  • DAY 2 - WI v. Jessy Kurczewski | A Wisconsin woman is facing life in prison if convicted of killing a friend in her care by poisoning her with eye drops. Jessy Kurczewski, 39, is charged with one count of first-degree intentional homicide and two counts of felony theft in the 2018 death of Lynn Hernan. Waukesha County court Judge Jennifer Dorow presiding.
    Prosecutors say Kurczewski killed Hernan, whom she was caring for, and staged the scene to look like a suicide by drug overdose. Hernan reportedly died after drinking a water bottle mixed with 6 bottles of Visine.
    Kurczewski told police Hernan was suicidal and “had been trying to kill herself by drinking Visine in vodka,” according to a criminal complaint. Investigators say, in total, Kurczewski stole $290,210.06 from Hernan before and after her death.

      Finally somebody else has noticed it! I can't stand when people speak into microphones and they have the worst cottonmouth and they don't take a drink of water it's so annoying! I hear it on the judge shows that I watch all the time some are so bad that all you hear is smacking of their mouth.

    I feel sorry for the court reporter for having the camera on a closeup of her face for every testimony. That would make me a nervous wreck! They should move her out of view so she can do her job without having to be on display!

      I think it is important that she is close to witnesses to ensure she hears their testimony clearly. She does have to type every single word that is said! That is what would make me nervous!! LOL

      @@SunnySky7 I made that comment the first day. Since then I've been conflicted. Sometimes she seems to be very articulate and makes good arguments, and then it's like a different person steps in and screws it up. It's really strange. The guy attorney is just awful all the time though.. He should just be quiet, lol . I can actually see the jury being conflicted about the murder. Hate to see the financial hijinks send someone to prison for murder. Of course after Murdaugh, maybe that's just the way they do it. It will be interesting to see what the verdict is. Not nearly as impressed with the judge as I expected either. She's pretty sharp with the defense when it doesn't seem called for. She could do a better job of being impartial. Also, this is after watching Judge Carroll for weeks. Now that's a JUDGE

      The defense is only asking questions on cross to the stupid questions the prosecution asked in the first place. I think the defense is doing a great job to poke holes in the prosecution's evidence....lots of probable doubt here so far.

    Defence are doing a good job in highlighting incompetence and the inadequate response in the initial stages of the investigation. It may appear to be a lengthy process but the skill is to engender doubts in the mindset of the jury.

    The defense guy lawyer is painfully slow at talking and asks questions that seem to lead nowhere. What does it matter if the cigarette was lit on the correct end? He doesn’t seem to ask questions that lead to any type of defense. Also, why isn’t Jen Flowers on trial as well? She definitely is part of all this.

    I’ve attended accidental overdoses and most times it was syringes and such around, but there were plenty of times too that the decedent would be lying on their backs with a plate of crushed drugs on it, presumably from when they were using and laid back and overdosed and passed away without ever putting the drugs away that made them OD to begin with

    Detective Timothy Loberg really scares me. He says that he sees what he wants to see in the scene. If he thinks it's suicide, he sees suicide. After they tell him it's not suicide, he says it's not suicide.
    So why is he a detective.

    After listening to her medical report from the medical examiner, it does appear she was in massive distress of her illness. In additional many docotors dropped her as their patient.... Really bad medical staff not addressing her illness and her mental health.... This could have lead her to feel hopeless and did in fact lead her too suicide herself...Jessy did take advantage by stealing from Lynn but from this report from the medical examinier it seems more and more like suicide... Maybe the family should sue the medical proffessional who took part in dropping her as a patient and left her feeling helpless an in pain... This is a very sad case and it seems they are trying to blame the wrong person to why she actually died in the manner she did...

      With the drugs she was on and mixing there’s a real possibility she accidentally overdosed. Mixing Xanax with all those muscle relaxers, pain pills, sleeping pills etc that is an OD waiting to happen. I’ve been to many scenes of ppl who have accidentally overdosed and on purpose. I’ve seen someone who’s OD’d laying on their back with a plate of crushed drug’s laying on their stomach, presumably from using the drugs and laying back as you start to lose consciousness and overdose.

      I can see a lot of reasonable doubt.. although it’s strange that Jesse used visine herself in the past and did not tell the detectives this .. also in her interrogation she lied a lot .. especially about the use of the visine.. however … this could have been a stress induced confession or something like that … I don’t know if I myself would feel comfortable finding her guilty in this case .. I won’t be surprised if she gets off

    I'm just now watching this day 2 video for the first time. Is this defense attorney just winging it or is there a purpose to asking the officer how many other deceased bodies have had dog tags around their necks? And, why does he keep asking if the photos he's showing the officer were actually taken by the officer? This attorney sounds like he himself is viewing these photos for the first time. This guy doesn't seem to have any direction. I don't understand the reasoning behind most of his questioning.

    I wonder if Judge Dorow is going to ask the prosecutor to not use the phrase "is it fair to say"? Have to wonder if the victim was being poisoned over a period of time. She had abdominal pain which was unexplained and then she was complaining her soup gave her mouth sores so she quit eating soup.

      Where did the tetryzoline come from? Why would someone drink eye drops to commit suicide especially when there was other RX’s she could OD on. Doesn’t make sense.
      Someone thought eye drops would be untraceable.

    Random question, but why do we still need court reporters when court can just be recorded in real time and saved just like a copy of what the court reporter would be making but video? Seems like an outdated technology but I don’t have any Court experience so maybe there is a need for it that I don’t know 🤔

      The official record for appellate purposes is the official written transcript. Video of proceedings are not part,of the official court record and is not relied on for any purpose. So court reporter is key to the legality of the proceedings.

      When I googled the defence attorneys, theyre from a private firm as far as i can tell. Unless theyre doing this pro bono. I believe she is also being held in custody.

      ​@red___shoes I don't know how it is in WI, but in VA, all private criminal law firms are required to do so many PD cases a year. Not every jurisdiction has a PDs office here, so the Judge has to appoint attorneys from private criminal firms to represent the defendant.

    I like these district attorneys a lot better than the ones from the Darrel Brooks trial. This one seems to be a lot more put together than Brooks trial.

      the prosecutors from Brooks trial may have seemed a bit disorganized because they changed their case at the last minute when Brooks when Pro Se. That was just a few days before trial. The prosecution slimmed down their case. They did a good job considering.

    As far as I'm hearing, and like I said before. There's something wrong with this investigation, some incompetence is clearly shown, and hearing the detective saying that he barely looked at the crime scene, I'm sure he took as a junkie overdose case and didn't think that it was gonna go that far.

      I was disappointed with police evidence from the scene. Looks like the assumed suicide. Then everything else was overlooked.

      Because when she called 911 she reported an apparent suicide by prescription drugs so when the police came and interviewed her they investigated what they had leads too....the medical examiners office determines cause nd manner of death from the test done at there offices ....

    Obviously Jesse is guilty but I can't be the only one watching that thinks her lawyers are absolutely horrible! I am very surprised that the state's lawyers don't object to asked and answered multiple times, they keep asking the same question just in different ways and the things that they are pointing out or asking are not helping her case in any way, if she actually paid for these lawyers that is insane!

    Another point about the Detective. He is obviously lying. I am a private tutor, i teach programming. I have had thousands of lessons. I cannot remember all of the, but ask me to remember the last one, i'll be able to. So this "I have had hundreds suicide investigations, they are so frequent, but i don't remember the last one" is a clear lie.

      I don't think he was wasting time at all, he seemed to be demonstration that the defendant was already written in the decedants will and would already be entitled to her estate. She was also on palliative care which meant she was dying. This seems to rule out the prosecutions claim that Jessy murdered Lynn for financial gain when she would be getting it anyway soon. If there is no motive it will be more difficult for them to find her guilty.

    Omgosh I am about to fall asleep. It would be so much faster if they show the physical papers/documents etc instead of using computers. I get that times are so different now but still. Also this lady's defense is super weak👎, that can either be a good thing or a bad thing. But I've only started watching this trial yesterday so its gonna take me a long while to get caught up.
