There was this guy on a university campas that made a panini cart and was selling paninis for around $3, the faculty said that he had to take down his business because you weren’t allowed to sell food on campas, the very next day he was out with his cart now saying he sold paper towels, one square for $3 and with every purchase you get a free panini.

I always figured that food-related lotteries were based on the idea that you're paying to get the guaranteed item (food) and entering to have the chance to win something extra (another portion of the food or a prized item). I honestly never thought about the "no purchase necessary" part... now the legal loophole seems so obvious.

Back in the 80s and early 90s my dad used to have the hobby of entering contests using the alternate methods of entry. He called it his therapy. He spent probably 10 hours a week filling in index cards, addressing envelopes, and reading the newsletter that listed all current contests. Often, you had to be between the ages of 12-18 for a kids prize, so he would put our name down. We ended up with a lot of stuff, even a couple of free trips. Bikes, toys, electronics, office supplies, clothes, kitchen appliances... it was pretty cool, actually. He kept all his supplies in one of the space-agey looking briefcases (pretty rare in the mid-80s)... and he'd sit down in the evening in his study and pop open his briefcase and start hand-writing name, address, and phone number on a 3x5 index card... over and over and over.

    Matpat:
True, "a lot of people" entered "the" giveaway by paying money to place a to-go-order but technically speaking, "you" could win prizes in the contest without paying Red Lobster a dime by "" downloading the app and registering an account. "This means that" Red Lobster "can" advertise the sweepstakes as no purchase necessary, thereby meaning that they "didn't" meet the legal definition of gambling
Literally the next paragraph is a repeat of the first paragraph except (the words in quotation marks) "a lot of people" is replaced with "the vast majority", "the" replaced with "that", "you" with "they", "didn't" with "don't", "This means that" with "This allows", "can" to "to", and added "simply" before download
I'm wondering if that was intentional (if it is, what's the point of saying almost the exact same words twice) or if it's a typo/mistake in the script

    • @Canadian_Teemo
      @Canadian_Teemo Před 2 lety +46

Not really a "good" theory, as it is just finding the blue print / dimensions of the stadium. Then find the volume of the type of cereal you want.
It depends on what ratio you use for your milk and cereal.
Assuming you want pure cereal and cereal is thrown in at random, then the cereal would fill about 50% of the volume of the stadium, if you want to fill it all the way due to the air in stacking. For milk it is 100% of the volume of the stadium, (again if you want to fill it).
The ratio is a bit more tricky, but still just the volume of cereal, the stadium and the fill rate you want of milk / cereal.
So a video would probably be about 5 minuts at max, and then it would just be math and math. So I dont know how many would watch that.

Thing about the AMOE, is that technically not everyone has to purchase the bars or the tickets even. Some people are willing to just give those away.
But the thing that I think also helps companies get away with sweepstakes like this is that you're not buying the sweepstakes, you're buying the product as you normally would, and choose to enter the sweepstakes at your own will.
I mean take McDonald's Monopoly thing for example. I buy my normal McNuggies meal with some fries and a drink, and those fries have the little peel-off piece on it that enters the sweepstakes. I didn't purchase the meal for the sweepstakes, I purchased it for satiating my hunger. The sweepstakes was just a wee bonus for something I do on a regular basis anyway.
I think that's the drive for most of these food based sweepstakes. People buy the product anyway, regardless of the sweepstakes' existence, and just acknowledging that is enough to accept that you aren't buying the sweepstakes entry, you're buying the product.
Another part of that "consideration" part of gambling law is what you get for paying. As long as you get something, it's not gambling. At that point it's not much different than a gacha or a raffle. You may not have gotten the grand prize, but you still got those fries you ordered, and were gonna order anyway. It's kinda why video games can get away with lootbox systems or gacha-based summoning. It's not illegal because you always get something out of it.

The "Magic Cans" segment reminds me of an event when I was 9 or 10. I usually didn't ask for anything when out with my parents, but one day, riding in town with my dad, I just exploded into a huge tantrum, screaming that I want a soda. I think my dad was too shell-shocked to correct my behavior, because he just took me to some vending machines and let me pick out a drink. I chose a can of Surge, but was confused to find out it wasn't a can, but a compacted t-shirt with it's logo and enough change to buy another drink.

@@abdullahgamer2134 You just reference a time in the video. For example, in my comment, I referenced 11:00 and that'll take you to that point in the video if you click (or tap) on it.
CZcams just automatically formats it into a timestamp. Welcome to CZcams!

In Canada these things just have a "skill-testing question" attached, making it technically a game of skill not chance.

its even better than that: you ARENT paying to enter any of these giveaways, you enter for free, your actually paying for food and nothing more, so point 3 for consideration is invalid anyway

the timmies roll up the rim rules do include "no purchase necessary", and "No purchase entry method available (must be postmarked by April 3/22 and received by April 10/22)." but it doesn't say what you would be mailing them. And the full rules aren't available as the content ended earlier this month

@@scottieyoung2000 Tim Horton's actually has a decent presence in the US, maybe that's so they cover both sides? I've seen other Canadian contests include that too, but plenty that don't. Whether places choose to include that or not, the "skill-testing question" part of it remains a thing specific to Canada. Looking at the wiki again just now it seems that Tim Hortons even had a winner disqualified for answering it wrong in 2008. (though she fought it and eventually got the prize)
