4:34 sweet little moment from Briscoe letting the guy know his kids were watching so he wouldn't get too aggro. Even if Briscoe thought the guy was guilty, no kid should be seeing their parent in the middle of this situation.
6:34 I love that the Chief went on to become a judge. (RIP Lynne Thigpen.)

I'm guessing that she finally found Carmen San Diego.

The final scene is one of Sam Waterston's defining moments as Jack McCoy. He always gave the sense that he was never totally certain about what he was doing, and when he was arguing, he was trying to convince himself as much as anyone else. (Especially when compared to his predecessor in the role, Michael Moriarty.) The famous final episode of this season made sense of that: McCoy's father was a cop, and McCoy became a DA not so much because he wanted to but because he felt it was his duty.
His father was also a "drunk SOB." Jack McCoy struggles with the morality and ethics of the law, even though he has a strong sense of justice and what is right and wrong.
"Don't be dense, Douglas" 😂
I love Victor Garber in anything! Always brilliant!
He's hot here
I like that they at least put forth different arguments of why the death penalty is tricky. It's not just "I don't think we should kill ANYONE because execution/killing/murder is wrong" but "I don't trust the state legal system to NOT make an incorrect ruling 100% of the time, and you consequences can't be undone or recompensed." The stakes are TOO high and it's better to make a Type 2 error (letting a guilty person go) than a Type 1 (convicting an innocent). Because what if that was YOU on the hot seat. Wouldn't you want people to lean more into tripple checking your innocence than possibly killing you for something you didn't do?
That’s exactly how the system was designed. I forget who said it and I’m paraphrasing but essentially a founder said something to the effect of “it’s better 100 guilty men go free then 1 innocent condemned”
The exoneration of so many people who were wrongly convicted well supports that argument.
Isn’t the EMT in the beginning the same detective from Dexter?
Angel Batista!

David Zayas. He was actually a cop before becoming an actor.
1:01 I did NOT Expect MR. Andrews to be in Law and Order.
Me neither

Or Argo. Or Alias. And countless others
I miss Jerry Orbach (Lennie Briscoe)
❤❤❤❤❤❤
Absolutely
I definitely miss ol' Lennie Briscoe; he was a big part of L&O history and one of the show's fan favorite characters.
RIP Jerry Orbach❤
Awesome legal vs moral discussion in this eps!
David Zayas. I swear, if you watch enough episodes of Law and Order almost every actor has either gotten some of their early parts there Or cameo.
90% of the OZ cast has been on ...New York actors I guess
My friend is an actor in NYC and has been on L&O twice. He says it's the law of averages. 🤣🤣🤣
The title is so funny when you think about, beloved character actor is poster child for the death penalty lmao
TRIVIA NOTE: Victor Garber once starred in a production
of " GODSPELL " .
Also starred in the MOVIE of Godspell.
Victor Garber was the original Anthony in Sweeney Todd.
and he played the role of Thomas Andrews the ill-fated cruise ship's shipbuilder in Titanic
He played Jesus in the movie version.
I got to see him in 3 different shows on Broadway. ❤️
This is one of the most heartbreaking moments delivered by victor garber.
I own the dvd to this season. This particular episode is out of sequence. The first scene is after the trial is over. Also, I love Van Buren taking a shot at good ol' Mike Logan!
I remember this episode. Quite haunting and with a most heartbreaking performance by Victor Garber. 💔
7:35- Don't be dense, Douglas.
David zayas (who played detective Bautista in Dexter) is the csi worker in the very beginning of the video, I also just saw him in another law and order video where his son was assaulted. Not the same character, but the same actor both times
"It's unlikely."
C'mon, Jack.
chief from where in the world is carmen san deigo and mr andrews from titanic i love it
Why does this show keep going on about the death penalty when the death penalty in New York had stopped at this time
It was made in 1995 shortly after the governor of New York reinstated it
Benjamin Bratt just doesn't come across as a tough guy, no matter how physically aggressive he acts.
So I see Spydaddy is doing another undercover job
Excellent acting all around
In the past I enjoy looking at this T .V.📺 Series.
I love the people they get to be the judges. Like the Chief from Carmen Sandiago (and the moon from Bear in the Big Blue House) as the judge in this episode. And whenever they have Maria and Gordon from Sesame Street, I smile.
Also...was that angel Bartista from Dexter as the EMT at the beginning?
Lynne Thigpen (the judge) was in the Godspell movie with Victor Garber.
They missed the best part where he and his wife beg for his life in court
6:35 Nice Miami Vice reference there, Your Honor.
what if that person, any person who has been accused and sentenced to death is innocent...? after those checks and balances are already been through...?

@@Feedback72 stupid? You'd have to be insanely malicious and powerful to fully get past all checks and balances. McCoy used the correct lawyer term: "unlikely", but that doesn't emphasize just *how* unlikely it is.
@dfmrcv862 21 people have had their death sentences overturned because of DNA testing that wasn't available at the time. And those are just the ones that the system caught before it was too late. Are you ok with killing 21 innocent people just because it is unlikely they would be innocent?
Death is irreversible. You can free a man that you mistakenly locked up, but you cant bring him back to life.

I can't live with "unlikely"... I could never be on a possible death penalty case, as I'm biased towards the constitution protecting the right of all citizens to be free to enjoy life, liberty and the pursuit of happiness. I also believe vengeance belongs to the Lord, not me or any other human being who are prone to mistakes.
1:00 Hello Mr Callahan. Looks like you losing the Brooke Windham trial did you so bad you lost your your job as a lawyer and ended up in a different show entirely.
One of the few cases on the show I was on the side of the defense lawyer. Not at trial mind you (Prison was made for people like the defendant), but at the appellate was with the deference on that one.
We can't even get these old L&O episodes on Peacock. Seasons 1-12 can't be streamed.
Where can we find them?
@@mrvincentjacksonno place I know of.
Briscoe was Best.
I'm generally against the death penalty, but in certain cases of heinous crimes, it's more than warranted. My doubts are around the certainty of the verdict, and that can be addressed by imposing an even higher standard of proof - higher than "beyond reasonable doubt", payslips perhaps a formulation of "beyond all practical doubt" - required to impose capital punishment.
Why is the death penalty so expensive?
@nateoverthehorizon1176 According to a quick google search, the issue comes down to the fact that most killers can't afford lawyers. The state has to pay for that person's lawyer. And trials and appeals can take years.
Like the other person says, it's not the execution itself that's expensive, it's all the trials and appeals. That's where liberals are confused.

there are episodes where Jack has put away innocent people or has discovered that innocent people have been in jail for years or decades.
he himself has failed at keeping innocent people out of jail, i dont know how anyone who has put an innocent person in jail can still be in favor of the death penalty.

Nice to hear Sam Waterson before he lost his good voice.
Anyway this kinda of crimes that includes narcotics are a serious matter
i always felt this episode was also trying to prove a point, like if it was some black dude from the ghetto that killed a cop in cold blood, no one would be arguing a needle in his arm, but because it's some rich white dude with an expensive lawyer, now we need to consider it's morality?

Just out of curiosity, who plays as the dead bodies in all L&O episodes such as the man who was shot dead in this episode?
The actors and actresses of the murder victims who never had screen time before their lifeless bodies were discovered were left uncredited. Those who did have screen time were credited.
I’m curious about who played the people who didn’t have screen time before their murder and why they aren’t credited.
Any who play only the dead body on L&O are considered an 'extra' or a 'background character'. Extras and background characters aren't credited in movies or shows, because they're considered part of the setting, don't have lines, and/or aren't even at the center of the scene. Tobey Maguire's first film role was "The Wizard" but was uncredited, because he just stands next to three other kids including the antagonist, Lucas, without saying a word. Any kid could've done that. If Tobey's character said at least one word, then his name would've appeared in the end credits.
Any uncredited L&O extras may be people aspiring to become famous stars, anyone off the street who happened to be on the day of shooting, or even fans who begged to play the dead body (Many fans ask online and even record themselves playing the 'dead body' to get on L&O). If any who played only the dead body on this show got acknowledged in the credits, then everyone who was ever an extra or background character would want the same recognition.
Kevin Costner played the corpse in "The Big Chill".
@@latinguy67 Which was also uncredited, and Kevin became a famous star. Bruce Willis and Brad Pitt's earliest films were also as uncredited 'extras'. Some make a living as uncredited 'extras' in films and shows. Playing the 'dead body' in an L&O series has the chance of meeting L&O cast members, appearing on tv, and potentially getting discovered in Hollywood.
@latinguy67
Costner originally had screen time in a flashback scene but it was cut before release So you would have had speaking parts
I believe non speaking parts Don't require sag/aftra
As a Texan, I don't believe in the death penalty. It's not our place, in my opinion.
What'l it's really like playing against pose
187 likes in a murder video 😆
Typically the acting is so bad in these shows that it is funny when they try to make legal arguments. However, this episode was different. Both the defense and state presented expertly crafted arguments for both sides of an issue.
Omg Bautista ?! What are you doing hereeee 🥹
the titanic sinking must of really affected victor garber hard if he had to resort to murder
It's amazing how shows like thisnjust gloss over the fact they beat up the wrong suspect in custody, but it's OK because they got their man in the end 🙄
Whenever I watch the season 5 episode of SVU where they find a headless boy in a park and look into Santeria until they find out a pedohpile bought him and killed him bc his wife was coming hope, when they threaten him with the death penalty, he says "No one's been in executed in NY state in (some odd) years." Someone forgot Sandig xD And that addict (played by Isabel Giles pre SVU) who killed that cop, that 18 year old who beat up a delivery guy bc him and his friends couldn't pay him.
Why cause he white and got a family. Good honest people should stop committing crimes.
There was another episode with an 18 year old boy. he and his friends lure the Chinese delivery man and beat him.
Upon hearing his groans and realizing he was still alive 1 guy picked up a brick to finish him off because he saw them.

detective curtis is the absolute worst.
8:12 that WOULD be a good argument, except the alternative to the death penalty would be to pay for all those prisoners’ food, shelter, security, etc for a lifetime which is most likely more expensive
No it's not. The appleas alone make the death penalty more expensive.
2:18 Indoor smoking 🤪
Too bad New York got rid of the death penalty. But let's face it, it would just be like California where they would keep them on Death Row until they died of old age unless they waived their appeals.
10:20 "What if someone falls through? How do we rationalize that?" I honestly get so annoyed with death penalty objectors using such lines. In instances like the fictionalized scenario shown here, the CPA killed a cop so he wouldn't get caught. The fear of losing one's family, job, and quality of life by being sent to prison is not a valid enough reason to kill. So yes, that criminal must then forfeit their life & there's nothing, absolutely nothing, they can say to justify the act. The unfortunate reality, however, is that it'll be a decade plus before the needle gets stuck into their arm, resulting in our tax dollars funding their food and lodging. And that fact sucks.
“I honestly get so annoyed with death penalty objectors using such lines”
Except it’s true. People have been convicted of murder “beyond a reasonable doubt”, and then been posthumously declared innocent after being executed. What SHOULD annoy you is a system that allows for executing innocent people
@@GabrielRodriguez-oe9li : Less than 1%. And before you ask if I (or the majority) can live with those odds, the answer is an emphatic yes. The system will never be perfect, and I'll admit it needs major revision to catch up with the times. But if we simply imprison convicts for life instead of offering a more fearsome deterrent (since some are apparently okay with free room & board at the state's expense), then that's arguably a far more tolerant society that will continue to get preyed upon.
So while the odd innocent person gets convicted & it's a tragedy for sure, it shouldn't influence the abolition of the death penalty. If one person in 1,000,000 were to die from flying instead of driving, would this mean we should ground all aircraft and never fly again?
@@GabrielRodriguez-oe9liso instead of fixing the system or becoming stricter we should do away with it?
👍
"He's white, he's rich"
WTF does that have to do with anything?
Are you serious? Everything. Stop being willfully ignorant!
There’s been an enormous discourse lately that rich white men in particular have gaming the system, whereas poor people of color are unfairly treated with overly harsh sentences that rich white people would never receive, and there has been tremendous outcry for the judicial system to balance the scales.
holy cow that turned boring...
I have a legal argument against the death penalty that has never been used. Slavery is illegal. The state can not legally destroy that which it does not own. If you have a dog that attacks someone and destroys the animal, it is a defacto transfer ownership to the state. When the state confiscated illegal drugs because they are illegal, that too is a defacto transfer of ownership. If it weren't, then the state couldn't try people for possession. Given that the state can not legally own a human being, the death penalty violates the law.
and it is wrong
I love how many people exist that don't support the death penelty. Even in this episode they try to make the argument that living is a fundmental right. Yet what about the victims. They didn't get to choose when their last breath was. More and more in this country we seem to want to pity the criminals.
It's entirely because there is no way to definitively say someone is guilty or not in some cases. Some cases have seen cops use threats during interrogations to get false testimonies, sometimes bad DNA testing was done and used against people that were innocent. One thing to consider about law is that it's not about every case, though laws affect everyone, you have to account for the rarest of possibilities. I don't disagree with the death penalty morally speaking, but purely from my own personal logic. It's better to be in a system that can give the falsely incarcerated the avenue to be able to go free, than it is to have a system that potentially puts innocent people to death.
Probably because we believe in being a society where people have the capacity and opportunity to change, and not one where we simply discard wrongdoers out of hand.
@@hippiejesus3363statistically speaking, innocent men on death row is anomaly, especially with modern technology providing evidence.
@@KS-qr1ry It's not that big of an impossibility. It's happened plenty of times.
"deprived the community of someone essential to its wellbeing" I thought he killed a cop, not a doctor or a firefighter?
Why does it cost over a million dollars to kill someone?
Part of it is that the drugs used in lethal injection aren't cheap, but the real culprit is how long the appeals process is. When you have a trial, a sentencing hearing, an appeal for the trial, and an appeal for the sentencing hearing, and possibly an appeal to the Supreme Court if the convicted party decides to fight it out that long, the hours spent on the case by the DA's office really stack up. Even if those hours are salaried, not billable the way private attorney's hours are, you're still looking at a respectable fraction of the personnel budget for the whole DA's office.
