    I think it’s not 1/3 merger but ONLY 2/3 merger is allowed

      The original act in 1985 spoke about 1/3rd, in 200 it was amended to 2/3rd.. So yeah you are right and Sekhar Gupta is Wrong..

      The original 10th Scheduled added through 52nd amendment in 1985 had both 1/3 rd for Split (Para 3) and 2/3rd for merger (Para 4).The Para 3 i.e. dealing with Split 1/3rd was deleted through 91st Constitutional Amendment Act in 2003.( There is a difference between split and merger) So, basically Shekhar ji should have used 2/3rd as provided in Para 4 of 10th Schedule.( 10the Schedule earlier dealt with Sikkim which was completely deleted and later 10 Schedule was incorporated as Anti Defection Law).There are 7 Paras of which Para 3 has been deleted and Para 7 which bypassed Judicial Review has been struck down by the Honorable Supreme Court in Kihoto Hollahan Case (1992)

      Rs.2000 per vote in Karnataka. In Mandya where HDK's son contested and lost, and in Hasan district where HD Revanna's son contested and won. That's what elects these crooks.

    Great to see that people here are discussing whether Shekhar pronounced Karnataka right or not, rather than the poor state of political affairs in the state.       Its vidhana sabha, Vidhana Soudha is the name of the building. When we are referring to state assembly, the technical term is vidhana sabha.

    Why do these 'shankar' character are still not debarred from the elections from going forward? Is it so rigid that given a government is formed and they have majority they can last for 5 full years and punish the very same voters who had elected them?
    Can't there be a President / Governor can intervene and 'nullify' the ineffective governments?
    Think about scenario in neighboring Tamil Nadu, there as well we have such an ineffective government but no one is able to do anything to them. Similarly in Delhi, we have a government who did not much to the people.

    My comments regarding R-Shankar. Since he is an independent, he is a self made MLA. I think he should have been a good person to have been chosen by the people over and above party lines. I am pretty sure he would have wanted an important post to have made some difference to the people. Since he was given environment, forest and ecology, I'm pretty sure he would have been shocked at the level of corruption by the officials in the ministry. If he had tried to root out the corrupton, his first move would have met with resistance and the congress party would have kicked him out the first thing. He would have been allowed to stay in the post if he would have been happy getting his hafta. The same would have been the case with the ministry of municipal affairs. There is a reason why the congress were reduced from 122 seats to 79 seats inspite of the huge support the congress enjoys from the bureaucracy. There is also a reason why the congress enjoys a huge support of the bureaucracy. There is also a reason why the congress and JDS MLAs have to run away to other states to get away from cops, undercover cops and goondas if they take a different stand from the party line. But I agree that people who can't obey by the party diktats should not be fighting elections on party symbols.

It is a wake up call to the electorate to give a principled and decisive mandate or suffer a wishy washy legislature. A lesson and message for all of India , not just Karnataka.

    : 1/3 MEMBERS of a political party in case of split got omitted as an exception from defection law.. now it the case of MERGER when 2/3 of a political party merge with other or form a different party.

    But, the law missed the whole crux. It should be if an MLA is resigning then opponent should lose equal MLAs, which shouldn't prevent them from standing in another election and serving their constituency. But their voting rights should be made void for the period of government along with equal reduction of its opposition.

    Well, I believe there is an easy explanation of this mess. When BJP was so close to the majority mark in Karnataka, the party which finished a distinct third should have realized this and let BJP form the government. Now sadly the person who is also ex-PM of India behaved like a greedy opportunist, put his self-interest over everything else. Got into the business of dalali with a defeated party which lost 50% of its seats it had won in the last election. All these actions resulted in empowering people like Shankar's of the world. When these leaders are such bad role models, how can anyone expect their followers to be sane!!! There is an old Kannada saying "Yatha Raja Tatha Praja" (People simply follow the Leader/King) which is apt to this situation.

    The problem is with the electorate, they vote for cash not for somebody who is morally incorruptible . you forgot to mention the great chandrababu naidu induced 23 mlas' from ysrcp to cross over to his party and he also made some of them ministers during 2014-2019 assembly period in ANDHRAPRADESH.The speaker did not take action till the end of legislative assembly term.It is better to scrap the law and help restore freedom of expression in legislative matters till people voluntarily realise and vote sagaciously .

    Shekhar Gupta ji, if anti-defection law is failed and should go, then how we can maintain the stability of the state and centre governments, like sarpanches in panchayats the CM and PM should be elected directly by the common voters so that the stability can be maintained. In last lok sabha elections the stability point is also considered widely by the neutral voters and they voted for the stable government.

Like in case of Mahashtra, Shivsena was part of alliance, many voters voted them as they were part of alliance. But post result the whole trading started. Such times are best for independent candidates.

    I would like to see that by constitution smaller party should be band from getting any ministerial berth in any coalition government, because public did not give mandate to be ruled by them. Also CM position should be reserved for the largest coalition partner, and junior coalition partner should be given only Minister of state portfolio in proportion to their number in the assembly. This way the smaller party will think twice before supporting any of the two largest party. This way the smaller party stay neutral and let largest minority party run the government. Vote on the merit of the motion.

    Politicians - are a reflection of our society!
    There were times, when the character of person was valued and people use to stand by the word. In today's society, there is hardly any value left for character & word. And, we all are responsible for it. Now, we expect the politician to be a good guy, conviniently forgetting this guy is the worst product of our own society(which is us). Till, we don't change our society(which is ourselves), we will have more & more such examples.
    Unfortunately, India which used to be respected for its character, is fast losing it. And, there is very little hope or maybe no hope, on the horizon.

    The situation in Manipur is also one of its kind. Congress, LPJ, Trinamool, Naga People's Front and NPP all in a BJP led govt. Infact the only state in India and also the only instance where Congress MLA is a minister in BJP govt. with about 7 other Congress MLAs openly joining the BJP govt 😆😆😆😇😇😇

    I think that the party whip should be removed all together. The members should be free to vote on issues based on their conscience. This should be the same for the ruling party and the opposition. Since the legislators are elected representatives of the people, they should represent and speak for the issues of the people in their constituencies and not be forcefully bound to the decisions of some third person (even if he is a representative of some other constituency). That is the real democracy. His first responsibility is towards the people of his constituency and not to be a zombie of a political party. In case of corruption by the legislator, it should be detected and exposed through some other means.

    Apart from national parties, all the regional parties are run by a founder / president have no democratic ethics expect prrsonal interests. Defection may takes place commonly since past. The present bill in force is to be ratified.

That’s all...if you are divided, your servants have free fun! Don’t be a party supporter but be a citizen to enforce your needs and rights!

    Anti defection law needs to stay so that it can make it difficult for defections which would frequently take place in it's absence. In every country there is political impropriety but the major difference is in the developed countries there is lobbying done to get the interests of the lawmaker accommodated in exchange for their vote while in India it is crudely done with either money or ministerial berth.....

    This anti defection law is anti democratic as it puts parties interests above people. Brexit is a standing example where the ruling party lost a secret ballot yet won the no confidence motion. That would never happen in India as parties would force an outcome that is anti people thanks to whips and anti defection law. Why is it that our democracy will run away from secret ballots. Even the party presidents are elected by whips. In some of our states (Delhi) as well as center there is no opposition leader. There is no one to balance the power except for an unelected RS or upper house in the state. In Karnataka people were not allowed a say as to who the CM should be it was decided by a mother and son sitting in Delhi. How is it democracy?

    Please put some light on Gujarat assembly defection issue, where congress poached BJP MLAs (led by Shankar sinh Baghela). It was very much congress' game till the time they found Shah like shrewd politician on the otherside, i know these incidents had almost given you heartburn, but sorry, you have to hear this alot in the near future too

    I don’t know whatever the law is but Iam from karnataka and I just want this jds/Congress govt to go.its basically govt run from the house of Deve Gowda and that’s why most MLAs of Congress are resigning because they treat everyone as thier slaves
