees to tend with or be monitored. I've been living where I reside at now for the past 5 years and love it. Everybody is doing there own thing. You'll hear dogs barking, motorcycles starting up, hear all the wildlife around. Hawks, Owls, etc. I love hearing all that. If someone needs to borrow a tool or needs an extra hand, no problem. Everybody gets along..... All except the lady behind me. I feel sorry for her. I'm a doer and go getter, a motivated person, although this year has been real challenging. One thing I have trouble is tolerating someone who is lazy and is a blowhard, combine. If that is what they want to be, that is there choice. This lady has a tree that is overgrown and is really tall. When storms with high winds come thru, it usually has a few branches that land in other neighbors yards, including mine. A few years ago, a big branch fell and landed on her own fence. She has partially the fence on my neighbors property to the side of me so the fence separates her residence and my neighbors residence. She had enough balls to ask my neighbor if she would chip in to replace the crushed fence. My neighbor said that's her tree and she needs to pay and fix the fence herself since her tree was the thing that caused it in the first place. So what does she do? She gets the fence fixed which I'm shocked that she did and paid for it. She had enough balls to ask the other neighbor thou. But here's the kicker, when she hired the cleanup crew to cut up the branches that fell off of the tree, they did that. But for the tree? A few branches that were split and dangling from the tree, she had them cut those parts of the tree and that's it. The rest of the tree, as tall it is, did not have them trim that at all. She just had the tree cutters do the bare minimum. Cheap skate. Eventually there'll be another event with this tree and it'll be in some ones living room! A few years ago, we had high winds and rain, this time had quite a few big branches break off and land in my yard. One of them landed about 6 inches away from my Chevy SSR pickup. On one of my garages is a four car garage and I've got them filled with cars. Even if I was to get rid of one of my cars, the SSR pickup won't fit in the garage because of the height so I'm kinda screwed of having it exposed to the elements outside in the backyard on the driveway. So instead of cutting up the limbs and having to put them in a yard waste container wasting a few hours, what did I do? I would do what any neighbor would do. I picked up all the large limbs and put them in her yard, since it's her tree. So the next day or a few days later, can't remember. There's a guy picking up the tree limbs on her property. Turns out, it was her brother. I let him know that all these limbs, I put them in her yard cause it's her tree. I was being nice to the guy and told him about one of these large almost landed on my truck, but I also let him know it's not just me having the problem with the tree, but with other neighbors as well. I was being polite, nice and friendly. Never seen these neighbors before. He was being nice and friendly stating, eventually they'll trim it down. I'm cool with that. Well the guy was working in the backyard for hours cutting up the limbs. I happen to have one of my other cars in the driveway around back. I was busy taking out dings out of my car. One thing that is amazing is how one's voice carries. The guy that was cutting up the tree limbs, his sister who owns the property comes out and is mouthing off about me to her brother. She doesn't realize I'm in the back and can hear every word she says. It was rather cute and funny. This lady must've been in the Navy cause she cusses like a sailor. Her mouth is like the Bermuda Triangle, a lot of sea men got lost down in there! Lol! This lady doesn't know me. She went on for about 10 minutes. Ripping on me, my cars, how I look, whom I'm politically affiliated with. She thinks I'm a silver spoon by all the cars I owned. That really pisses me off! That was a lot of hard work to own a Plymouth Prowler, a 356 Porsche Speedster widebody, 2 custom Mr2 Spyders and a Chevy SSR pickup. It took dedication and hard work to have these and I feel very blessed. Some were bought, some were built with my hands. When I look at these cars, I love looking at them. Actually, getting better with streamlining vehicles. After my father had died, I sold his Denali pickup and his 23 T Bucket. So there is 5 vehicles I'm down to, but like to get it down to 4 so I can build a street rod. This lady has got me all wrong. So what did I do? I went by the fence and told her to come by the fence. I told her I could hear everything she said. Her voice carries. I told her to not be a coward, if you got something to say, say it to my face. I was pissed, but I kept my composure to the point I restrained from violence. I told her that if this tree lands on my house, I'm suing her for everything. It's not an act of GOD and my insurance won't be covering it....... you will! I'm notifying you now get that tree trimmed. So what did I do a few minutes later? I was unable to apologize to her but apologized to her brother for my behavior and told him to tell her I'm sorry. Big mistake. Two years later. Nothing. Another limb almost hit my truck again a few days ago. So what did I do? Put the limb in her yard. Her yard. Her tree. Well today, that same limb is on my property again. I put it on her property again. That was her brother doing it too. Cause she's a 300 lbs. mouth breather. She would be out of air before she made it to my yard and back with no breaks in between. That was the last straw. So, on Wednesday, I'm going down to city hall and explain the situation. Maybe have them come out and look at the tree themselves and have them do an assessment to determine if they need or her to trim it down or not. If not, even though I won't like it, I'll honor city hall decision. If determined by city hall there is neglect, they'll be notified. That's a good thing. It's always good to have documentation. So if they refuse to trim it all, there's documentation and evidence there and if there is an event that occurs on my or any other neighbors property, it won't be considered an act of GOD but negligence on homeowner which opens them up to a lawsuit, a judgment on their property, etc. In most cases, when a neighbors tree falls onto your property like your house and car, it is considered an act of GOD and usually your own, not their insurance, has to pay up. So not only does your insurance have to cover the cost for some one else's tree, but your insurance will go up if you have to file a claim. Most people don't realize this. But if you have documentation presenting concern and they've done nothing to alleviate the situation after an allotted amount of time, you can go after their insurance company that's if they have homeowners insurance. If not, you will have to be reimbursed thru the courts if you win a judgement. If they don't have any money and can't pay for the damages. Good I'll take your house then. Wednesday is going to be fun! Let's make some things happen. :) Ready or not, here I come! LOL!
