The child would likely have to go with CPS if they did that.
Additionally, once they file the charges and process them into holding, it likely isn't up to them to dismiss the charges. Either a more senior officer or DA would likely have to do that.
Long and short, kid would likely end up in foster care as a result and they would likely be endangering their career.
Would be easier potentially in a smaller area sherrifs office. But they work for a city PD with more oversite.

Ever wonder why we're spending more and more, but the encampments are growing, and are everywhere? As soon as they solve it, it stops being a justification for them to tax and spend all those millions, millions that increase the political power (and the incomes) of those in power who do the spending. So their incentive is to subsidize it. Not toward a total fix, and not spending the money all that wisely, but just enough so that there are ones like this mom and son who have to be turned away, possibly ending up in one of those encampments, becoming their seed corn for the next round of spending.

My husband and I were kicked out of where we had been living for over 6 years for them to do a little spit shine and then charge almost double. A new management company took over a month or two before they kicked out probably at least half of the people in the complex. Then they had the guts to charge the people that lived there for a majority of the renovation they did after. And the reasons they were giving were a bunch of BS (like one was about clothes lying on the floor) and then not answer or get back to you in the time we were told to rectify it. They're talking about things like fire code, the hard cap on the number of people that can be in a building. The state doesn't say "only X people can sleep here because it's a shelter."
And contextually, this must be an atypically cold winter night in California, so the shelters are all much more slammed than usual, which is why they can't find another spot.

It's not as simple as giving the mom a minor charge and having her sleep in jail for the night. The issue is she's got a kid and if she gets arrested and no relatives can take the kid, kid's gonna go to foster care and it's gonna be a mess for the mom to get her kid back even if she finds a new place to live. And most parents would rather keep their kids at all cost because you never know what kind of foster home kids end up in (optimistically, a nice one; statistically, not a nice one). Sadly, until she can find shelter with a friend or family or a homeless shelter has an opening, they gotta sleep rough.
