The New York Convention, also known as the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, is an international treaty that provides a framework for the recognition and enforcement of foreign arbitration awards. The Convention was adopted by the United Nations General Assembly in 1958 and entered into force in 1959.
The New York Convention has been ratified by more than 160 countries, making it one of the most widely adopted international conventions in the field of arbitration. Its main purpose is to facilitate the recognition and enforcement of foreign arbitration awards by providing a mechanism for their recognition and enforcement in the territories of other contracting states.
Under the New York Convention, a party seeking recognition and enforcement of a foreign arbitration award can apply to the competent court in the country where enforcement is sought. The court is then required to recognize the award as binding and enforce it in accordance with its own procedural rules.
The New York Convention is considered a key instrument for the promotion and development of international trade and investment. It provides a level of certainty and predictability to parties involved in cross-border transactions, as it ensures that foreign arbitration awards are recognized and enforced in a consistent manner across different jurisdictions.

The high court with original jurisdiction to decide the questions forming the subject matter of a foreign Arbitral award will have jurisdiction over an application for enforcement in terms of section 47 read with section 49 of the Arbitration Act.
District court is included in domestic Arbitral award.
