    atty. under po ako sa bfar may public lands po na ni release ng DENR for fishpond development at eto po ay gtrnsfer na po ng denr sa jurisdiction ng bfar. at eto po ay pnpa lease sa mga applicants na gusto mg develop for fishpond via fishpond lease agreement.ano po ang massabi nyo dto?ksi po sabi nyo bawal e pa lease yung public lands.

    I have 2 buildings on 1 title lot 2 10159...I have since found out there is another title with water access carriage way that isn't registered with nswlrs ...council says they want the carriage way but some documentation for lot 2 10159 shows the title as being 1/323681 its prime mixed use town central land with a fee simple title I believe....can you help....

    Question po, we are in possession of a land since 1946. We have a record of paying tax declaration only up to date. But this year someone showed up that our land is theirs. They have a title release 2003 and applied 1976. What will happen to us?
    Our tax declaration doesnt show the lot numbe or any exact location of the land

    Sir may tanong po ako may lupa akong nabiling lupa total area is 11442sq.m sa BIRang zonal value nya ay divided into 3,first 20 meters CR sonal value nya is1250p/aq.m and second 30meters CRzonal value nya is 1080p/sq.m at ang huli ay agricultural zonal value nya ay 650 p/sq.m ang tanong kopo sa computation sa bawat isa poba sa 20m,30m at sa agricultural part so kung ganon parang napakalaki naman ang CGT At ang ONNET COMPUTATION SHEET ay sa BBIR poba na papel ito salamat po sana naintindihan mo ang tanong ko

    Medyo nalito lang po ako. Bale sa Civil Code po: 10 or 30 years ang prescription to acquire ownership over a land. Meanwhile, R.A. 11573 speaks na 20 years of open, continuous, exclusive, and notorious (OCEN) na lang po in order to register the same.
    Is the new law an amendment po ba of the provision ng NCC? What if po naka-20 years of OCEN na po ako but I am in bad faith (so supposedly 30 years dapat ako para maka acquire ng ownership) can I still have the land titled even if hindi pa po ako ang owner?

    Property p Rin Po db even if 2 separate lands when merge into 1; and a road is property p Rin but not a private property, but property owned by the state

      timberland or alienable and disposable land ba property nyo??sa municipal assessor's office po kumukuha ng tax declaration kaya mas okay siguro dun kayo magpunta at alamin nyo kung totoo ba yang tax declaration na yan

    Foreigner husband, Filipina wife. If the wife passes away the husband may own the land through inheritance but I understand the property (estate must be sold). No parents, no children. But a portion must be given to deceased’s siblings. Must this be done immediately after death? Spouse is homeless?

      You’re correct. A foreigner may inherit the land. But since the couple did not have a child, the foreigner spouse will inherit together with the parents and/or siblings of the deceased Filipino spouse. The estate should be settled as soon as possible in order to distribute the estate to the heirs. Also, that will save them from late payment penalties on the estate tax.

      @@TheHowsofLaw so am I correct in assuming if the foreigner spouse dies (more common), the wife must still divide the estate among mandatory heirs, leaving her homeless also ( assume the house and lot are the only assets)?

      No. If it is the foreign spouse who died, the Filipino wife has no obligation to subdivide the property because as the only Filipino citizen between the two spouses, she solely owned the lot. The lot or half of it will not form part of the estate of the deceased foreigner spouse because he owned nothing of it when he was alive thus, nothing can be transmitted by him to any heir upon his death.

      As regards the house, if it was co-owned by the couple, 1/2 of it becomes the deceased (foreigner’s) estate (as the other half belongs to the surviving spouse, in her own right),and subject to distribution to the Filipino wife and the deceased foreigner’s other heirs such as his own descendant (not of or with this wife) or ascendant or the siblings of the deceased. Now the wife as co-owner of the house (and a big part of it - more than half is hers) cannot be ejected from the property.

      @mythdiaz6596 The foreigner spouse cannot co-own the land, just the house. Improvements are not covered by the prohibition against foreign ownership of lands.
