  • On April 29th, the documentary, "Michelle Malkin Investigates: Railroaded-Surviving Wrongful Conviction" aired in Cinema Village. Jeff makes an appearance in the documentary, as do exonerees Brian Franklin and Ray Spencer in the course of Malkin examining the Danielle Holtzclaw conviction. The film won the "Film Heals Award", which is given to filmmakers that use the power of film to promote peace, justice, equality, and humanity. A talk back session was held afterwards in which Jenny Holtzclaw (Danielle's sister), DNA expert Eric Fuchs, exoneration attorneys Craig Cooley and Oscar Michelin, and Jeff participated in, is also attached.

    What happened to the liar that falsely accused Brian of this? This is what I would like to know. I think there is way to much of this going on these days. And there definitely needs to be strong repercussions of falsely accusing someone of a crime.

    I'm living a nightmare because of a wrongful conviction. false alligations a corrupt cop, and a conflict of interest. my public defender's are personal friends with the person who helped my ex wife do this to me. nothing was used in my defense. I went straight to prison and never saw my son again. and now that I have this wrongful conviction on my record. it's happening again. I'm being mistreated by law enforcement officers and was arrested for aggravated stalking. I'm facing 15 years in prison. I did nothing to anyone and everyone is lying. I'm scared for my life and desperately need help exposing the truth.

    I'm a naval cryptologist veteran who finds these cases heartbreaking. I once took an oath to support and defend the U.S. Constitution. Secret hearings, witness bullying, false DNA reporting, biased detectives, lack of evidence, mishandling the chain of evidence, and the character/integregrity/history of the "victims," is questionable. The judicial system and police department's behavior reminds me of the East German Stasi. Convicted of rape with NO DNA or any other evidence or rape kit being done? Really? Last time I checked, Oklahoma has a petition to succeed from the union, but it has yet to pass as law. They still fall under the U.S. Constitution, which in the case of Mr. Holtzclaw was railroaded, hi-jacked, and thrown out. The prosecutor's closing argument is perjurious. He may not have been sworn in like a witness, but an officer of the court should be expected to tell the truth in a courtroom, before a judge and jury.
    Shame on the judge, DA, and police department. Residents of Oklahoma City should vote corrupted officials out of office/from the bench, because THEIR rights are being violated under U.S. law. If it happened to a police officer, what chance does any law abiding citizen have? I proudly signed the petition. Godspeed his release, and all the other innocent men and women sadly imprisoned by their own local or state corrupted judiciary officials. It's up to ALL OF US to change the world and make it the planet it should be, we all just need to say, "Enough is enough."

      I'm a proud supporter of the Innocence Project and the Illinois Exoneration Project, so I'm right there with you. But, until prosecutors and judges are held criminally responsible for grievous misconduct and corrupt leading to the imprisonment of an innocent person, we will continue to see innocence convicted. Society needs to understand that the wrongfully convicted could very well have been anyone of us or our family member or friends. When a innocent person is convicted then the victim hasn't received justice and are forgotten. And, the guilty person is out there free.

      How about 263 years for Daniel holtzclaw with not one piece of forensic evidence? He’s still in prison and when you look into that case it’s beyond obvious he’s innocent. The system is so corrupt . It’s all about money and power not justice. It’s a big farce.

    I often fall down rabbit holes when on CZcams, it’s odd how things get clearer as you seek a completed story. I saw Daniel’s investigation from the detectives interrogation after watching a video of an actual guilty police officers interrogation, such different body language and wording of questions. As I began watching Daniels I almost stopped because of how vulgar the detectives were, Daniel remained calm even as the female detective began to talk about which hand she used to masterbate with. Daniel did not join in this conversation but laughed a very nervous laugh, this was clearly not a comfortable conversation for him. A man accused of the vulgar things they charged him with would have no problem following right along in said conversation. If an interrogation is to be used as evidence it should only be allowed in its complete form, not snip it’s. I think if the jury had watched it cold as I did they would have never convicted Daniel! ❤️🌎✌️

    Sometimes, the jury gets it right.
    I was Uniformed Patrol for 9 years and I've listened to Holtzclaw's original interview by the investigating detectives. Its astounding how many things Holtzclaw did which can only be explained as astounding stupidity or an attempt to cover his tracks.
    Specifically:
    1. Conducting stops off duty,
    2. While your radio and data terminal are off,
    3. Conducting a search of person and vehicles,
    4. Of lone females,
    5. Who you removed from their vehicles and placed in your car
    6. All while not logging or otherwise documenting the stop,
    7. Not notifying a supervisor (during or immediately after), that you'd made the stop.
    8. And doing this MULTIPLE TIMES.
    In the end, Hotlzclaw's inexplicable errors left the jury only one viable option, conviction.
    Jesus Fucking Christ, if he had just scribbled the names of these women and the date he stopped them in a Field Officer's Notebook, he'd be a free man today. I wonder why he didn't?

      @Chad K I'm not aware he logged any. If he did,I'd like to see the evidence.
      The other factors still remain.
      I'd see DUI's all the time driving home. I'd call the CHP. It never even occurred to me to attempt a stop.

      Imagine how hard it is NOW to get 12 people to sit on a jury, then imagine how hard it would be to get 12 people to sit on a jury when they face legal liability for their verdicts.
      I'm also imagine that the 5th Amendment prohibition against self-incrimination would find itself extended to jury verdicts, crashing the entire justice system.

      Thank you, I have family in law enforcement and was going to ask them about after finding those items odd myself during his interview. When he says that early on, the Det called him on it, seemed very strange. I also thought it was off, the 1st victim to come forward, that he put a potential DUI in his car, but no field sobriety ? AND let her drive away even tho she had no DL ? C'mon...guitly AF

      I personally can attest to the fact that this is a common practice in San Bernardino County California. The City of Yucaipa S.B.C. Sheriff Department routinely have falsey arrested my son (Daniel Lee Waterman) for crimes he had nothing to do with. Each of the 5 notable events Daniel was hunted down, arrested, hand cuffed behind his back and brutally beaten by Yucaipa Deputies. The deputies were (their words) "building a substantial criminal arrest record". "Not a conviction record".
      With each "false arrest" and "subsequent beating in hand cuffs" "in custody" Daniel would be kidnapped and beaten severely by Yucaipa's deputies the roughly 2 days later he would be released "without being charged".
      The Waterman family (or counsel) have never been able to get a copy of the police report/ arrest report or charging document laying out the reasonable suspiscoun needed to get a judge to sign a warrant for arrest and by who, where, when and at what time.
      Currently, my son is locked up in Donovan State Prison doing life for yet another crime he did not have anything to do with. Yucaipa Sheriff Deputy Detective Daniel Whitten LIED in several of his sworn declarations, fabricated evidence to implicate
      Daniel in these crimes. Crimes that all parties involved in this case "absolutely knew Daniel did not commit and possessed evidence proving Daniel innocents. In fact, there is documented proof of the trial court judge (J.David Mazurek) instructing the prosecutions star witness (accomplice and involved) Rikki Johnson on exactly what to say, when to say it and how to change her previously given testimony from accusing her then boyfriend (Joseph Johnson)as responsible to now accusing Daniel Waterman of these same crimes. The judge did this twice. Daniel invoked his 5th to counsel, who never informed the court. Daniel then "FIRED COUNSEL". Who refused to be fired.
      It's important to say "counsel (James Rankin Gass) never once met with Daniel to discuss the case". He also never once contacted any of Daniel's 6 witnesses about what they knew about the case. "James Gass failed to call a single witness at trial"!
      James Gass also made practically zero objections throughout trial either to contest what was being said at trial or to protect Daniel's rights om appeal.
      When Daniel refused to take the stand, Counsel Gass said to him "you hear what they are saying about you. What have you got to say for yourself?
      Daniel told him " what do you want me do, make something up? It's like I said to your investigator, "I was not there. I don't know what happened."
      So James Gass then responded with "well, if you're not willing to get up on the stand and say something in your own defense, then why should I?"
      James Gass then informed the court to "Just give my guy life!"
      And they did just that.

      Additionally, at this point in time my son (Daniel Lee Waterman) is DIEING. At only 32 years old and having spent the past 10 years locked up wrongfully convicted, the system is adding to the injustice "wrongful death" due to the Ca. State Prison system refusing to treat Daniel for his very treatable (No. Curable) condition that they were aware of from day one, untill now. Where Daniel was given roughly "3 months to live"!
      Complications to stage 4 liver cancer from the failure to treat his Hep-C condition.
      Well, now the San Bernardino County Sheriff deputies of the City of Yucaipa's Office have not only falsely arrested, beaten in cuffs, tortured, stocked and harassed Daniel for years, they now are effectively responsible for his slow and painful death.
      The god damned courts can't even see their clear to release him to go home to die with a little dignity.
      So, yes. You are right. The wrongfully convicted are not the only ones who are sentenced and suffer when these cases of injustice take place.
      Soon, the only questions left to answer are "where to go with it from here?" "To what end the reconciliation must go to cure the wrongs committed by all involved?"

      I am sorry this happened to your family but if I may offer you a piece of advice, you have to shorten this story. A lot. You can detail later when asked but your initial citing of the case needs short specific overview of facts. This is just way too long, you lose the attention of readers.

    It shouldn't take 15 years before a person is deemed to have had enough..we don't see alot of wrongfull concictions take place before our eyes..were used to seeing it on the other end.. when it's over turned and it brings us back to when we were Young and watching them being sentenced.... after watching this the last few days.. I can see how they tarred and feathered holtzclaw.. I was actually under the opinion that he was guilty... I admit that public opinion had me convinced when I seen it 3 years ago..but now that I know what MSM is all about..my opinion is of great concern that if it can happen to a cop ..it can happen to anyone

      Anyone that knows anything more than what they saw on tv knows he’s innocent. Just the fact that there was 26 accusers and 26 crimes scenes and no forensic evidence, No direct evidence supported the allegations of sexual assault that led to charges against Daniel. The complainants' claims also contained numerous contradictions, including exculpatory evidence that the prosecution ignored during the investigation.anyone that has done more than watched the tv about this case and has half of just one brain cell would know he’s innocent. Some People do not realize how ignorant they sound when they disagree with his innocence. Forgive them, they are not educated with the facts so they are talking out their ass.

    Michelle is a big supporter of the innocence of Daniel Holtzclaw, she advocates his innocent. She has dedicated a significant amount of time and effort to his case, authoring multiple videos and articles on the various issues in his case. Holtzclaw had a history of stopping poor women and demanding sex..thankfully he finally got caught... Conservative digital TV network, CRTV, posted a billboard in the neighborhood of the victims with his picture stating "what if he's innocent" jezebel.com/company-removes-billboard-speculating-that-convicted-se-1789310962 This is and of itself wouldn't be so bad if this so called conservative channel post billboards for the numerous folks that can prove their innocence but are still incarcerated !
    The police department failed to monitor Holtzclaw after two incidents in 2013: one in which a black man died after Holtzclaw and other officers restrained him, and another in which Holtzclaw allegedly assaulted a black woman outside of a restaurant. ...
    After assaulting one of his victim, Holtzclaw friended her on Facebook and visited her house uninvited in his personal car. He ascribed his irregular dealings with all of the women as part of his job: “That’s good police work. You can run warrant searches. You can talk to them … you can find intel based on what their stores are and see if they matched up.” Yeah right.....!!!!
